Wleland, Environmental Analyst I Dept. of Environmental Conversation Bldg. 40 - SUNY Stony Brook, New York 11790-2356 Re: Application #1-47380-00073/00001-0 Sebastian's Cove Property Owners Association Dear Mr. Wieland, We are in receipt of your letter of August 13, 1993 stating the Departments continued objection to Sebastian's Cove exercising their court affirmed riparian rights by the construction of a boat basin for their own use. The objections cited are all based on assumption which are contrary to facts. The actual facts are cited and substantiated below. Starting with the objection to marina installation: Tine pre-existing use of this facility was for the hm'bornge of a multlslip commercial marina with repair facility, and was not a facility for private boats for a sin21e resident. To create a boat basin for private use of residents would constitute a less intense use of the area. The area constitutes eleven (11) properties for residential use and not fifteen (15) properties as staled in your objection. In addition, there are communal properties, namely the lots having Suffolk County Tax Map Numbers 100.-3-11.11and 3-11.12. This latter property is owned Jointly by the property owners as is evident by the tax map and tax bill attached. It is the only property that has riparian rights which are due to the Joint ownership by the eleven (11) property owners. These Riparian Rights of the Association have been stated in the wording of the 'Taking Notice" sent to our Immediate nelghbborlng site to the south. These rights were further confirmed in testimony given by New York State at a trial in the Court of Claims regarding compensation for wetlands acquired by the State from this site. In the Court's judgement these .rights were confirmed. Applicable pages nrc attached for your information. The transfer of riparian rights to the communal property Is affirmed by the declaration of covenant filed by the original owners to the eleven (11)property owners of Sebastian's Cove. Copy of covenant Is atlached. Thus, no riparian rights would be granted to property owners who do not already have them. The covenant will not permit further subdivision of any of the properties which is against Southold Town zonlag regulations in any event. Therefore, there is no devaluation of waterfront property. As far as the increase in boat traffic, Ihnt will also he very slight to nonexistent, as property owners who are likely to keep their boat In the new marina do already keep their boats elsewhere in Mattltuck Inlet. Furthermore, all the property owners now use Sebastian's Gutter whenever water Ieve! and boat draft permits. Fuel spills and sewage discharge are non-existant at said facility. Box 1201 36 Nugent St. Southampton, NY 11969-1201 RE: Application ~1-4738-00073/00001-0 Sebastian's Cove Property Owners Association Dear Mr. Walker: As we have discussed over the telephone, the Department continues to object to your proposal for dredging and creation of a marina. What follows is a detailed explanation of the Department's objections. General Backqround: Natural Resources Sebastian's Gutter (the project area) is mapped on official DEC Tidal Wetlands Inventory Map #706-542 as shoals and mudflat wetlands and is flanked by extensive areas of highly productive, State (DEC)-owned intertidal marsh and high marsh. The adjacent wetlands also contain two upland "islands"; evidence of past dredging activity and spoil deposition in the wetlands. The immediate wetland area is only part of a much larger wetlands system that has remained relatively intact along the entire length of Mattituck Creek. The area falls entirely within the Mattituck Inlet Critical Environmental Area (CEA). Mattituck Creek contains productive shellfish habitat, and is the site of permitted shellfish harvest programs. Since 1986 successful conditional shellfish harvest programs have been operated each year. Mattituck Creek also supplied harvested clams for a transplant project in 1988. The waters are classified as "SA"; suitable for shellfishing for market purposes (propagation, culturing, and harvesting) and primary and secondary contact recreation. The two aspects of this project: the creation of a marina basin and the dredging of Sebastian's Gutter and the objections to each are discussed below. James L. Walker August 13, 1993 Page 2 Dredginq: Object The proposed dredging of Sebastian's Gutter as a regulated activity does not meet the standards for permit issuance as per 661.9 (b) (1) . According to the Inter-Science letter dated 10/24/91, the Gutter was last dredged in 1946. The proposed dredging, then, would qualify as "new" dredging. Use category 27 classified (new) dredging in a coastal shoals, bars and flats (SM) area as a presumptively incompatible use (Pip). As per 661.9(b)(1) (v), "if a proposed regulated activity is a presumptively incompatible use under such section, then there shall be a presumption that the proposed regulated activity may not be undertaken in the subject area because it is not compatible with the area involved or with the preservation, protection, or enhancement of the present or potential values of tidal wetlands..." Neither does the project meet the standards for permit issuance under 661.9(b) (1) (i). As alluded to in the previous paragraph, the proposed dredging is not compatible with the policy of the Act to preserve and protect tidal wetlands values and benefits. The dredging itself will result in the short-term destruction of over 10,200 sq. ft. (1133 cu. yds.) of productive shoals and mudflat habitat. Sebastian's Gutter supports a healthy benthic community of clams and perhaps oysters, as well as a host of lower invertebrates. These species, in turn, provide the basis of the food chain for a number of wading shorebirds, gulls, and other waterfowl. In the long-term, this benthic community will most likely re- colonize. However the mature and rather diverse, pre-existing community will most likely be replaced by a monotypic population of pioneering organisms. The Gutter will be degraded in terms of its species diversity and ability to support a diverse array of higher life forms. If the Gutter is dredged, it would be reasonable to expect future requests for maintenance dredging activity. Routine and repetitive dredging will interrupt the secession process within these sediments with the end result being the maintenance of a perpetual, monotypic, pioneering (degraded) community. Not only will the dredging injure and kill shellfish living in the Gutter, but the accompanying suspension of sediments is also likely to have an adverse effect on the feeding and survivorship of nearby populations. Walker August 13, 1993 Page 3 The dredging of Sebastian's Gutter will create a navigable channel and will encourage boat travel; from resident vessels moored within the proposed basin as well as other recreational traffic. Boat-induced wake is likely to initiate or accelerate the rate of wetland erosion, by undercutting the existing bog, along the banks of the Gutter on State (DEC) property. This created or accelerated erosional process may, in addition, be in conflict with the legal rights of the State as land owner of the Gutter's bottom and adjoining lands. According to the Department's analysis of the State's controlling interest in this matter, any dredging (or the results of dredging) cannot legally impact on the waterfront lands of others. There cannot be any loss of uplands or wetlands landward of the general line of the mean high water (MA"W). Since M}{W lies approximately at the edge of the Gutter's bank, any bank erosion and/or subsequent erosion of wetlands landward of MHW would violate the State's lawful right to protect their property. In addition, it would appear that to dredge the Gutter would not be compatible with the public welfare and therefore not meet the standards for permit issuance under 661.9(b)(1) (ii). Marina Installation: Objection The pre-existing use of this facility was for the harborage of a boat(s) for a singl~ resident. The proposed dredging, deepening of the existing boat ramp/slip, in conjunction with the excavation of additional upland is aimed at expanding the size of this facility to harbor a minimum of eleven recreational vessels. Suffolk County Tax Maps 10000-100-3, 1000-99-3, and 1000-107-3 show that of the 15 lots including and surrounding Sebastian's Cove Road, only 3 appear to be waterfront. If this project were to be approved, the Department would, in effect, be granting riparian rights to non-waterfront landowners. The possibility exists for waterfront owners to sell their property to an "association" of upland owners for the sole purpose of granting mooring rights to those who have no rights. Waterfront property would become devaluated, single lots that once harbored a few small boats would turn into mini-marinas and environmentally, small creeks, canals, bays and harbors would become choked with boats, petroleum discharge, and flotsam that seem to follow in their wake. In addition to the above concerns, the expansion of a single residential boat ramp/slip into an eleven vessel facility, along with the accompanying dredging does not meet the standards for permit issuance as per Section 661.9(b) (1). The proposed use would, in effect, grant riparian rights to non-waterfront landowners and condense the negative environmental impacts James L. Walker August 13, 1993 Page 4 associated with boating (discharge of petroleum products, bilge waste, sanitary waste, floatables) and focus them to a single point source. In the creation of the facility, existing wetlands to the south of the existing bulkhead will be dredged to provide mooring/navigation depth. Intertidal and perhaps high marsh will be converted to (negatively impacted) shoals and mudflat wetlands. It is currently against the Department's practice and contrary to the Governor's No Net Loss initiative to allow for one type of wetland, with distinctive functions and values, to be replaced with another. The creation of a communal marina facility at this site is not compatible with the policy of the Act to preserve and protect tidal wetlands; to allow for this concentrated, expanded use of a single family residential boat ramp/slip. It is not reasonable, 661.9(b) (1) (iii), for the State to grant riparian rights to non-waterfront landowners when in doing so the environmental value and benefits of the surrounding wetlands would be compromised in the process. The proposed marina facility does not comply with the use guidelines in Section 661.5. Dredging of tidal wetlands Intertidal marsh (IM), High Marsh or Salt Meadow (HM o__~r SM/LZ) is Pip under use category 27. Construction of bulkheads in vegetated tidal wetlands is Pip under use category 29. According to Section 661.9(b) (1)(v): "if a proposed regulated activity is a presumptively incompatible use under such section, then there shall be a presumption that the proposed requlated activity may not be undertaken in the subject area because it is not compatible with the area involved or with the preservation, protection, or enhancement of the present or potential values of tidal wetlands...". similarly, the dredging of upland needed to expand this boat slip into a marina facility would not meet the standards for permit issuance in the adjacent area as outlined in Sections 661.9(c) (3) & (4). If you wish to pursue your current proposal, the Department will schedule a public hearing on the matter. 'You will be responsible for all costs associated with the hearing and will have the burden of overcoming the presumption that the project is not compatible with the preservation, protection, or enhancement of the present and potential values of tidal wetlands. As such, we are going to pursue the design layout depicted on the site plan dated January 1992. According- ly, would you provide a formal review of that proposal so that when we have the site plan finalized all pertinent site plan design elements are addressed. We will be having the survey revised according to their review as well as having the dredging project staked as appropriate. For your convenience, I have enclosed a copy of the NYSDEC review document which was copied to the Town of Southold. Since you had provided a review of this development proposal earlier (letter dated January 15, 1992 also enclosed), we will rely on that review unless I am advised that additional information is required. Although this layout does not meet all of the Town of Southold's objectives, it is hoped that the project can be ap- proved after appropriate mitigation measures are put in place. However, the Department prefers the design layout depicted on your site plan dated January 1992. The Department feels this original proposal, which entails excavation of the upland, would have less environmental impact. Creation of tidal wetland littoral zone by means of creating the boat basin will, in part, mitigate the adverse environmental impacts expected from the proposed dredging in this environmentally sensitive setting. Considering the pristine setting for the new dredging which is considered a presumptively incompatible activity, please review Section 661.9 of the Tidal Wetland Land Use Regulations and show how your proposal is consistent with the standards for issuance of permits. Also: Please place labelled stakes at all corners and ends of the proposed boat basin and at each end and at no less than 100' intervals along the route of the proposed navigational channel to indicate the limits of dredging. Revised plans should be submitted in the form of a blueprint quality stamped sealed survey to clearly show all proposed and existing conditions including, but not limited to property boundaries, mean high water, mean low water, shoals/mudflats, tidal wetland vegetation types, limits of dredging, upland Page 2. excavation, spoil deposition and structural elements (i.e. bulkheads, ramps, floats, etc.). Submit revised cross-sectional plans of the proposed dredging, to correct scale. Further, be certain the cross-sectional drawing of the area to be dredged corresponds with the plan view of the proposed navigation channel for dredging. The eleven (11) slips are located along a smooth line to promote flushing. The wave sheathing would be the batterboard bulkhead design with every third sheathing member cut flush with the bay bottom. This design would protect the wetlands and allow the area seaward of the proposed bulkhead to be dredged to 3 feet below mean low water. The existing bulkhead lines on the north and south side of the property would be maintained so that the improvements thereto would be in-place and in-kind to minimize new impacts to tidal wetlands. The small amount of material excavated would be placed behind the proposed 80 linear feet of bulkhead to fill in the existing boat ramp. I believe this plan largely meets the design suggested at our recent meeting. If revisions are required, they will be provided. However, due to the fact that the design has changed, this office has sent this rough sketch to the New York State Department of Environmental Conservation for their comments. If the NYSDEC feels that this plan is more acceptable, we will prepare formal plans for their review and for the Trustees. We will wait until the NYSDEC comments are received so that revi- sions to the plan are not made without the benefit of NYSDEC review. Box 1179 Southold, New York 11971 December Re: Sebastian's Cove Property Owner's Association SCTM #1000-106-4-1 Dear Mr. Bredemeyer: Enclosed please find revised plans for the proposed improvements at the Sebastian's Cove Property Owner's Association. We have taken over this project from J.M.O. Consulting in order to try to revise the plans to meet both the Association's needs and the directives of the various regulatory agencies. As such, we have located a boat basin in the upland portion of the Association property which is a technique that the NYSDEC has recommended in certain instances to reduce impacts to wetlands areas. The idea is to locate a small boat basin where the existing boathouse is located to avoid impacts to the wetlands fringe along the Gutter. Please be advised that the Association will be removing the boathouse. The channel to extend from Mattituck Creek to the proposed boat basin is 30 feet wide with 1:3 sideslopes to avoid erosion of the adjacent NYSDEC (Oregon Marsh) tidal wetlands. The Association is willing to limit the dredging to the bare minimum necessary to allow navigation. Again, the catwalks over the wetlands and the dredging in the littoral zone has been eliminated to reduce impacts. However, the Association must receive permission for some dredging to allow passage to the navigable waters of Mattituck Creek. I remind you that this dredging was completed in 1948-1950 by Army Corps of Engineers permit. Please be advised that this office has already submitted information on riparian rights to the NYSDEC which they are reviewing with their Legal Department. Please resume your review of this application using the DRAFT plans enclosed. I assume by review of your September 25, 1991 letter, that the project was tabled pending an alternate plan. The CAC recommends disapproval because there is no sign of erosion. Placement of a bulkhead may lead to erosion by backwashing of stormwaters. Application submitted by Howard Ludecker. The project is a Type I action because it is adjacent to NYDEC wetlands protection area, it is located in a CEA, and the location is in an area that is a primary, principal or sole source aquifer. Also, shellfish opportunities exist around the area. The CAC in addition recommends that, instead of the requested floats, two floating docks along the bulkhead to accomodate six boats.
