Transfer of Wetland Permit #5171 from Bernard Kiernan to Joseph Buczek & Christina
Spornberger, as issued on May 24, 2000 and Amended on June 21, 2000.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

We are presently writing you regarding this applicalion you recently
approved at the 5/24/00 meeting. At the present, we have been made aware
of a change to the project proposal. The applicant now wishes to reconstruct
the _+ 157' of bulkhead within 18" instead of in kind in place as originally
depicted. The returns shall be reconstructed in kind in place as well as decks
and slairs, this portion of file project shall not chmage. I have enclosed a
copy of the revised plata and section depicting this modification. Please ~el

Dear Mr. Just:
The following action was taken by the Board of Town Trustees
during a regular Meeting, held on May 24,2000, regarding the
above matter.
WHEREAS, BERNARD KIERNAN, applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated May 2, 2000 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 24, 2000, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
BERNARD KIERNAN to reconstruct in kind/in place +/- 157' of
timber bulkhead and two 10' returns and to backfill structure
with +/- 25 c.y. of clean sand to be trucked in from upland
source. To construct a 5'x14'3" deck located landward of the
bulkhead, 5-1/2'x4-1/2' landing located seaward of the bulkhead
and 4x7'6" steps, and remove walkway on beach.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.
