all in accordance with the detailed specifications as presented in
the originating application.

lowing: 1. the Sotuhold Town Trustees Permit must be prominently
displayed on premises e££ected during period of work.

orization was originally obtained.

its agents, and non-compliance with the prov~ions of the ori~nnfing application, may be canoe for
revocation of this Permit by resoindon of the said Board.
5. That there will be no unreasonable interf~ence with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and zepa~ alung
the beach between high and Iow water marks,

of Southold.
8. That the said Board will be notified by the Permlttee ot the completion of the work auth-

RESOVLED to recommend to the Southold Town Trustees approval of
Wetland Application No. 103-10-28.1 of Henry A. Boczek to install a
6' x 20' floating dock and 12' x 4' ramp and two mooring piles at end
of existing dock.

On a motion by Stephen Angell, seconded by Cynthia Sturner, it was
RESOVLED to recommend to the Southold Town Trustees conditional
approval of Wetland Application No. 70-13-20.3 and 20.4 of Joseph
Corna¢chia to construct 308 I.f. of bulkhead within 18" of existing
functional bulkhead, including 20 I.f. to close opening to naturally
filled channel; drede lagoon to average 4' below MLW yielding estimated
3900 c.u. of spoil; use spoil to backfill behind new bulkhead, to backfill
non-functional channel and to nourish beach. The Council approves
the bulkheading as submitted. The Council approves the dredging
with the condition that the project "link up" with the Koke dredging
project after it receives DEC approval. The dredging should not be
done if there will be no link up because it would create a "pothole"
and prevent proper flushing. The dredging should not commence until
the Koke project is complete. Of course, recommendation of conditional
approval is to be considered only after the ownership of questionable
areas is established.

On a motion by John HOIzapfel, seconded by Bruce Loucka, it was
RESOVLED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 110-7-12 of Pecluash Club to construct a
timber bulkhead 100' long with a 10' return. The Council recommends
disapproval because the bulkhead may destroy the beach in front of
it. The beach should be stabilized by planting natural vegetation (beach
grass, etc.) and keeping people off the beach. Concrete only
exacerbates the situation.

On a motion by Stephen Angell, seconded by Bruce Loucka, it was
RESOVLED to recommend to the Southold Town Trustees approval of
Wetland Application No. p/o 122-3-14 (lot 3) of Alarn Cardinale to c~nstruct
a catwalk, platform ramp and float to piles. The Council suggests
the applicant extend the catwalk and send the ramp from the catwalk
to float and eliminate the stairs.

Recommendation of Wetland Applications
On a motion by Bruce Loucka, seconded by John McCormick, it was
RESOVLED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 78-5-16 of James Grathwohl to construct
a single family dwelling, sanitary system, well, bluestone driveway and
construct a dock consisting of: 4' x 10' fixed elevated (4' above grade)
walk; 3' x 16' hinged ramp; two 6' x 16' floats secured by three 8"
diameter pilings. The CAC recommends disapproval because the house
and septic system would be within the 100' wetland buffer area and
the leakage from the cesspool could be excessive with the buffer area.
The CAC recommends disapproval of the ramp and dock because it extends
29' out into the channel, going half way across the channel and would
result in hazardous navigation of the channel.

On a motion by John Holzapfel, seconded by Cynthia Sturner, it was
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 116-4-16.4 of Nell McGoldrick to maintenance
dredge a channel within Halls Creek and approach channel from Freat
Peconic Bay. The Council recommends disapproval I~ecause it feels
that this application cannot be considered a maintenance dredging project
and suggests the applicant reapply not as a maintenance project but
as an original dredging project.

On a motion by Bruce Loucka, seconded by John Holzapfel, it was
RESOVLED to recommend to the Southold Town Trustees approval with
stipulations of Wetland Application No. 70-6-9 of Renato Starcic to constuct
a 4' x 95' fixed elevated (4' above grade) pier (including inclined ramp
on inner end). Install three mooring pilings. The Council recommends
approval i._~f the project length is cut down so it soesn't interfere with
anyone already moored. The Council feels the project, as submitted,
is too long and will present navigational problems since moorings are
already present.

Since we have not received a response to our letter dated February 28,
1991 (copy enclosed) requesting additional information on the above-referenced
project, we cannot commence our review of your federal consistency
certification. Please be advised that the U.S. Army Corps of Engineers
cannot issue a permit for this project unless the Department of State concurs
with your consistency certification. A copy of this letter has been sent to
the U.S. Army Corps of Engineers.
Because of your failure to respond in a timely manner, we are closing the
file on your application. Should you desire to reapply at some later date,
please submit a new Federal Consistency Assessment Form (FCAF) and complete
maps, site plans, sketches, photos, and description of the proposed project at
that time.

A detailed description and pla~s of the applicant's activity are
enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation
of the probable impact, including cumulative impacts, of the activity
on the public interest. That decision will reflect the national
concern for both protection and utilization of important resources.
The benefits which reasonably may be expected to accrue from the
activity must be balanced against its reasonably foreseeable
detriments. All factors which mgy be relevant to the activity will be
considered including the cumulative effects thereof; among those are
conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, land use, navigation, shoreline erosion and
accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food production and, in general, the needs and
welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal,
state, and local agencies and officials; Indian Tribes; and other
interested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by.
the Corps of Engineers to determine whether to issue, modify, condition
or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties,
water quality, general environmental effects and the other public
interest factors listed above. Comments are used in the preparation of
an Environmental Assessment and/or an Environmental Impact Statement
pursuant to the National Environmental Policy Act.(NEPA). Comments are
also used to determine the need for a public hearing and to determine
the overall public interest of the proposed activity.
It is requested that you communicate the foregoing information
concerning the activity to any persons known by you to be interested
and who did not receive a copy of this notice.

WORK DESCRIPTION
The applicant, Joseph Cornaccia, has requested Department of the Army
authorization to construct a new bulkhead, dredge with attendant
backfill, and beach nourishment in Jockey Creek, Shelter Island Sound,
at the Town of Southold, Suffolk County, New York.
The applicant proposes to construct approximately 390 linear feet of
bulkhead within 18 inches of the existing one, dredge to 6 feet below
mean low water an irregularly shaped lagoon, and dredge open a small
channel to Shelter Island Sound, removing approximately 4,000 cubic
yards of material. The applicant has also stated that some of the
dredged material would be used as backfill behind the proposed bulkhead
and the rest would be used for beach nourishment. Ail work would be
performed in accordance with the attached drawings.
The stated purpose for the project is to protect the applicant's
property from the effects of erosion and to provide adequate navigation
depths for the applicant's vessel.

Any person may request, in writing, before this public notice expires,
that a public hearing be held to collect information necessary to
consider this application. Requests for public hearings shall state,
with particularity, the reasons why a pu~.lic hearing should be held.
It should be noted that information submitted by ~all is considered

weight as that furnished at a public hearing.
Pursuant to Section 7 of the Endangered Species Act 116 U.S.C. 1531)
and based upon a review of the latest published version of the
threatened and endangered species listing, a preliminary determination
is that the activity under consideration will not affect those species
listed or their critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible for, or
included i~, the Registe~ within the ~ermit area. Presently unknown
archaeological, scientific, prehistorical or historical data may be
lost by work accomplished under the required permit.
Reviews of activities pursuant to Sect%on 404 of the Clean Water Act
will include application of the guidelines promulgated by the
Administrator, U.S. Environmental Protection Agency, under authority of
Section 404(b) of the Clean Water Act and the applicant will obtain a
water quality certificate or waiver from the appropriate state agency
in accordance with Section 401 of the Clean Water Act prior to a permit
decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972
as amended [16 U.S.C. 1456(c)], for activities under consideration that
are located within the coastal zone of a state which has a federally
approved coastal z~ne 9anagement program, the applicant has certified
in the permit application that the activity complies with, and will be
conducted in a manner that is consistent with, the approved state
coastal zone management program. By this public notice, we are
requesting the state's concurrence with, objection to, or waiver of the
applicant's certification. No permit decision will be made until one
of these actions occur. For activities within the coastal zone of New
York State, the applicant's certification and accompanying information
is available from the Consistency Coordinator, New York State
Department of State, Division of Coastal Resources and Waterfront
Revitalization, Coastal Zone Management Program, 162 Washington Avenue,
Albany, New York 122314 Telephone (518) 474-3642. Comments regarding
the applicant's certification should be so addressed.

The following action was taken by the Board of Town Trustees
during their regular meeting held on June 22, 1989 regarding the
above matter:
WHEREAS, Proper T Services on behalf of Joseph Cornacchia applied to
the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated March
29, 1989 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and reco~uendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on June 22, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that Proper T Services ON BEHALF OF Joseph Cornacchia BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct 4' x 14' ramp, 4' x 60 floating dock, install 3 pilings at
property located on Kimberly Lane, Southold, N.Y.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.
