That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the tight of the public to pass and rep~ along the beach between high and low water marks. 7. That if future operations of the Town of Sonthold require the removal and/or alterations in the location of the work herein authorized, or i/, in the oplulon of the Board of Tms~.e% the work shall cause unreasonable obstrucnon to free navigation, the said Permirtee will be required, upon due notice, to remove or alter this work or project herein stated without expemes to the Town of Southold. 8. Box 942 Southold, New York 11971 ACTIVITY: Ten years maintenance dredging with beach nourishment WATERWAY: Southold Bay, Shelter Island Sound LOCATION: Southold, Town of Southold, Suffolk County, New York A detailed description and plans of the applicant's activity are enclosed to assist in your review. The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may he expected to accrue from the activity must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the activity will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food production and, in general, the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; agd other interested parties in order to consider and evaluate the impacts of this proposed activity. Any com~.ents received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Consulting IN BEHALF OF Harbor Lights Canal Association applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated March 13, 1990 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on May 24, 1990 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will -not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED THAT J.M.O. Box 1179 Southold, New York 11971 To: From: Da ted: Re: Southold Town Trustees South01d Town Conservation Advisory Council May 22, 1990 Recommendation of Wetland Applications The following recommendations were made by the Southold Town Conservation Advisory Council at its meeting held Thursday, May 17, 1990: On a motion by John Holzapfel, seconded by Margaret Feeney it was RESOLVED to recommend to the Southold Town Trustees approval with conditions Wetland Application No. 3-5-90-79-q.5 submitted by Glenn E. Just/J.M.O on behalf of Harbor Lights Canal Association to maintenance dredge and place spoil on adjacent beach. The CAC approves provided the dredging is delayed until · September to avoid the normal summer complications of dredging and also that · the spoil is contained by haybales, etc. to avoid runoff into the cove side. Harbor Lights Drive, Southold Vote of Council: Ayes: All Motion carried. On a motion by John Holzapfel, seconded by Bruce Loucka it was RESOVLED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 3-6-90-1-4 submitted by J.M.O. Consulting on behalf of William Riley to construct a timber bulkhead and backfill structure with clean sand. The CAC recommends disapproval because no need is shown and a dock is already in place. A .cop~ of this permit or ~pproval and Approved project plans and supplement- ary conditions shall be available at the project site whenever authorized work is in progress. The permi~ sigh enclosed with the perm/t or a copy of approval letter shall be protected from the weather and posted in a conspicious location at the work site until completion of authorized work. At least 48 hours prior to commencement of the project, the permittee shall complete hnd return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the perun[tted work the bottom portion Of that form shall also be completed and returned. .For projects involving activities to be accomplished over a period or more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours to the commencement of resumption of work each year. If project design modifications take place after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The perm/tree is advised that substantial modification may require submiss- ion of a new application for permit. All necessary precautions shall be taken to preclude contamination of any wetlands or waterway by suspended solids, sediment, fuels, solvents, lubricants, epoxy coating, paints, concrete, leachers or any other environmentally deleterious materials associated with the project work. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. The permittee is advised to. obtain any permits or approvals that may be required from the U.S. Department of Army Corps of Engineers, New York District, 26 Federal Plaza, New York ~ 10007, (Attention Regulatory Functions Branch), prior to commencing work authorized herein. The granting of this permit does not relieve the permittee of the responsib- ility of obtaining a grant, easement, or other necessary approval from the Division of Land Utilization, Office of General Services, Tower Building, Empire. Ail dredging shall be conducted so as to leave a uniform bottom elevation free of mounds or holes. Le All spoil material shall be disposed of either in the Atlantic Ocean or at an approved U.S. Government Dumping Ground, as directed by the District Engineer, U.S. Department of the Army, Corps of Engineers. Any spoil material not intended for such water dis- posal shall be removed from the site and disposed of at an approved upland site. All fill and spoil material shall be suitably contained at the work site so as to prevent its eroding, leaching or otherwise entering into.adjacent wetlands and wate~;ays. Ne. All peripheral rip-rap berms, cofferdams, rock revetments, gabione, bulkheads, etc. shall be completed prior to placement of any fill material behind such structures. All. repairs to existing structures shall be confined to replacement of existing structural elements with no change in. design, dimension~ or materials, unless specifically authorized herein. Trustee Smith and Trustee Kujawski would recommend to the Town Board Approval of said application, with the provision that the spoil is removed in a manner consistant with the bulkhead height, and to the satisfaction of Mr. McGuire, the property owner on the ~0~,. side of the canal. Trustee Bredemeyer and Trustee Bednoski would recommend denial. Trustee Bednoski felt that this work was done before the proper permits were secured. He will not approve of any work that is done before permits are secured. Trustee Bredemeyer felt that permits should be secured first, before work is done. He would refer this to the Building Dept. for further action, then take up the matter at a later date. This resolution was lost, due to the split vote. Very truly yours, Henry P.
