Dear Mr. Mazzella:
The Trustees have been contacted by the landscaper Louis Caracciolo regarding the
location of a pool and fence on the above referenced property. The Trustees visited your
property on November 15, 2004 to determine the location of the wetlands and the
required buffer.
Please note the enclosed survey and permit which were approved when the house was
built. The survey indicates/requires a 20' wide non-disturbance non-fertilization buffer to
protect the wetland area. When the Trustees were there they found that while there are
some trees along the berm most of that area has been cleared.
The Trustees require that the area be planted with fresh water wetland buffer species of
shrubs and trees. Enclosed is a list of appropriate species for the area.
We are sending a copy of the species list to Mr. Caracciolo who indicated that he will be
planting the required buffer.
At the completion of the planting you will be required to apply to the Trustees for an
application for the pool.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 29, 2001 regarding the above matter:
WHEREAS, Catherine Mesiano, Inc. on behalf of SCHEMBRI HOMES, INC., applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated March 7, 2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
August 29, 2001, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of SCItEMBRI HOMES,
INC. to construct a 31'X 56' single-family residence with pervious driveway, on-site sewage
disposal system, public water and drywells to contain the roof run-off, with the conditions shown
on the survey dated August 23, 2001, and with the condition that the Town Engineer must
inspect the proposed trench, as stated in the letter from Jeffrey T. Butler, P.E. dated August 23,
2001.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to coustmct and complete project will expire two years fi'om the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

the CAC would recommend to the Southold Town Board of Trustees' DISAPPROVAE of

single-family residence with pervious driveway, on-site sewage disposal system, public
water, and dryweils to contain the roof run-off.

Justification
Upon the trustee's request, the CAC has closely looked at application 113.4-t
C & D Realty, and has concerns regarding the proposed project. Currently, as
of 3/16/0t the council is researching Information regarding septic systems and
setbacks from wetlands, and hes produced significant findings from West
Virginia University and additional sources. Both of the above applications have
similar environmental concerns in regards to the septic setbacks and the
potential negative impacts to natural systems of Southold Town. Additional
Natural Resource concerns apply to wetland application 56-7-13 Schambri
Homes. The NYS DEC Non Jurisdiction origin for this permit, allows the Town
and it's Trutes's to conserve/manage these smaller yet integral natural
environments for the good of the Town and it's natural systems within.

The following is the survey ( tax map# ~.000-56-07-13)for the residence we spoke of. Our intent is to design an
in ground pool for the customer into the Northeast corner of the rear yard. As there is very little room behind the
home for the required fencing, the homeowner is requesting that you consider placing the fence directly behind
the established burm so as not to completely close them in. The non-disturbance zone is less than 19' off the back
of the house, as you can see. The fencing would be a chain link style and we would install it as to not disturb any
existing vegetation.

Attached please find a copy of a site plan for the above referenced site.
Please note that a drainage trench is proposed along the east boundary of the non
disturbance buffer in the front yard. The proposed trench is intended to capture and
percolate normal rainfall runoff from the site so as to not interfere with Hashmomaque
pond.
The proposed trench shall be excavated to suitable drainage soil. All unsuitable leaching
soils shall be removed and replaced with suitable percolating soils (sand and gravel).
The excavation must be inspected by the towns authorized representative prior to
backfill.
Site conditions will dictate the full extent of the excavation, backfill and finished grades.

Dear Schembri Homes:
Based on the information you have sul3mitted, the New York State Department of Environmental
ConserVation has determined that:
Your parcel, lot # 26 on Albacore Drive, South01d, NY, $CTM# 1000-56-07-13, is more than
100 feet from New York State Department of Environmental Coneervetlon regulated
freshwater wetlands and is greater than 300 feet from the tidal wetland boundary, as shown
on the survey by Joseph Ingegno dated OCtober 6, 1999, last revised September 12, 2000.
Therefore, no permit is required under Article 24 ( Freshwater Wetlands) or Article 25 (Tidal
Wetlands) of the Environmental ConserVation Law.
Be advised, that all construction, clearing, excavation, filling, and/or other ground disturbance must
remain more than 100 feet from the freshwater wetland boundary.
Aisc be advised that no construction, sedimentation, or disturbance of any kine may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit.
It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal
Wetlands and Freshwater Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the jurisdictional boundary and
your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier, or hay
bale berm. In addition, any additional work, or modification to the project as described, may require
authorization by this Department. Please contact this office if such are contemplated.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
