Relocate an existing 3 foot by 14 ramp, and three
4 foot by 20 foot floats secured to seven 8-inch
diameter pilings approximately 9 feet to the south
onto adjoining applicant's parcel. Remove two 8-
inch diameter mooring piles and one 2-pile
dolphin. The purpose of this project is to
relocate the mooring facility onto a parcel
containing a primary dwelling.

As this is minor in nature, authorization may be by'Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicant
has certified that the activity complies with and will be
conducted in a manner that is consistent with the. approved state
coastal zone management program.
To allow for the timely processing of the subject
application, your comments are requested within 15 days of
date of this letter.

Members oftbe Board:
During the 26 January 2000 public hearing held on the captioned application, the Board
requested documentation regarding the legal status of the dock and the apparent right-of-way
over the subject property to the "park and recreational area" depicted on the owner's survey.
In response to that request, please find attached copies of Trustees Permit No. 3733, issued for
construction of the dock on 23 June 1989, and Permit No. 3972, issued for reconstruction oftbe
subject bulkhead on 17 January 1992. As we have not yet been able to obtain a final answer
regarding the right-of-way, however, we request that the reopening of the public hearing be
postponed until March.
