Dear Mr. King,
This Firm represents Giancomo Chicco who owns the property referenced
above. In March of 2005, we applied and received a Letter of Non—Jurisdiction
from your Board. Attached herewith please find a copy of the Letter of Non-
Jurisdiction along with a copy of the survey prepared by Joseph A. Ingegno
marked received by the Trustees March 23, 2005 ("LNJ Survey").
The 100-foot jurisdictional boundary was staked in the field by the then
surveyors Young and Young and hay bales were deployed along this boundary
all in accordance with the LNJ Survey. The parcel was cleared landward of the
100-foot jurisdiction.
Subsequently, this Firm determined that the actual wetland boundary was
significantly landward of the wetland boundary determined by the Town and DEC
in the processing of the underlying subdivision which subdivision was approved
by the Town in 2004. 1 have sketched the location of the actual wetland
boundary on the LNJ Survey and have highlighted the actual boundary in yellow.
The mapped approved wetland boundary (by the Town and DEC) is highlighted
in green.
The clearing of the building envelope in accordance with the LNJ Survey
resulted in a violation with the NYSDEC and possibly with your Board, even
though the applicant followed and relied upon the wetland boundary approved by
the Town and DEC for the subdivision. The DEC violation was resolved by the
relocation of the proposed structures and the agreement to implement a planting
plan prepared by this office. An additional non-disturbance buffer (beyond what
was required by the Town and DEC for the underlying subdivision) was also
established.
Enclosed herewith please find:
Two copies of the survey prepared by Joseph A. Ingegno last dated
April 26, 2006; and
Two copies of the planting plan prepared by this Firm dated May 4,
2006.
By way of this correspondence, I request that you rescind the previous
Letter of Non-Jurisdiction as it was not reflective of the true wetland boundary
and issue a new letter of non jurisdiction or permit authorizing the proposed
dwelling and plantings consistent with the revised survey and planting which
plans and surveys show the actual wetland boundary.

The Southold Town Board of Trustees reviewed the survey prepared by Joseph A.
Ingegno last dated March 4, 2005 and determined the proposed construction of a
single-family dwelling, swimming pool, pool house, and retaining wall to be out of the
Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the
Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.

However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.

which was approved by New York State Department of Environmental
Conservation (tidal & Freshwater Wetlands Permit No. 14738-03150/00001), issued
December 19, 2003, authorizing to "Subdivide a 10.4 acre parcel into 12
residential lots and two open space reserve areas..." and which authorized
predetermined building envelopes within each lot, including subject lot.
Accordingly, please note that the proposed improvements referenced above are
to occur wholly within the previously authorized building envelope thereon.

being significantly setback from the vegetated edge of the
wetlands boundary, and the utilization of staked haybales and
siltation fencing during construction to prevent any and all
run-off from entering subject wetlands.

This proposal is to be situated within a previously approved
building envelope resultant from the underlying Subdivision,
which was approved by state, county and local regulatory
agencies, including the Town of Southold Planning Department,
and accordingly, will be substantially set back from both
wetlands and the top of the bluff along the northern section of
subject property. Therefore, with regards to the design of the
project, as well as the environmental concerns being positively
met with the issuance of the underlying subdivision approval,
we believe that no adverse impacts to the surrounding
environment are expected during and after construction of this
project.

Dear Mr. Krupski,
This Firm represents Mr.Chicco, owner of the property referenced above, who wishes to improve
thereon. Accordingly, approval from your Department is required. Please note that this property
is known as Lot 10 of the Cove Beach Estates subdivision, which was reviewed and
subsequently approved by the Town of Southold Planning Board on June 29, 2004. Resulting
from the creation and approval of this subdivision were conforming building envelopes within
each newly created lot, which were dictated in size and design by maintaining compliant setbacks
from both the edge of wetlands and the top of the bluff along the northern section of subject
subdivision, including Lot 10. Consequently,activities within a building envelope will conform
with all typical regulatory requirements of your Board for administrative approval. In view of
that, we wish to emphasize that all structural improvements and activities within this application
will take place within the Town of Southold approved-for building envelope within Lot 10,
pursuant to the initial subdivision approval referenced above, and request that this application be
expedited based on these details accordingly.
Enclosed herewith please find a completed Wetland Permit Application. Application contents are
as follows:
(1) Town of Southold Trustees Wetlands Permit Application;
(2) Short Environmental Assessment Form;
(3) Reduced copies of the associated Subdivision Map of Cove Beach
Estates, as approved by the Town of Southold on June 29, 2004,and
highlighting subject property, for reference;
(4) Photographs of subject property, indicating the location of all
proposed structures thereon(two [21 sets);
(5) Location Map for easy reference(two [21 copies);
(6) Survey of subject property, prepared by JOSEPH A. INGEGNO, L.S.,
indicating all proposed structures thereon, last dated March 4, 2005
(two [21 copies); and
(6) Check made payable to the Town of Southold in the amount of$250.00
covering the requisite application fee.
By way of this correspondence, and on behalf of Mr. Chicco, I request that you commence review
of this application and schedule for the next available Board of Trustees meeting for permit
