Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 26,2004 regarding the above matter:
WHEREAS, Robert E. Herrmann on behalf of GREGORY & MIKAL·ANN TYRER
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated April 28, 2004, and,
WHEREAS, said application was referred to the South old Town Conservation Advisory
Council for their findings and recommendations, and.
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 26. 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and.

WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
South old Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of GREGORY &
MIKAL-ANN TYRER to remove and replace (in-place) approx, 113 linear ft. of existing
concrete seawall with vinyl bulkhead, Area up to 8' seaward of new bulkhead to be
dredged to a maximum depth of -3' ALW; approx, 30 cy, of sand/silt spoil to be used as
backfill, with the condition of a 10' non-turf buffer landward of the bulkhead. and all as
depicted on the plan prepared by En-Consultants. Inc. last dated June 29. 2004.
Permit to construct and complete project will expire two years from the date the permit
is signed, Fees must be paid. if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection, (See attached schedule.)
Fees: $50.00

At the meeting of the Southold Town Conservation Advisory Council held Tuesday, May
11, 2004. the following recommendation was made:
Moved by Don Wilder, seconded by Doris McGreevy, it was
RESOLVED to recommend to the South old Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit application of GREGORY & MIKAL-ANN TYRER
to remove and replace (in-place) approx. 113 linear ft. of existing concrete seawall with
vinyl bulkhead. Dredge up to 8' off new bulkhead to a maximum depth of -3' ALW to
recover and remove remnants of concrete structure and footings and enable safe and
adequate boat dockage. Approx. 50 cy. of sand/silt spoil to be used as backfill.
Located: 1490 Smith Drive South, Southold, SCTM#76-3-6
The CAC recommends Approval of the application with the Condition of a 10' non-turf
buffer and hay bales are placed down prior to construction,

The New York District, U.S. Army Corps of Engineers, has
received a request for Department of the Army authorization for
the following activity:

Dredge of up to 50 cubic yards of material from a
8 foot wide by 113 foot long area to a maximum
project depth of 3 feet below the plane of mean
low water to be used as backfill. Under the
authority of the Nationwide Permit Program (NWP) ,
NWP No.3, remove approximately 113 linear feet of
concrete bulkhead. and replace, in-place, with
vinyl sheathed bulkhead. The purpose of this
project is to maintain shoreline stability and to
provide safe navigation and docking of the
applicant's boat.

Town of Southold, Suffolk County, New York
As this is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A», the applicant
has certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state
coastal zone management program.
To allow for the timely processing of the subject
application, your comments are requested within 20 days of the
date of this letter.

plan modified to depict a reduced dredge area of 8' x 60', This reduction in dredge area should reduce the volume of
dredge spoil to approximately 30 cubic yards. which is also noted accordingly on the revised plan.
