SOUTHOLD TOWN BOARD OF Reference: Dock Permit 5288 WADE & LORETTA HINDERLING · 38 Pickwick Road Manhasset N.Y. 11030 April 1 2002. It has come to our attention that a new dock is being planned on West Creek (permit 5288). We live on West Creek slightly upstream from this proposed dock. It is our understanding that the planned dock may end up some 30 feet out from the shore line. We find it rather odd that a new dock should extend out from the shore line double the distance Of the 4 existing docks in this area. Anyone who navigates West Creek knows that the so-called channel at low tide is aproximately 30 inches deep and about 10 feet wide but more importantly Is MOSTLY NORTH of a center dividing line from shore to shore. Most of the area south of center has 10 inches of water or less at iow tide and is non-navigable. The proposed dock would place a boat squarely in the RIGHT OF WAY. We don't think that anyone should have the right to block the right of way of the 40 or so boaters that live upstream. Thank you for your consideration in this matter. Albert J. WHEREAS, Land Use Ecological Services, Inc. on behalf of JOSEPH CORTALE applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated July 5, 2001 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 25, 2001 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. WHEREAS, the Board has determined that the project as proposed will not affect the health, Safety and general welfare of the people of the town, 2 NOW THEREFORE BE IT. RESOLVED, that the Board of Trustee approved the application of JOSEPH CORTALE for a Wetland Permit to cons~'uet a 3,380 s.f. +/- residence and a 1,620 s.f. pervious driveway, proposed septic system will consist of a septic tank and (5) leaching tings. The residence is proposed to be setback 90 +/- from the Tidal Wetland Line, the sanitary system is proposed to be setback 100 + from the Tidal Wetland Line. With all of the proposed activities the adjacent area coverage for non-pervious access is proposed to be 14.4% .With the stipulation there be a 50' non-disturbance buffer fi.om the wetland edge - with haybales. BE IT FURTHER RESOLVED that this determination should not be considered a determination 'made for any other Department or Agency, which may also have an application pending for the same or similar project. Permit to construct project will expire two years fi.om the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification.
