Re: PATRICK KELLY SCTM#71-2-6 Dear Ms. Gralton: The following action was taken by the Board of Town Trustees during its regular meeting held on April 21, 1999 regarding the above matter: WHEREAS, Inter-Science Research Assoc. Inc. on behalf of PATRICK KELLY applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated March 18, 1999 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 21, 1999, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees grant a Wetland Permit to PATRICK KELLY to construct a 20'X 40' in-ground swimming pool approx. 50' from the bulkhead and a 1300 s.f. brick and sand at-grade patio located approx. 45' from the bulkhead with the condition that the buffer be maintained as it is to date, and drywells be installed for the backwash of the pool. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification.
