· ~ommen~s: Laumn: As you requested, we submitted a FOIL request to the Town Clerk's Office to
receive copies of the approvals for lhe Hills, but we only received the copy of the permit and no plan, which
is what I'm primarily interested in. I spoke t~ Charlotte this morning, who advised me Ihe plans might be too
large to copy, but I am going to have to ask ~at you do so, as Sue Long is apparently out of her office
indefinitely for health reasons.
Please let me know if this is a pmbiem, but since the permit was for a dock, I suspect that the plans are on
normal paper (8.5" x 'I 1' sheets), as required by the U.S. Army Corps of Engineers.

restrictions having expired on ~anmar~ 1, 1960~ but rather

November 13, 193~o This strip of beach or wate~f~out is s~ow~ on' this

In furtherance of our meeting on August 7. 2000. I have
enclosed additional documentation regarding my clients' above-
referenced application for permission to construct a dock on
their premises located at 360 Oak Avenue. Southold. New York.
Enclosed please find a letter from Commonwealth Land Title
Insurance Company stating that the Hills own the premises
described in Schedule 'A" annexed thereto, which includes the
language: #TOGETHER with all right, title and interest in and to
that portion of the land lying in front of and adjacent to said
plots to the mean high water mark of Goose Creek." I have also
enclosed copies of the deeds into the original subdivider, Oliver
Bros. Building & Construction Corporation, the first deed out of
said subdivider to Fonde. and the deed into my clients. All of
these deeds include the land between the filed subdivision lot
and the mean high water mark of Goose Creek. As a result, it is
obvious that the Hills actually own to said mean high water mark
of Goose Creek. which fact is verified by the letter from
Commonwealth.
In addition to the specific grant of said land between the
filed subdivision lot and the mean high water mark of Goose
Creek. the deed from the subdivider also sets forth, in relevant
part: "_ should owner or owners of plots facing Goose Creek
desire to erect a dock on said land, said owner or owners may do
so providing said dock does not prevent other owners of plots on

Dear Ms. Long:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 25, 2000 regarding
the above matter:
WHEREAS, Susan E. Long on behalf of TIMOTHY & NANCY HILL applied
to the Southold Town Trustees for a permit under the provisions
of the Wetland Ordinance of the Town of Southold, application
dated ~arch 3, 2000, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 25, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standards set forth in
Chapter 97 of the $outhold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
TIMOTHY & NANCY HILL to install a fixed catwalk that will extend
no further out than the eastern and western catwalks, in a
straight line, a 3'X 12' ramp, and a 6'X 20' float secured to
two (2) single-pile dolphins, a set of stairs and a gate, with
the condition that the boat rack and the boat be removed from
the phragmites. Plans dated March 1, 2000, last revised October
25, 2000 and approved October 25, 2000.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

I WOULD LIKE TO OFFER THE FOLLOWING INFORMATION PRIOR TO THE
SCHEDULED FIELD INSPECTION SCHEDULED SEPTEMBER 13TM.
I have been in telephone contact with the NYS DEC. They have not sent me a letter
because I am in total disagreement with the water depths they found during their
inspection. They found appro~ 2.5' of water at the float and requested that we extend
the dock an additional 17' seaward. WE BELIEVE THE NYS DEC IS IN TOTAL
ERROR WrrH THEIR F[NDI2qGS AND WE RI~QUESTED THAT THEY GO TO THE
SITE AND TAKE THE SOUNDINGS AGAIN. My eliant end I took soundings on foux
different occasions and found 40" - 42" each time (~ ALW.
In an effort to save time and to possibly avoid another field inspection, I have placed
stake (the farthest seaward stake) at the 17' mark as requested by the NYS DEC. The
more landward stake represents the location o£the end of the proposed float.
I have also been advised that the NYS DEC wants the catwalk extended landward 15'
and attached to the existing s~awalL

is not adjacent to Town underwater lands.

Dear Mr. Krupski:
I am a Goose Bay Estates property owner, having recently purchased a property on Cedar Drive,
Southold. I write, on behalf of myself and the Goose Bay Estates Residents listed on the
attached sheet, to: (i) oppose the Hill application for a wetland permit; (ii) to express concern
over the issuing of dock and pier permits by the Board of Trustees to property owners within the
Goose Bay Estates community; and (iii) to request the Board to suspend, temporarily, the
issuance of such permits. The basis for this request is that the area in which such dock/piers are
being erected is, in actuality, an area reserved for the enjoyment of the Goose Bay Estates
community as a whole: no property owner, including those Oak Avenue residents with property
abutting this area, has an individual private property right in or to this area.
I have set forth below the facts pertinent to this request for your review.
In or about 1934, the subdivision known as Goose Bay Estates was established as a private
community. The development granted all community residents equal rights of access and
traverse over all property within the community not designated as private property. Included in
this community property is the area marked as "unnamed street", abutting Goose Creek. A copy
of the tax map is attached for your review.
As evidenced by both the Tax Map and the Taxing Authorities of the Town of Southold, the area
described as "unnamed street" on the tax map, belongs equally to all Goose Bay Estates residents
and is now, and has been since 1934, reserved for the quiet enjoyment of, and unobstructed
access by, the residents. The property oxvners on Oak Avenue whose property abuts the
"unnamed street" do not have an individual property right in the unnamed street and waterfront
along their property line; they are not taxed as waterfront properties, nor are they granted, by
deed or otherwise, any greater right, title or interest in this area than any other resident of Goose
Bay Estates.
Notwithstanding the foregoing, the residents of Oak Avenue have and continue to erect
docks/piers on and over the unnamed street and into Goose Creek, infringing the rights of free
access by other community residents.
While we do not wish to interfere ~vith any other resident's enjoyment of this area, we also do
not wish to surrender our right, title and interest in free, unobstructed access to and on the
unnamed street, a property right granted to us upon the purchase of a home within the Goose Bay
Estates community.
Therefore, we respectfully request the Board to place a temporary moratorium on the granting of
Wetland Permits and dock and pier permits in this area to permit further investigation into this
matter by both the Goose Bay Estates residents and the Town Attorney.
