Moore, Esq. 51020 Main Road Southold, NY 11971 RE: SCTM#70-12-39.4 Joanna & Dennis Lane 1852 North Bayview Road Southold, NY Dear Ms. Moore: The Board of Town Trustees took the following action during a Regular Meeting, held on May 21, 2003 regarding the above matter WHEREAS, Patricia C. Moore, Esq.. on behalf of Joanna & Dennis Lane applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of South old, application dated October 7, 2002 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 21, 2003 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. WHEREAS, the Board has determined that the project as proposed will not affect the health, . . safety and general welfare of the people of the town. NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approved the application of JOANNA & DENNIS LANE request a Wetland Permit for timber dock (3'x40') minimum 3' above grade -ramp (3'xI2') with a new location for the stairs and the board walk four foot wide - 6 inch piles on the dock as per plans submitted. and dated July 7, 2003 by Sea Level Mapping. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Fee must be paid, if applicable and permit issued within six months of the date of this notification. Inspections are required at a fee of$5.00 per inspection. (See attached schedule). This Department objects to the location of the proposed dock because it does not meet the standards for permit issuance as per Section 661.9 (b)(ii) of 6 NYCRR Part 661 (Tidal Wetland Regulations). We find that the current proposal is not compatible with the public health and welfare because the proposed location for the dock would create a navigational hazard for other boats as they pass through the narrow opening under the bridge adjacent to the project location. The only circumstance in which the Department could approve the proposed dock is if it were relocated 100' south of the currently proposed location. Should your client choose to modify the proposal to comply with this recommendation, please submit four sets of revised site and crossview plans to my attention at the above address.
