Dear Al,
Thank you for taking the time to call and discuss this project after your site visit this
week. I shared your concerns with my client, Kevin O'Mara, and his environmental
consultant, Cathy Mesiano, and we hereby ask you to take the following action:
1) Postpone the public hearing for proposed action within the Trustees
jurisdiction. Within a few months we will return to your agency with revised drawings
showing a beach stair, a landscape plan, and, perhaps, a shoreline hardening structure
at the base of the bluff. We shall in all likelihood not seek to re-grade the top of the bluff
in any significant manner.
(~' 2) Issue a Letter of Non-Jurisdiction for the conforming house and swimming
pool, as per the revised SITE PLAN enclosed.

At the meeting of the Southold Town Conservation Advisory Council held Monday,
August 20, 2001, the following recommendation was made:
L. KEVIN O'MARA & ALEXANDRA R. O'MARA for a new sir~gle-family residence with
swimming pool, located landward of the 100' setback from the coastal erosion hazard
line. Additional work includes clearing and re-grading property within the required
building setback.

Dear Al,
The above referenced residence will be built on property currently owned by William
Baxter, Jr., and is part of a minor subdivision called "Baxter Sound Estates", located on
Oregon Road in Cutchogue. The actual lot will appear in District 1000 Section 72 Block
02, lot number to be determined.
Although a topographic survey was made by Joseph ingegno, Land Surveyor, the
contours were taken from the "Five Eastern Towns Topographical Map", not from field
notes, and not referenced to the NGVDatum. In order to perform the necessary field
work to prepare such a map (which is necessary for application to the DEC), the
surveyor needs access to the property, which is overgrown with brush.
As per our phone conversation, I am notifying you of our intention to have portions of
the site cleared, so that the survey work can proceed. The minimum area will be
cleared, no trees will be removed, and there will be no disturbance of the ground
surface.
Soon after, we will be submitting a Site Plan and application to your office, showing the
Trustees our complete intentions for the project.

Basically, we propose to construct a new residence and swimming pool on Long Island
Sound, set 100 feet behind the Coastal Erosion Hazard Line, as required. We also
propose to clear and re-grade portions of the site within the 100 foot setback, as shown
on the SITE PLAN.
For your information, my client will be making an application in future for a shoreline
hardening structure and set of beach stairs.
