RESOLVED, that the Southold Town Board of Trustees Approve an Amendment to Permit
#5288 to depict (2) proposed tie offpiles at the end of the proposed dock each tie offpile is
proposed to be 5" +/- fi.om either side of the proposed dock, preventing a vessel from mooring
parallel to the proposed dock with the condition that an inspection be made on 4/17/02.

At the meeting of the Southold Town Conseh/ation Advisory Council held Monday,
March 18, 2002, the following recommendation was made:
JOSEPH CORTALE to Amend Permit #5288 to include tie off piles at the end of the'
proposed dock. Each tie off pile is proposed to be 5'+/- from either side of the proposed
dock, preventing a vessel from moodng parallel to the proposed dock.

proposed installation of two splles to prevent moodng parallel to dock
! live at 2100 Glenn Rd, Southold Immediately adjacent to West Creek and have a dock on West
Creek.(permit 1807) installed in 1984. Ply property is immediately adjacent (upstream} to the
property for which the ~nced permit covers.
A headng notice of an amendment to an existing dock permit (5288) ~ on a tree on the
property adjacent to mine was brought to my attention the other day. The wording was cudous
in that it proposed two splles to prevent mooring parallel te the dock. Not knowing that a dock
permit had even been issued for this property, ! visited the trustees office to inspect the file. Lo
and behold, ! found that a permit had been issued on February 26m, 2001 for a then "L" shaped
dock extending into the creek for quite some distance. On arriving home a registered letter from
the applicants representative had arrived with a sketch of a fixed dock and the requested
amendment.
I had been advised by registered letter on .lan. 9u~,2001 of the Initial application and learned
when calling the Trustee office that the hearing had been cancelled. I then wrote a letter to the
trustees at that time ( .lan 31st) stating my opinion. Hy letter was in the file as well as a letter
from the Conservation Advisory Cnundl recommending di~rnrnrOval as of a lanuary 31s: meeting
citing its opinion that the dock was too large for the creek. !t was also noted when examining
the file that the design of the dock had been modified several times since the initial approval.
What is further confusing is that on April 9u~ 2001, ! again received, as an adjacent property
owner, another letter with a new sketch calling for a 25 foot ramp and a 20 x 6 float. ! don't
recall attending the hearing, if one was held, possibly assuming wrongly, that the Town Trustees
would adhere to past policy. What action was taken by the trustees is not clear but a letter in the
file from Susan Ackerman of the NYDEC permit off'~e on March 20th indicated that thirty inches
on water should be present under a floating dock at Iow tide. What beating this had on the
application was not clear.
I called Susan Ackerman, since my dock as well as the other three existing docks on this side of
West Creek have nowhere near this depth of water. She stated that this is only a policy and that
the DEC has no regulations on docks in regard to size, distance from shore, etc and this policy is
more intended for large boats. She did not think it of concern when I pointed out that there is
only seven/~ clearance under the Goose Creek bridge prohibiting the ent~nce of large boats.
Apparently the dock design was again changed once again, eliminating the float and going to a
fixed dock. Applicant's latest sketch shows a fixed dock extending out to 2.5 f~et of water at Iow
tide. It does not get much deeper than that in this area of the creek.
What seems highly unusual about this permit is that it grants permission for a fixed dock to
extend into the deeper waters of the creek in an area where, up to now, floating docks closely
parallel to the shore have been encouraged, and in fact, insisted upon. It also violates the
published policy of the Board of Trustees which states "All docks shall be kept as dose to the
shoreline as possible, so as not .tO impede navigation or ~ beyond the existing pier lirle".
There is an additional line of policy which states "All docks with a boat at it shall be no further
than 1/3 across the width of the creek". The applicant's sketch shows a creek width of plus or
minus 80 foet. One third would be 26.4 feet. There has been a 2"x2" stake visible only at lower
tides placed in the creek at the site and Is assumed to indicate the end of the ~lock. This stake is
8 good twenty five feet from the.creek bank. Add the seven foot.beam of 8 boat and you are out
over thirty feet. There is nothing in the file revealing any mitigating circumstance that might
require the Board of Trustees to suspend or deviate from their published policies.
My dock permit (1807) issued Adl 30, 1984 contains the provision" that the float does not go
out more t~an 10 lc. from the bank into the water". I believe I pointed this out tn my previous
letter to the trustees. At the time Henry Smith along with the other trustees present, said that no
greater than ten f~4c would be approved so as not to interfere with boaters upstream. Ny dock
probably does not extend more than five or six f~et from ALWN. If the Trustees followed their
published policy, they would have drawn a line from the outside of my dock to the outside edge
of the next eastern dock and insisted the proposed dock be kept it within this limit.
The problem of this dock as approved by the Trustees Is that it simply extends too far into water
that can be considered navigational as It Is used for passageway in and out of the creek. Tt
presents not only a navigational hazard but also a safety hazard for those boaters entedng the
creek on a dark night.
! am at a loss to understand the actions of the board, especially in view of their previous record
of preserving navigational waters and disallowing extended dock structures in limited space. Tt is
especially strange in light of recent public statements by some trustees concerning docks being
built in excess of their approved limits and the enforcement of Board policies. The fact that an
amendment is now reduimd to install additional spiles further indicates the lack of foresight in
the approval of the application.
The change of policy and Issuance of this permit by the board will invite other dod( owners
induding myself, who have been restricted to floating docks in shallow water, to reapply for
amended permits extending their docks into deeper water. This may interfere with boating
access but the board has seemingly ceased to use this as a criteria.
! should also point out in regard to the proposed installation of additional spiles, that they will be
directly in line with the course ! take leaving my dock to Goose Creek! Therefore ! am firmly
against approval of this amendment. For your information ! am furnishing neighbors with a copy
of this letter.
I don't like opposing future neighbors but this approval granted by the trustees for a fixed dock
will not only interfere with, but present navigational and safety hazards to the boaters using this
creek and should have been denied.

construct a recreational dock facility consisting ofa 4'x35'fixed CCA dock with a 6" dia timber
tie off pile 10' eat of the dock (8) 4'x6" timber posts are proposed to support the dock facility.
A 4'x40' natural wood chip path is proposed to access the dock facility. A 4'x40' natural wood
chip path is proposed to access the dock facility. With the stipulation that the boat secured not be
1/3 across the channel.
However, this permit does not constitute any other permits from other agencies.

Dear Mr. Krupski:
Enclosed please find (7) sets of pho~ographs in regards to the above referenced project. These
photographs illustrate the neighboring dock facilities to the project site es well as evidence of a shoal at
the project site. Although the existing facility to the west is approximately 15'+/- from the ALWM, there is
a scarp off of a tidal fringe with no shoal, yielding deeper water thus a shorter facility. At the above
referenced project site the scarp is less prevalent and a shoal projects out into the creek, thus a
proposed dock facility at this location has to project further into the creek to achieve an appm~ate water
depth. This shoal is also reflected in the neighboring dock facility to the east, which projects further into
the creek then the existing facility to the west. Evidence of this shoal is also reflected by the sounding
data recorded by the NYSDEC, which was also verified by our offioa on a recent site visitation June 13,

Dear Mr. Krupski:
Enclosed please find (7) sets of revised plans in regards to the above
referenced project. These plans indicate that the sounding data has been updated as
per a NYSDEC site visitation in March. Their data indicated that the proposed dock
facility did not sit in the minimum water depth they require, (-2.5'). In order to meet this
depth the ramp has been extended 7', thus the float is 7' seaward. No other aspect of
the proposed facility has been changed from the above referenced permit. I have
enclosed (7) copies of the NYSDEC letter confirming this amendment request. Please
contact our office if there are any questions, or if the trustees would like this facility
staked again.
Also enclosed please find the affidavits associated with this project which should
have been submitted at the last meeting.

RESOLVED to recommend to the Southold Town Board of Trusteas DISAPPROVAL of the'
Wetland Permit Application of J~$EPIt CORTALE 78-2-39 to construct a 4'X 40' fixe,d CCA
timber dock, 3'X 20' ramp and ~;~X 20' float. Fixed dock to be elevated a min. of 4' above
grade. Ramp and float to project off the fixed dock at a "L" configuration. Float supported by
(2) 6" diameter timber piles on the landward side of the float. A 4'X 75' natural wood chip
access path is proposed from the residence to the proposed dock facility. A light post with an
electrical outlet is proposed near the end of the fixed dock.

The CAC recommends Disapproval of the application as submitted. The applicant must conform
to the Trustees Policies with regards to the length of docks on the creeks. The proposed dock
seems excessive for the area. A 50' non-disturbance/non-fertilization buffer must be maintained

The following action was taken by the Board of Town Trustees during its regular meeting held
on Wednesday, February 21, 2001 regarding the above matter:
WHEREAS, Land Use Ecological Services on behalf of JOSEPH CORTALE applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated December 26, 2000 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
February 21, 2001 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JOSEPH CORTALE to
construct a 4'X 12' fixed CCA timber dock, a 3'X 18' ramp and a 6'X 20' float, elevated 2.5'
above grade at the tidal wetlands line. The ramp and float are to project offthe fixed dock at an
"L" configuration. The float will be supported by (2) 6" dia. CCA timber piles on the landward
side of the float. A 4'X 40' natural wood chip access path installed from the residence to the
dock facility and a light post with an electrical outlet to be located near the end of the fixed dock,
all with the condition that there are no hand-rails on the ramp and a 50' non-disturbance buffer is
maintained landward of the structure.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

Gentlemen:
As an adjacent Property owner to the property referenced in the above listed application
number, I want to make the following comments.
1:
The location of the dock has been staked and there is a broken tree limb, with sur-
veyer's ribbon attached, placed out in the creek through the ice, the creek having been
iced over for the past several weeks. I have to assume that this tree limb marks the
distance that the dock will project into the creek but it is not clear as to which part of
the dock it represents.
2:
At present there are four floating docks at this end, and on this side of the creek (four
of the first five lots as one enters the creek}. There is also a new floating dock on
opposite side which, while not directly opposite the proposed dock, is for practical
purposes - opposite.
3: All of the existing docks, with one exception at the creek entrance, follow the same
form with right angle ramps and in close proximity to the shore.
4;
The permit for my dock issued in 1984 (copy attached) limits my dock to a maximum
projection often feet from the bank. This is now probably more like twelve feet as
substantial erosion of the bank has taken place and the catwalk supports originally
placed back eighteen inches from the edge are now in water. A twelve foot limit
seems more reasonable and practical in this area, and even at this limit all of the
docks on this side of the creek partially rest on the bottom at low tide.
If the proposed dock is allowed to extend to the marker that has been placed in the
creek it may well present a navagational hazard as it will seriously, in combination
with the existing dock on the opposite bank, restrict the navagational width of the
creek.
6: If these comments are noted and the proposed dock is prevented from becoming a
navagational baTard and is constructed in conformance with the existing docks, I have
no further comments on the application.

Project Description:
Rev: (2-15-01), (2-22-01)
The applicant proposes to construct a recreational dock facility consisting of the
following:
- 4' x 12' fixed CCA Timber Dock
- 3' x 18' Ramp
- 6' x 20' Float
The proposed fixed dock is proposed to be elevated 2.5' above grade at the tidal
wetlands line. The ramp with a float which is proposed to project off at a "L"
configuration are to be removed seasonally, as is represented on the project plans.
The float is proposed to be supported by (2) 6" Dia CCA Timber piles on the landward
side of the float. A 4' x 40'+/- natural wood chip access path is proposed from the
residence to the proposed dock facility. A light post with an electrical outlet is
proposed near the end of the fixed dock.
