To Whom it May Concern:

I am unable to attend today's hearing regarding the renovation of the above-
referenced property. However, I am aware that my neighbor, Alan Litner, will be
in attendance. Please know that t share the Litner'e position in opposing the
planned renovations to this property.
I am also aware that recent work to this property did not conform with submitted,
and approved, plans. No were variances for work completed outside of the
approved plans obtained prior to construction. Plans submitted to me prior to
work on the garage and house did not reflect the ultimate construction and
design of these structures. At the present time, work to the property is again
being conducted without approvals, conformity to DEC regulations, or variances.
Aside from the legal matters, the resulting structures, once finished (although
substantially oompleted already without approvals), will negatively impact the
quality of enjoyment, piece of mind, end property value of my home.

At the meeting of the Southold Town Conservation Advisory Council held Tuesday,
February 12, 2002, the following recommendation was made:
Moved by Bill McDermott, seconded by Drew Diilingham, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Amendment Request of FREDERICK VON ZUBEN to Amend Permit #5344 for the
renovation of the existing single-family dwelling, including the placement of the house
on pilings, construction of a new deck, replacement of the sanitary system, removal of
concrete walls along property lines and construction of a new gravel driveway.

The CAC recommends Disapproval of the application because they feel the applicant
should be required to apply for a new permit.

Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permiltee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its rupresentalivea, employees, agents, and assigns for all claims, suits, actions, flamages,
and costs of eve~ name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and maintenance cf the tactile/or facilibes authorized by the permit in compliance or non-compliance with
the terms and conditions of the permit.
Item B: Permittee's Contractors to Comply with Permit
The permi~ee is respon:~ible far informing its independent contractors, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittae'$ agent with
respect to the permitter[ acti¢ities, end such persons shall be subject to the same sanctions for v~olations of the
Environmental Conservation Law as those prescribed for the perm[flee.
item C: Permittee Respon.~;ible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-at-way that
may be required lo carr~ out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
Tl;~s perm=t does nc'. convey to the permittee any right to trespass upon the lands or interiors with the riparian
rights of other5 ~n order to perform the permi{ted work nor does it authorize the impairment of any rigl~ts, title, or
interest in real or personal properl'y held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1; Facility Inspection by the Department
The permitted site or facilily, including relevant records, is subject to Inspection a(reasonable hours and intervals
by an authorized representative of the Department of Environmental Conservation (the Depart3'nent) to determine
whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECL 71-0301 and SAPA 401(3),
The permittee shall !~ro'/ide a person to accompany the Department's representative during an inspection to the
permit area when requested by the Department.
A copy ul' this permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times et the project site or Facility, Failure to produce a copy of the permit upon
request by a Deparlrnent representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind
any order or determination previously issued by the Department or any of the terms, conditions or requirements

General Condition 3: Applications for Permit Renewals or Modifications
The permittee must suEmit a separate written application to the Departrnent for renewal, modification or transfer
of this permiL Such appl~caHon must include any forms or supplemental information the Department requires. Any
renewal, modiflcauon or ~ra~afer granted by tho Department must be in writing.
The permittee must sul~rnit a renewal application at least:
a) 180 days before expiration of permits far State Pollutant Discharge Elimination System (SPDES),
Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste
Management Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications I~or permit renewal or modification are to be submitted to:

General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Depa~lment reserves the right to modify, suspend or revoke this permit. The grounds for modification,
s~spension or revocation i~clude:
the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions
of the ECL end pertinent regulations is found;
b) the permit wa~. obtained by misrepresentation or failure to disclose relevant facts;
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.

[f luture ope'rations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if. in the o~,[nion of the Depa~ment of Environmental Conservation ~t shall cause unreasonable
obstruction to the free na'Agabon of saicl waters or flood flows or endanger the health, safety or weifara of the
people of the State, or cause loss or destruction of ~he natural resources of the State, the owner may be ordered
ay the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense
Lo the State, and ~f, upon the expiration or revocation of this permil[, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shaJl, without expense to
the State, and to such extent and in such time and manner as the Depa~ment of Environmental Conservation may
require, remove all or ary portion of the uncompleted structure or till and restore to its former condition the
nawgable and flooci capacity of the watercourse. No claim shall be made against the State of New York on
account of any such removal or alteration.
The State of New York ;hall in nc case be liable for any damage or injury to the structure or work herein
authonzed which may be caused Dy or result from future operations undertaken by the State for the conservation
or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any
such damage.
Granling of this permit ~oes not relieve the applicant of the responsibility of obtaining any other permlssmn,
consent or approval from the U .S. Army Corps of Engineers, U.S Coast Guard, New York S~ate Office of General
Services or local government which may be required
4. Ali necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended
solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leaehate or any other
environmentally deleteri~)us materials associated with the project.
Any material dredged in :he conduct of the work herein permitted shall be removed evenly, without leaving large
rofuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable ch:annals or to the banks of a waterway.
There shall be no unreasoneble ,nterference with navigation by the work herein authorized.
If upon the expiration or revocation of this perrmt, the proJect hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted stn.~cture or fill and
restore the site to its former condition. No claim shall be made against the State of New York on account of any
s~-.ch removal or alteration.
If granted under 6NYC RR Part 608, the NYS Department of Environmental Conservation hereby cectifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301. 302,
303,306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and reL'poved to ar, approved upland area for disposal. No debris is permitted in tidal wetlands and or
protected buffer' areas.
2. The storage of construction equipment and materials shall be confined to within the project work site and or upland
areas landward of the hous~,
3. Disturbance to the natural vegetation or topography greater than 25 feet seaward of the approved structure is
prohibited.
4. Necessa~ erosion contr31 measures i,e., haybales, silt fencing, etc. ara to be pieced on the downslope edge of
any disturbed area. This sediment barrier is to be put in place before any disturbance of the ground occurs and is to
be maintained in good cenCition until ~hick vegetative cover is established.
5. Dd~zeways and parking ~.reas shall be constructed of pervious material.
6. Sanitary system (bottom of tank and leaching pools) shah be located a minimum gl' 2" above seasonal high
groundwater.
7. During cons[ruction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix
trucks, mi~ers, or other devices enter tidal wetlands and or protected buffer areas.
8. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than one (1) week shall be
contained by a continuous ~ine of staked hay bales/s~tt curtain (or other NYSDEC approved method) placed on the
seaward side between the fill and wetland or protected buffer area. Turps are authorized to supplement these
approved methods
g. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion
or pr~or to permit expiration, whichever comes first. The approved methodologies are as follows:
a. StaOdizat,on of [he enti'e disturbed area with appropriate vegetation (grasses, otc,).

c. temporarily stabilized w~th straw or hay mulch or jute matting or other similar natural fiber matting within 1 week

10. If sending is impracticable due to the time of year, a temperaW mulch must be applied and final seeding
performed a£ the ~adiest c:~portunity when weather conditions favor germination and growth, but not more than six
months after project completion.

On June 8, 2001 you mssued a Coastal Erosion
Management Permit, the owner obtained all other peLmits
and started construction. During the construction the
DEC, FEMA, recommended that the house be elevated above
the flood zone. The construction was halted, plans were
revised, an amended DEC p~rmit was issued on November
29, 2001 for placement of the house on piles. We have
returned to the building department with our revised
plans and they request than you review your permi~ and,
if necessary, issue an amended permit.
Enclosed is the DEC amended permit. Please place
this on your work session calender of January 23, 2002
so we can disc'uss it.

retaining walls/fence along property lines, regrade and landscape.
