In March of 2005, we applied and received a Letter of Non—Jurisdiction from your Board. Attached herewith please find a copy of the Letter of Non- Jurisdiction along with a copy of the survey prepared by Joseph A. Ingegno marked received by the Trustees March 23, 2005 ("LNJ Survey"). The 100-foot jurisdictional boundary was staked in the field by the then surveyors Young and Young and hay bales were deployed along this boundary all in accordance with the LNJ Survey. The parcel was cleared landward of the 100-foot jurisdiction. Subsequently, this Firm determined that the actual wetland boundary was significantly landward of the wetland boundary determined by the Town and DEC in the processing of the underlying subdivision which subdivision was approved by the Town in 2004. 1 have sketched the location of the actual wetland boundary on the LNJ Survey and have highlighted the actual boundary in yellow. The mapped approved wetland boundary (by the Town and DEC) is highlighted in green. The clearing of the building envelope in accordance with the LNJ Survey resulted in a violation with the NYSDEC and possibly with your Board, even though the applicant followed and relied upon the wetland boundary approved by the Town and DEC for the subdivision. The DEC violation was resolved by the relocation of the proposed structures and the agreement to implement a planting plan prepared by this office. An additional non-disturbance buffer (beyond what was required by the Town and DEC for the underlying subdivision) was also established. Enclosed herewith please find: Two copies of the survey prepared by Joseph A. Ingegno last dated April 26, 2006; and Two copies of the planting plan prepared by this Firm dated May 4, 2006. By way of this correspondence, I request that you rescind the previous Letter of Non-Jurisdiction as it was not reflective of the true wetland boundary and issue a new letter of non jurisdiction or permit authorizing the proposed dwelling and plantings consistent with the revised survey and planting which plans and surveys show the actual wetland boundary. Ingegno last dated March 4, 2005 and determined the proposed construction of a single-family dwelling, swimming pool, pool house, and retaining wall to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. 4 However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office.
