Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 29, 2001 regarding the above matter:
WHEREAS, En-Consultants, mc, on behalf of CHARLOTTE DICKERSON applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of South old, application dated April 30, 2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
August 29, 2001, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 ofthe Southold
Town Code,

WHEREAS, the Board has detennined that the project as proposed will not affect the health,
safety and general welfare ofthe people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of CHARLOTTE
DICKERSON to construct a +/-117' timber retaining wall, 12' westerly return, 13' armored
return on the east side, Approx, 250 cy, of clean sand to be trucked in ftom an upland source and
used as backfill and planted with Cape American beach grass 12" on center,
BE IT FURTHER RESOLVED that this detennination should not be considered a detennination
made for any other Department or Agency, which may also have an application pending for the
same or similar project
Pennit to construct and complete project will expire April 1,2004, Fees must be paid, if
applicable, and pennit issued within six months of the date of this notification,
Two inspections are required and the Trustees are to be notified upon completion of said project
Fees: None

Dear Mr. Krupski:

As you are aware, the Board approved the wetland permit application of Charlotte Dickerson
during its regular meeting of 29 August 2001, conditioned upon receipt of revised project plans
fÌ'om En-Consultants, Inc, depicting the relocation ofthe proposed retaining wall and an armored
return, Such plans were delivered to your office on or about September 28, 2001,
The application fee has been paid in full and any and all other obligations required by Chapter 97
of the Southold Town Code have been satisfied to the best of my knowledge, To date, however,
the wetland permit has not been issued, and your office has advised me on several occasions that
the permit's issuance is now contingent in some way upon the Town Attorney's approvaL
Although I was unaware of any such requirement, I explained the situation to my client several
months ago and suggested that we wait patiently for the permit.
As more than three months have now passed since we supplied you with the revised plans,
however, we must respectfully request that the permit be released promptly, Should the permit's
release be a continued problem, kindly have your office forward me a written explanation of the
problem, which I can forward to Mrs, Dickersón, I thank you in advance for your anticipated
cooperation and look forward to hearing fÌ'om you,

At the meeting of the Southold Town Conservation Advisory Council held Monday, May
14,2001, the following recommendation was made:
Moved by Bill McDermott, seconded by Melvyn Morris is was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of CI;ARLOTTE DICKERSON 74-1-35,51 tò construét a +/_
138' timber retaining wall and 21' easterly return; and backfill with approx, 300 cy, of
clean sand to be trucked in from an upland source and planted with Cape American
Beach Grass (12" on center), Westerly terminus of proposed structure will tie into face
of adjacent steel retaining wall to west; and portions of existing 1-3 ton stone toe armor
fronting adjacent return will be relocated to armor proposed return,

The CAC recommends Approval but suggests that the applicant considers re-vegetation
as an alternative, There is also a concern about the access during construction,
