The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land use, navigation, shoreline erosion and accretion,recreation,water supply and conservation,water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and, in general, the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Seebode C ef, Regulatory Branch Enclosures CENAN-OP-RE PUBLIC NOTICE NO. 1991910-L2 WORK DESCRIPTION The applicant, Sebastian's Cove Property Owners Association, has requested Department of the Army authorization to install mooring piles and dredge material from Sebastian's Cove, Mattituck Creek at Mattituck, Town of Southold, Suffolk County, New York with ten years maintenance and subsequent upland disposal. The work would involve dredging, with ten years maintenance, by clamshell, up to 10 feet seaward of the existing bulkhead to a depth of 4 feet below mean low water, removing approximately 50 cubic yards of material on an initial basis. Additional events anticipated every other year during the ten-year life of the permit, removing approximately 25 cubic yards of material. All dredged material would be disposed of at an on-site upland location where it would be suitably retained so as to prevent reentry into any waterway. The applicant also proposes to install 11 mooring piles to create 10-foot wide boat slips. This requires the removal of approx. 1.5' in depth of bottom for a total volume of 50 +/- c.y. Sebastian's Cove Road N/o Mill Rd., Mattituck The CAC expressed a concern regarding the concentration of boats allowed in that particular area for an association application. As a matter of record the original subdivision application for Sebastians Cove depicted use of the waterfront for mooring of privately owned boats of the Property Owners of the Association. Furthermore, Riparian Rights of the owners were affirmed in a Court of Claims Decision #72690 dated July 26 , 1989.
