Telec~hone SO $-2660 MINUTES $OUTHOLD TOWN BOARD OF APPEALS January 9, 1964 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M.~ Thursday, January 9, 1964 at the Town Office, Main Road, Southold~ New York. There were present: Messrs. Robert' W. Gillispie, Jr., Chairman~ Robert Bergen~ and Fred Hulse~ Jr. Absent: Messrs. Charles Grigonis~ Jr.~ and Serge Doyen, Jr. PUBLIC HEARING: Appeal No. 625 - 7:30 P.M. (E.S.T.), upon application of Elwood L. Martz and Alita L..Martz~ 46-04 245 Street, Douglaston, New York,. for recognition of access in accordance with State of New York Town Laws Section 280Ao Location of property: private right-of-ways known as "Sunset Lane"~ south side Bayview Road, Sa thold, New York. Property bounded north by land of Dickerson, east by "C~dar Beach Park", south by Little Peconic Bay~ and west by land of Mills and land of Turne~ Fee paid $5.00° Southold Town Board of Appeals -2- January 9, 1964 The Chairman opened the hearing by reading application for a variance for recognition of access~ legal notice of hearing~ affidavit attesting to its publication in the official newspaper~ and notice to the applicant. The Chairman also read a letter from the attorney for the applicant, Schiffmacher & Rochford~ and a letter from the Chief of the Sout~old Fire Department. TPIECHAIRMAN: Is there anyone present who wishes to speak for this application? (There was no response.) THE CHAIR~AN: Is there anyone present who wishes to speak against this application? (There was no response.) THE CHAIRMAN: From what we can gather th~s access is not maintain by anyone and is impassable a great deal of the time. On Motion of~Lro Gillispie~ seconded by Mro Bergen~ it was RESOLVED that Appeal NOo 625 of Elwood L. Martz and Alita L. Martz for recognition of access in accordance with State of New York Town Law, Section 280A~. be recessed until such time as the access to their property from Bayview Road is improved sufficiently to permit the ingress and egress of fire trucks~ a~bulances: police cars~ and other emergency vehicles. At the present time it is the opinion of the Board of Appeals that a proper access does not exist. The Fire Chief of the Southold Fire District concurs with the opinion of the Board in a letter dated December 22~ 196~. Vote of the Board: Ayes:- Mr. Gillispie~ Mr° Bergen~ and 5Lt. Hulse. Southold Town Board of Appe~s -3- January 9~ 1964 A letter was forwarded to Schiffmacher and Rochford advising them of the action of the Board in the matter of the application of Elwood and Alita Martz. PUBLIC P~EARING: Appeal NOo 624 - 7:45 P.M. (E.S.T.)~. upon application of Andrew Jo Campbell~ 125 Front Street~ Greenport, New York~ for a special exception in accordance with the Zoning Ordinance~ Article IVz Section 400, Subsection 9, for permission to use the property as a public garage and car sales lot. Location of property: south side west Front Street (Route 25), Greenport, New York~ bounded north by West Front Street, east by Giovanelli and Schultz~ and Robert Brown~ south by Long Island Railroad~ and west by So Van Scivero Fee paid $5°00. The Chairman opened the hearing by reading application for a special exception~ legal notice of hearin~ affidavit attesting to its publication in the official newspaper and notice to the applicant. (There was no response.) On motion of Mro Gillispie~ seconded by Mr. Hulse~ it was RESOLVED that the hearing upon Appeal NOo 624 by Andrew ~. Campbell for a special exception be recessed to 9:00 P.M.~ Thursday~ January 23~ 1964o It is the opinion of the Board that the operator of a public garage and car sales lot should be present at the hearing as there are a number of questions the Board would like to ask. vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen=. and Mr. Hulseo Southotd Town Board of Appeals -4- January 9~ 1964 A letter was forwarded to Mr. Andrew J. Campbell advising him of the recessed date of his hearing and asking that he be present on this new date. On motion of Mro Gillispie~ seconded by Mr. Hulse~ it was RESOLVED that the minutes of the Southold Town Board of Appeals dated December 19~ 1963 be approved as submitted. Vote of the Board: Ayes:- Mr. Gillispie~ Mro Bergen~ and Mr. Hulseo The next meeting of the Southold Town Board of Appeals will be held 7:30 PoM., Thursday~ January 23~ 1964 at the Town Office~ Main Road~ Scu thold, New York° On motion of Mr. Gillispie~ seconded by Mr. Bergen~ it was RESOLVED that the Board of Appeals set 7:30 P.M. (E. SoT.), Thursday~ January 23~ 1964, Town Office~ Main Road~ Southold~ New York as time and place for hearing upon application of Kathryn Mo Reeve, Sound Avenue~ Mattituck, New York~ for a variance in accordance with the Zoning Ordinance, Article III~ Section 300~ Subsection 7~ for permission to erect a private detached garage in the front yard area of her property 83 feet from the front property line. Location of property: south side Mason Drive~ Cutchogue~ New York~ bounded north by Mason Drive~ east by I. Merrill~ south by Broadwater Cove~ and west by E. A. Smith° Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen, and Mr. Hulseo On motion of Mr. Bergen~ seconded by Mr. Hulse~ it was RESOLVED that the Board of Appeals set 7:45'P.M. (E.S.T.).~ Thursday~ January 23, 1964~ Town Office, Main R oad~ Southold, New York as time and place for hearing upon application of C. F. Van Duzer Gas Service~ Inc.~ Route 27A, Southold~ New York, for a special exception in accordance with the Zoning Ordinance~ Article X~ Section 1007.~ Subsection (a)~ for permission to erect a Propane storage tank in the rear of his business Southold Town Board of:Appeals -5- January 9~ 1964 property. Property located on the north side Route 27A, Southold, New York~ bounded north by H. E. Tuthill~ east by R. Wo Ryan, south by-County Route 27A~ and west by Ho E. Tuthill. Fee paid $5.00. Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen~ and Mr. Hulse. On motion of Mr° Hulse~ seconded by Mr. Gillispie, it was RESOLVED that the Board of Appeals set 8:30 P.M. (E.S.T.), Thursday~ January 23~ 1964, Town Office, Main Road~ $outhold, New York as time and place for hearing upon application of the New York Telephone Company~ 101 Willoughby S~reet~ Brooklyn 1~ New York, for a variance in accordance with the Zoning Ordinance~ Article iII,.Section 300~ and Section 301z and Article X~~ Section 1007~ Subsection (a), for permission to erect a 95 fto microwave cylindrical tower on the~ property ~'ereby expanding a non-conforming business in the ~f_ Residential. District° Location of property: east side Youngs.Avenue, 'Southold, New York~ bounded north by Thompson - Downs, east by Fo & A. Downs~ south by To W. Wiegand~ and west by Youngs Avenue° vote of the Board: Ayes:- Mro Gillispie~ Mr. Bergen~ and Mr° Hulse. It was further RESOLVED that legal notice of hearings be published in the official newspaper on Friday~ January 17, 196~. Vote of the Board: Ayes:- Mro Gillispie~ Mr. Bergen~ and Mr. Hulse. In connection with the application of C. F. Van Duzer a letter was forwarded to Mr. Van Duzer requesting that he arrange to acquire all information available in connection with hazards surrounding the storage of Propane gas above ground so that it may be available at his hearing on the 23rd of January. In connection with the application of The New York Telephone Company a letter was forwarded to the F. A. A.~ Eastern Region~ Federal Building~ J. F. K. Airport, Jamaica, New York~ Mr. Charles Ho Newpol, Chief~. Air Space Utilization Southold Town Board of Appeals -6- January 9, 1964 B~anch~ requesting that they advi~e the Board of Appeals with regard to the requirements or regulations of air space utilization in the Town of Southold which might concern us since there is proposed to be constructed on Youngs Avenue a 95 fto microwave cylindrical tower for improved transmission of ship to shore radio-telephone communications° The Board also received an application from James Po Howard for recognition of access on a private right-of-way in New Suffolk. The Board determined that this right-of- way has never been approved for connection to New Suffolk Road otherwise known as Connty Route 26~ and there are drainage problems existing in this regard° Further~ it was learned that this access has never been fully completed and improved. A letter was forwarded to the Suffolk~County Department of Public ~brks previously asking them the status in this matter and a letter was forwarded to Mr. Howard advising him of the situation and also suggesting that he might look into the matter of possible improvement of the access to his property° No date was set for the hearing on this matter.
