A regular meeting of the Southold Town Board of Appeals
was held at 7:30 P.M.s Thursday~ November 19~ 1964~ at the
Town Office~ Main Road, Southold~ New York.

PUBLIC HEARING: Appeals NO. 724 - 7:30 P.M.(E.-S.T.~ upon
application of'Lester and Lillian Wallance~ Ketcham Lane, East
Marion~ New York, for a variance in accordance with the
Zoning Ordinance~ Article III~ Section 307~ for permission to
attach a breezeway and garage to the house With insufficient
side yard. Location of property: east side KetchamLane,
East Marion,. New York~ bounded north by F. Begora~ east by
F. Preston~ south by F. Begora~ west by Ketcham Lane. Fee paid

The Chairman opened the hearing by reading application
for a variance~ legal notice of hearing~ affidavit attesting
to its publication in the official newspaper, and notice to
the applicant.
(The Board and Mr. Wallace discussed the size of the lot
and the dimensions of the proposed addition as well as the
existing dwelling.)
THE CHAIRMAN: Is there anything else you want to bring
out?
MR. WALLANCE: NQ~ ~_othing more, than that I want this
to improve the living conditions of my family.
THE CHAIRMAN: Does anyone wish to speak against this
application2

The CHAIRMAN: Are there any questions about-this application?
(There was no response.)
After investigation and inspection the Board finds that
Mr. Wallace wishes to add a garage and breezeway to the existing
dwelling~ with insufficient side yard. The Board is in agree-
ment with the reasoning of the applicant. The rear yard area
normally available for a garage is occupied by two cesspools.
The overall size of the lot is in excess of the mininum required
by the Zoning Ordinance.
The Board finds that strict application of the Ordinance
will produce practical difficulties or unnecessaryhardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance does observe
the spirit of the Ordinance and will not change the character
of the district.
On motion by Mr. Gillispie, seconded by Mr. Hulse~ it was

RESOLVED that Lester and Lillian Wallace, Ketcham Lane,
East Marion, New York, be granted permission to attach a
breezeway and garage to the existing dwelling with insufficient
side yard, on property located east side Ketcham Lane, East
Marion, New York~ subject to the following condition:
1. The garage shall be located at least 5 feet from any
property line.

PUBLIC HEARING: Appeal No. 725 - 7:45 P.M. (E~S.T.), Upon
application of Robert Hiltz, Route 25, Selden, New York, a/c
Fred Ninesling~ 139 Steamboat Road, Great Neck, New York~ .for
a variance in accordance with the Zoning Ordinance, Article
III, Section 307, for permission to build a dwelling with
insufficient sideyards. Location of property: west side Lilac
Lane~ off north side Sterling Road, Nassau Farms, Lot $i15,
Cutchogue, New York. Fee paid $5.00°
The Chairman opened the hearing by reading application
for a variance, legal notice of hearing~ affidav, it attesting
to its publication in the official newspaper~ and n~ice to
the applicant.
The applicant agreed to amend the application by adding
the phrase "insufficient side yard for location of the house."

MR. NI~SLING: I need a house, what more can I say.
THE CHAIRMAN: YOu'll have no room to expand this house.
MR. NINESLING: We have no plans of ever enlarging the
house.

After investigation and inspection the Board finds that
Fred Ninesling wishes to construct an5building with insufficient
side yards. The Board is in agreement with the reasoning of
the applicant. The Board finds that this application is being
made on lot $115~ "Nassau Earms", a filed map. The overall
area exceeds the legal mininum requirement of the zoning
Ordinanc$, although the frontage is only 70 feet.
The Board finds that strict application of the Ordinance
will produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property _~
and in the same use district; and the variance does observe
the spirit of the Ordinance and will not change the character
of the district.

It was further RESOLVED that~the legal notice of hearings
be published in the Long Island Trave~er-Mattituck Watchman~
the official newspaper of the Town, under date of November
25, 1964, and that the noticefor hearings on Fishers Island
should appear in the New London Day.
The next meeting of the Southold Town Board of Appeals
will be held 7:30 P.M.~ Thursday, December 34 1964~ at the
Town Office, Main Road, Southold, New York.
