RESOLVED, that the Southold Town Board of Trustees Approve an Amendment to Permit #5622 is going to be neutral as far as an affect on the environment to allow for alterations to the plan to conform to the 75 foot setback and to allow for 400 cy. of fill to be brought on site with the modification that the mn-offto the west be addressed so that does not impact the neighbor on the west side, stake row of haybales be used on the landward end of the non-disturbance buffer be placed during construction and tmtil a lawn area is established, haybales at the seaward side of the berm area placed until that berm area is vegetated. Although both versions address Mr. Richter's recommendations, version "B" extends the laid-up stone wall slightly into the Trustees setback area. Mr. Richter, implied that this stone wall was similar to a fence, and he did not think this would pose a problem, but he could in no way speak for the Trustees. I sincerely hope this addresses any concerns the Trustees may have regarding any run-off and you will be able to approval this revision at the next Trustee's Meeting. During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix trucks, mixers, or other devices enter tidal wetlands and or protected buffer areas. 2. Any debris or excess matedal from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debds is permitted in tidal wetlands and or protected buffer areas. 3. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activity. 4. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion or pdor to permit expiration, whichever comes first. The approved methodologies are as follows: a. Stabilization of the entire disturbed area with appropriate vegetation (grasses, etc.). 5. All till shall consist of"dean" sand, gravel, or soil (not asphalt, flyash, broken concrete or demolition debris). 6. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 75 linear feet from the tidal wetland boundary. 7. To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall be no disturbance to the natural vegetation or topography within an area extending 50 linear feet landward of the tidal wetland boundary. 8. A row of staked hay bales or appreovable eresion control devicas shall be placed at the landward edge of the buffer area or 50 linear feet from the tidal wetland boundary, or as per NYSDEC approved plan, at commencement of regulated activities and remain in place until project is completed and all disturbed areas stabilized with vegetation. 9. Roof runoff must be directed to drywells a minimum of 75 linear feet landward of the most landward edge of the tidal wetland boundary, and must be installed a minimum of 2 feet above seasonal high groundwater. 10. Driveways and parking areas shall be constructed of pervious material. 11. Sanitary system (bottom of tank and leaching pools) shall be located a minimum of 2' above seasonal high groundwater. 12. The permittee shall incorporate the following language as a notice covenant to the deed: "Regulated tidal wetlands associated with Goose Creek are located at Suffolk County Tax Map Number. District 1000, Section 70, Block 12, Lot 17, otherwise known as the properties of Paul Nahas and his heirs, assigns, or successors. This property is subject to the provisions of New York State Environmental Conservation Law (ECL) Article 25 or its successor, and the conduct of regulated activities may occur only pursuant to ECL Article 25 if prior approval is given by the New York State Department of Environmental Conservation (NYSDEC) or its successor. Regulated activities include, but are not limited to the erection of any structure(s); excavation; dredging grading and tilling; clearing of vegetation; and application of chemicals." This deed covenant shall be recorded with the Clerk of Suffolk County within 90 days of the issuance of this permit. A copy of the covenanted deed or other acceptable proof of mcerd, along with the number assigned to this permit, shall be sent within one calendar year of the issuance of this permit to: NYSDEC, Regional Manager, Bureau of Marine Habitat Protection, SUNY Building 40, Stony Brook, New York 11790-2356. ' 1-4738-03110/00001 NEW YORK S. dEPARTMENT OF ENVIRONMENTAL CONSERVATIO~'''~' ADDITIONAL GENERAL CONDITIONS FOR ARTICLES t5 (TITLE 5), 24, 25, 34 AND 6NYCRR PART 608 ( TIDAL WETLANDS) If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvemant of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. Granting of this permit does not relieve the applicant of the respensibility of obtaining any other permission, consent or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. 4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. Any matedal dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with navigation by the work herein authorized. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion cf the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. If granted under 6NYCRR Pert 608, the NYS Department of Environmental Conservation hereby certifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met. 9. At least 48 hours prior to commencament of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also bo signed and returned, along with photographs of the completed work and, if required, a survey. 10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or his agent as part of the permit application. Item B: Perrslttee's Contractors to Comply with Permit The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with this permit, including ali special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee. Item C: Permlttee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may be required to carry out the activities that are authorized by this permit. Item D: No Right to Trespass or Interfere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the dpadan rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal properb/held or vested in a person not a party to the permit. GENERAL CONDITIONS General Condition 1: Facility Inepac6on by the Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Pem~it to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate wdtten application to the Department for renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in wdting. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. SOUTI~OLD, NEW YORK i i971' ' APRIL 29, 2003 The Tmsteas of the Town of Southold Town Hall Southold, New York 11971 To The Trustees: In the matter of the property on the comer of Beachwood Lane and Crittens Lane in the Southwood subdivision, town of Southold, village of Southold; the officers and the trustees of the Southwood Property Owners Association stand firmly opposed to the lifting or easing of any part of the moratorium with regards to this property, currently being sought to be built upon by Paul and Barbara Nehas. Elevating this property above the current road bed, and the level of the surrounding properties will cause an environmental ha??ard to Goose Creek. The covenants of our property owners association, which have been in existence for almost 50 years, and are registered with Suffolk County, require that a two and a half foot elevation from the mp of the foundation to the crown of the mad be maintained. Paul and Barbara Nahas To whom it may concern: May 08, 2003 Easter~ Lo~ Island Office Tkree Long Point Road, Lok~ P~oka~ N.Y. 119~1-1828 ~ith regard to the inquiry as to what has changed since tt~ origlnat-a~ll~cation, we provide the following list of comments: The requirement to bring in outside fill has been reduced from 850 yards to between 400 and 450 yards. The actual number will Jepend on how much of the fill removed from the foundatlon and basement areas is utilized on site. The original unimproved state of the property allowed water to flow across the site and onto the roadway area. The revised plan redirects just about all of thls flow towards the wetlands. A swale and small berms were used to stop water whlch previously flowed off the property onto the road to instead be directed to the northwest corner of the propert~j adjacent to the wetlands. The aforementioned swale was added al~o to the driveway area and a grate / drain installed so as to prevent water running down the driveway and into the street. Maximum slopes have been reduced from as steep as 2:1 to 4:1 (horizontal to vertical). The septic system was moved further back from the wetlands area. The house was moved further back from the wetlands area. Overall, each of the above represents and improved condition and is therefore more beneficial environmentally as compared with the original plan initially reviewed by the Board. At, er meeting with Mr. Semon on several occasions, we originally asked to have approximately 850 cu. yds. of clean fill to be brought on site. This amount as previously stated to the Trustees was used as a safe guard to eliminate the need for additional amounts of fill to be used at a later date (at Mr. Semon's suggestion) and was in no way what we actually thought would be needed. Atter having our engineer carefully review the plans and creating a swale area as suggested by the Trustee's the need for fill has been drastically reduced to less than half the original amount or to be more specific approximately 400 cu. yds. Please keep in mind that after several meetings with Mike Verity and Bruno Semon of the Southold Building Department, prior to making the decesion to bring in fill, it was pointed out by them, that in Zone AE of which we are a part, it is required that we conform to Chapter 46, Flood Damage Prevention Code, adopted by the Southold Town Board on 8-10-93 which in order to meet, would require fill to be brought in to increase elevations and reduce the risk of flooding. More specifically the follovdmg sections: 46-2 Purpose. Section B. Require that uses vulnerable to floods, including facilities which serve such used, be protected against flood damage at the time of initial construction. 46-4 Definitions. Section B. Elevated Building (line 7) In the case of Zone Al-A30, AE, A, A99, AO, AH, B, C, X, or D, "elevated buddings" also include a building elevated by means of fill or solid foundation perimeter walls with openings sufficient to facilitate the unimpeded movement of floodwaters. 46-10. Warning and disclaimer of liability. The degree of flood protection required by this chapter is considered reasonable for regulatory purposes and is based on scientific and engineering considerations. Larger floods can and will occur on rare occasions. 46-12. Floodplain development permit; fees; deposit. Purpose. A floodplain development permit is hereby established for all construction and other development to be undertaken in areas of special flood hazard in this community for the purpose of protecting its citizens from increased flood hazards and ensuring that new development is constructed in a manner that minimizes its exposure to flooding. 46-16. Standards for all structures. B. (2) New construction and substantial improvements to structures shall be constructed using methods and practices that minimize flood damage. 46-17. Residential structures A. (1) Within Zone A1 -A30, AE and AH and also Zone A if base flood elevation data are available, new construction and substantial improvemants shall have the lowest floor (including basement) elevated to or above the base flood level. ( these are minimum requirements) As you can see from the above the intent of this code is to reduce the possibility of flooding by setting minimum code standards. I am sure you are all well aware and if you check with the Town Engineer and Building Department, to truly succeed in reducing flood related disasters, these minimum requirements should be exceeded if at all possible to achieve the intent of this code. We have therefore attempted in many instances to exceed standards, thus reducing the possibility of flood water damages and as reconananded by the above sections in the town code especially 46-4, Section B, which states" In the case of Zone Al-A30, AE, A,A99,AO, AH,B,C,X,D, "elevated buildings" also include a building elevated by means of fill or solid foundation perimeter walls with openings sufficient to facilitate the unimpeded movement of floodwaters". The following is a list of my observations: 1. The original Trustee Permit to construct a single family dwelling approved a building envelope that is within 75' of the adjacent wetlands. This permit has also required a non-disturbance buffer of 50' immediately adjacent to the wetlands. Due to this relatively close setback and the proposed 1/3 slopes created by the placement of fill in this area, it is recommended that all fill adjacent to the buffer area be stabilized with a line of hay bails at the toe of slope. It is also recommended that erosion control fabric be placed over the top of this entire slope to prevent erosion prior to the germination of permanent ground cover. 2. The building plans indicate that a new retaining wall will be constructed at the northeast corner of the proposed residence. This area is immediately adjacent to the steep slopes noted above. If this wall were extended slightly outside of the proposed building envelope, it may allow a reduction in the severity of slope that has currently been proposed. Any reduction in slope without further encroaching into the buffer area would be considered a positive change. 3. Drainage calculations have not been provided. The calculations should be submitted for review and the location of all proposed drainage structures should be accurately indicated on the site plan. Proposed drainage should provide enough capacity to contain a 2" rainfall and all leaching pools should maintain a minimum separation two (2') feet from the ground water table. Runoff from the driveway area should be directed down into the proposed swale area with something more substantial than a 2" dip in the proposed stone pavement. Over time this will fill in and direct the runoff into the Town road and ultimately the wetland. 4. The swale as proposed appears to be large enough to collect the remaining site runoff generated at the site. If this swale is pitched to the north as indicated, the remaining site runoff would be directed out and away from the site through the buffer area that will ultimately act as a natural Bio-filter. 5. The amount of fill requested by the applicant is not a requirement of FEMA Regulations. The proposed first floor elevation proposed for the new residence does appear to have been established to meet these regulations but the requested fill appears to be necessary to maintain the appearance that is dictated by the communities self-imposed covenant & restrictions for the area. 6. Please note that FEMA Regulations are within the jurisdiction of the building department. Any and all approvals regarding those regulations would need to come from their department. Adequate documentation needs to be produced to the effect that any runoff would be contained on the applicant's property Since the meeting, I have been advised that our covenants, which apply to all new construction in Southwood, call for the top of the foundation to be no more than two and a half feet above the crown of the road. My objections are many fold, least of which is your arbitrary interpretation of this law applying to building on vacant land. The Temporary Moratorium is very clear in Section 2, paragraph 1, stating "The Board of Trustees of the Town of Southold shall not accept for review, continue review, hold a hearing or make any decision upon any application (new or pending) made pursuant to Chapter 97, of the Town Code" (see attached). According to Chapter 97, of the Wetland Ordinance, the definition of an Application ( see Article II, Permits, attached) it is very clear that the application contain the following items A through J (see attached). The horizontal control of said survey shall be based on an approved local coordinate system.
