Dear Mr. Just,
The following action was taken by the Southold Town Board of
Trustees at their Regular Meeting on June 23, 1999:
RESOLVED, that the Southold Town Board of Trustees denies the
request for an Amendment to Permit #4957 for the construction of
a 12' return and that the return be removed, and, a planting
plan be submitted for the disturbed area of the the return at
the western terminus of the bulkhead, but that the construction
of a 4' X 5' platform off the new constructed bulkhead with a 3'
X 5' set of stairs for beach access be permitted as per plans
submitted and received May 24, 1999.
However, this determination is not a determination from any
other agency.

TRUSTEE KRUPSKI: We all took a look at this also. They never sent in the planting
plan?
DIANE HERBERT: No, I don't see it. It's not here.
TRUSTEE KRUPSKI: Any comment on this?
TRUSTEE SMITH: Well he really didn't follow the permit procedure that we wanted
recommended. They wanted to do it this way to start with and we said no, you know, and
they went ahead and did it anyway.
RICHARD SMITH: As stated on the Permit, was it allowable to have the return? Was it
open-ended, the Permit?
TRUSTEE SMITH: Well it was supposed to go right into the bank.
TRUSTEE KRUPSKI: Right, we didn't ...
RICHARD SMITH: Oh you did not approve a return anyway.
TRUSTEE KRUPSKI: We specifically didn't approve a return.
RICHARD SMITH: Therefore, has a violation been issued at this point?
TRUSTEE KRUPSKI: No. Nothing has been issued.
DIANE HERBERT: We told him to come in for an Amendment.
TRUSTEE ICRUPSKI: Right. That's what he had in the field that day. He had the DEC
Permit which showed what he built. What's your pleasure?
TRUSTEE KING: I'd hate to approve something that's been done.
TRUSTEE KRUPSKI: Especially since we made a big effort here have it constructed the
way it was supposed to be constructed. It wasn't just like it happened, casually. We'll
can Deny it.
TRUSTEE POLIWODA: I'll make a motion to Deny it.
DIANE HERBERT: And then what does he do if it's already built?
TRUSTEE KRUPSKI: He has to remove it.
DIANE HERBERT: The return?
TRUSTEE KRUPSKI: Yes. Do I have a second on that?
TRUSTEE KING: I'll second. ALL AYES
TRUSTEE KRUPSKI: There's no planting plan in here either. Alright Diane, you'll
have to notify the Bay Constable and he should issue a violation.
DIANE HERBERT: Okay.
HOWARD & VALERIE MICHELSEN request a Waiver to construct a 4'X 12.5'
entrance-way on the front of the house. Located: 860 Rabbit Lane, East Marion.

1999: A check for $3,575.24 was forwarded to the Supervisor's
Office for the General Fund.
II. PUBLIC NOTICES: Public Notices are posted on the Town
Clerk's Bulletin Board for review.
III. AMENDMENTS/WAIVERS/CHANGES:
1. J.M.O. Consulting on behalf of VILLAGE MARINE requests an
amendment to Permit #4882 to reconstruct, inkind/inplace, 340+'
of timber bulkhead and dredge a 10' X 268' area adjacent to
bulkhead to a depth of -4' at ALW, and 200 c.y. of resultant
spoil to be utilized as backfill. Located: Bay Ave.,
Mattituck. SCTM #122-3-15.1
TRUSTEE SMITH moved to approve the application and to charge for
400 c.y. of spoil not 200, TRUSTEE KING seconded. ALL AYES

TRUSTEE KRUPSKI: Glen, I think when we looked at this we didn't
see where you would have the need to put a return on the north
side. Because we would like to see it held tight up against the
bank there.

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Monday, June 21,
1999, the following recommendation was made:
Moved by Scott Hilary, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Amendment Request Application of LOUIS SIRCUSANO 71-1-9 to amend Permit//4957 to
allow for the construction of a 12' return at the western terminus of the bulkhead and the
construction of a 4'X 5' platform off the newly constructed bulkhead with a 3'X 5' set of stairs
for beach access.

The CAC recommends Approval of the application as submitted and further recommends a
violation be issued for the 12' return.

that if a return is needed, that the office be notified as to

Dear Mr. Just:
The following action was taken by the Board of Town Trustees
during its regular meeting held on February 24, 1999 regarding
the above matter:
WHEREAS, J.M.O. Consulting on behalf of LOUIS SIRCUSANO applied
to the Southold Town Trustees for a permit under the provisions
of the Wetland Ordinance of the Town of Southold, application
dated February 3, 1999 and,
WHEREAS, said application was referred to the $outhold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 24, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members
familiar with the premises
and,
have personally viewed and are
in question and the surrounding area,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
LOUIS SIRCUSANO to construct +/- 100' of timber bulkhead
relocated +19' landward than originally proposed location.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.
