Telephone S05-2660 MINUTES SOUTP1OLD TOWN BOARD OF APPEALS September 24, 1964 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M., Thursday, September 24, 1964~ at the Town Office, Main Road~ Southold, New York. There were present: Messrs: Robert'W. Gillispie, Jr., Chairman, Robert Bergen~ Fred Hulse~ Jr. Absent: Messrs: Charles Grigonis, Jr., Serge Doyen= Jr. PUBLIC HEARING: Appeal No. 711- 7:30 P.M.,(E.D.S.T.), upon application of John G. Glander, Grathwohl Road, New Suffolk, New York~ for a variance in accordance with the zoning Ordinance, Article III, Section 307, for permission to attach the garage to the house with insufficimnt sideyard. Location of property: east '-side Grathwohl Road, New Suffolk, New York, bounded north by Guido Petrusa, east by Grathwohl, south by Bruno Zuhoski, west by Grathwohl Road. Fee paid $5.00. Southold Town Board of Ap~-als -2- September ~_~ 1964 The Chairman opened the hearing by readingapplication for a variance, legal notice of hearingt affidavit attesting to its publication in the official newspaper, and notice to the applicant. The Board viewed tha application of Mr. Glander. It was observed that the plot plan submitted by Mr. Glander was incorrect~ therefore the Board could not make a decision on this application. Mr. Glander was not present at th e hearing to speak for the application or correct the plot plan. THE CHAIRMAN: Is there anyone present who wishes to object to this application? (There was no response.) On motion by Mr. Hulse~ seconded by Mr. Gillispie, it was RESOLVED that the following letter be sent to Mro Glander concerning his application for a variance: "Dear Mr. Glander: Considering your application for a variance in connection with appeal ~711~ dated June 1, 1964, we are handicapped by our inability to relate the plot plan on the application to the building inspector for a building permit, to the actual dimensions of your plot. Accordingly, we will consider this application, if your will furnish us with the correct plot plan. Meanwhile~ we are holding your application. "We will schedule this for 7:30 P.M., Thursday, October 1964, at which time please be present~ and provide us with correct plot plan. "Very truly yours, /s/ Robert-W. Gillispie, Jr.~ Chairman, Southold~ Town Board of Appeals." Vote of the Board: Ayes:-Mr. Gillispie, Mr. Bergen~ Mr. Hulse. PUBLIC HEARING: Appeal No. 712 - 7:45 P.M.(E.D.S.T.'), upon application of Daniel Smith, Southold, New York, a/c Thomas Pepe, Kenney's Road and Soundview Avenue, Southold~ New York~for a Southold TOWn Board of Appeals -3- September ~4, 1964 variance in accordance with the Zoning Ordinance, Article III~ Section 306, for permission to build an addition with insufficient setback. Location of property: northwest corner of Soundview Avenue and Kenney's Road, Southold~ New York, bounded north by D'~Antonio-Pepe, east by Kenney's Road~ south by-Soundview Avenue, west by Schriever-Great Pond. Fee paid $5.00. The Chairman opened the hearing by reading application for a variance, legal notice of hearing ~ affidavit attesting to its publication in the official newspaper~ and notice ©to the applicant. THE CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak in opposition to this application? (The~e was no response.) After investigation and inspection the Board finds that Thomas Pepe wishes to have an addition constructed onto the existing dwelling. Said addition would violate the required setback from the road. The Board finds that there is no hardship involved, in view of the fact that the lot has more than the required area. The Board also points out that any further addition to the dwelling should conform with all front yard and side yard requirements. The Board finds that strict application of the Ordinance will not produce practical difficulties or unnecessary hardship; the hardship created ~ not unique and would be shared by all properties alike in theimmediate vicinity of this property and in the same use district and the variance does not observe the spirit of the Ordinance and will change the character of the district. On motion by Mr. Bergen~ seconded by Mr. Hulse, it was RESOLVED that Daniel Smith~ Southold, New York~ a/c Thomas Pepe, Kenney~s Road and Soundview Avenue, Southold~ New York, be denied permission to build an addition witk insufficient set- back on property located northwest corner Soundview Avenue~ and Kennye~s Road, Sou~hold, New York. Vote of the Board: Ayes: Mr. Gillispie, Mr. Bergen~ Mr. Hulse. Southold Town Board of Appeals -4-- September ~, 1964 PUBLIC HEARING: Appeal No. 713 - 8:00 P.M.(E.D.S.T.), upon application of Ernest W. Jones~ Mattituck, New York, a/c Gordon Hayes, Nasau Point Road, Cutchogue, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 300~ Subsection 7, for permission to put an accessory building in the front yard area. Location of property: east side Nassau Point Road, Nassau Point Club Property, Inc., Lo~$29a Cutch0 ogue, New York, bounded north by right-of-way, east by Peconic Bay, south by Davis, west by Nassau Point Road. Fee Paid $5.00. The Chairman opened the hearing by reading application for a variance, legal notice of hearing, affidavit attesting to its publication in the official newspaper, ~d notice to the applicant. THE CHAIRMAN: How far are the other garages in the area from the road? ERNEST JONES: Approximately the same distance~ THE CHAIRMAN: Anyone present wish to oppose this application? (There was no response.) THE CHAIRMAN: Are there any other questions? (There was no response.) After investigation and inspection the Board finds that Gordon Hayes wishes to construct a garage in the front yard area. The Board agrees with the reasoning of the applicant. This is a waterfront lot, making it impossible to locate the garage in the back yard area due to the slope in the land. Other garages in the area are also located in the front yard~ therefore, the character of the neighborhood will not be harmed° The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district and the variance does observe the spirit-of the Ordinance and will not change the character of the district. On motion by FLr. Hulse, seconded by Mr. Bergen, it was Southold Town Board of Ap~eals -5- September~z4, 1964 RESOLVED that~ErnestW. Jones, Mattituck, New York, a/c Gordon Hayes, Nassau Point Road, Cutchogue, New York, be granted permission to put an accessory building in the front yard area, on property located east side Nassau Point Road, Cutchogue, New York, subject to the following conditions: 1. The garage should be erected at least 60 feet from the Main Highway. 2. The garage should be erected at least 7 feet from the private right-of-way on the north. Vote of the Board: Ayes: Mr. ~illispie, Mr. Bergen, Mr. Hulseo On motion by Mr. Gillispie, seconded by Mr. Bergen= it was s RESOLVED that the minutes of the Southold Town Board of Appeals dated September 10, 1964, be approved as submitted. Vote of the Board: Ayes: Mr. Gill~spie, Mr. Bergen, Mr. Hulse. Mr. Donald Frederick appeared before the Board for an informal discussion in regard to a variance for an addition to a hQuse on the corner of Kenney~s Road and Wes~and Road, Southolda New York. The Board advised Mr. Frederick that he should fill out an application to the Board. On motion by Mr. Gillispie~ seconded by Mr. Bergeni it was s RESOLVED that the Southold Town Board of Appeals set 7:45 P.M.(E.D. SjT.), Thursday, October 8, 1964, at the Town Office, Main Road, Southold, New York, as time and place of hearing upon application of Donald Frederick, Southold, New York, a/c Charles Essman &'Wife, Kenney~s Road and Wesland Road, Southold, New York, for a special exception in accordance with the Zoning Ordinance, Article III, Section 306, for permission to construct and addition to the existing dwelling with insufficient setback. Location of property: south east corner Wesland Road and Kenney~s Road, Southold, New York, bounded north byWesland Road, east by'Sylvester Smith, south by J.'E. Fontana, West by Kenney~s Road. Vote of the Board: Mr. Gillispiei Mr. Bergen, Mr. Hulse.
