TC C Re: Modification/Amendment of Permit # 5320, issued April 26, 2001 1245 Sleepy Hollow Lane (1000-78-01-10.15) This is an application to Amend/Modify a Permit previously issued by the Trustees in the following 2 ways: I am not seeking a variance or exception, nor do I wish to increase anything on the property. I seek to reduce the footprint, ground coverage and increase growth to wetland vegetation with modification/amendment of a Pen'nit previously granted. 1. On the tint modification I seek I have oriented the swimming pool North-South instead of the previously granted East-West, and added approximately 40 square feet decking on the North side of the pool, within the Wetlands setback line, and I have compensated for this addition by eliminating approximately 120 square feet of decking from the Easterlyside. The net effect of this modification is to reduce the coverage of the entire plot and to move the most seaward part of the deck further back from the wetlands. 2. I submit to you an amendment/modification for a dock/catwalk 45' in length, covering a minimum amount of wetlands area, 4' in width, with a piling and pulley phced approximately 25' seaward of the dock Said dock/catwalk would be constructed at the end of the existing path, approximately 15' from the comer formed by the propenyline and the apparent high water mark The previously granted permit approved a catwalk/dock 85' in length 4' wide and 2.5' above grade (with piling) and did not take into consideration - as a result of an error in the plan submitted by my surveyor - the path that goes to the shore of Goose Creek The effect of the previously approved permit would cover the path with a catwalk I submitted this proposal to the DEC and have discussed the matter with Kendall Klett, Environmental Analyst of the DEC in Stonybrook as well as with Chris Arfsten, the DEC inspector who has visited the property and who have approved, from the DEC standpoint, the 45' x 4' x 3.5' high configuration, with piling. The DEC requires 3.5' above grade, more restrictive than the Town Board's 2.5' feet. I honestly do not wish to litigate 1.0' of height and am caught between two jurisdictions! I know the aesthetics of a 2.5' and know wetland vegetation to grow better under a 3.5' dock. I beg the Trustees to grant an amendment/modification of my original Permit, which will allow a 45' catwalk/dock, 4' wide and a more restrictive 3.5' above grade. The dock is purposefully located in the closest seaward position, where k will have the smallest environmental impact on the wetlands area. The area to be transversed by the dock is located approximately 27' from the Nature Conservancy's Howell's Meadow Preserve. The Preserve, and my contiguous property are comprised of "salt hay", and the vegetation to be transversed is the same "salt hay" that has been harvested there since the 1640's and is prolific. I assure the Trustees that I will take all means to see that there remains a healthy growth under the dock The net effect of this modification is to reduce ground coverage by 160 square feet in the wetlands area, and permit greater growth of wetlands plants. Southold I am preparing to build a residence at the above-referenced address. In surveying my property in the "wetlands area", I have come upon storm debris, fallen trees, dead and diseased trees which I seek to remove. Among the approximately 200 trees in the subject area, I seek to remove 8 dead or diseased trees, 2 rotted docks or floats that have washed up on the shore, miscellaneous flotsam (plastic foam), and 2 fallen logs/stumps. I have examined the trees/logs and have enclosed photographs of each. I attest that there are no animals or birds inhabiting these trees, no squirrel nests, bird nests or any habitats that would be injured or destroyed by their removal. None of the trees are rare or endangered. They are indigenous oaks, most of which are smaller than 8' in caliper size. My contractor uses hand-cutting and a large-wheeled farm tractor for removal, not bulldozers or other mechanical means. We both respect our environment and will take care not to disturb the wetland plants. (There are no rare or endangered plant species in the area) There is no plan or intent to expand a vista, clear a meadow, or dear-cut an area. The tree cover goes from medium on the north to dense on the south, and the subject trees are randomly located throughout. I have enclosed a map, keyed to the descriptions and photographs that are enclosed, indicating the location of each of the 12 items. 1. Is a fallen tree, stump and diseased tree next to it. Note the irregular "wavy" growth of this diseased tree in comparison with it's neighbors. 2. The dead tree is on the leE. 3.
