RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to

At the meeting of the Southold Town Conservation Advisory Council held Wed., July 13,
2005, the following recommendation was made:

highlighted several areas that pertain to the waterfront, wetlands, and landscaping.

Dear Mr. Keegan:
The following will serve as mitigation in order to comply with the requirements of
Trustee Permit #5600, as originally listed on the letter to you of May 24, 2005:
1. Apply for an amendment to Trustee Permit #5600 for the concrete wall to be 31'
from the wetlands.
2. Apply for an amendment to Trustee Permit #5600 for the deck to be 56' from the
wetlands.
3. Decrease the lawn width from 94' to 47'. Remove all turf in the designated buffer
area, as per the survey prepared by David H. Fox of Fox Land Surveying Last
dated October 24, 2002, and replant with native, upland tidal wetland buffer
species. Attached is a list of plants that can be used. Please submit a planting plan
for approval by this office.
4. Increase the buffer on the eastern side of the property by removing the turf and
planting with native species. Submit a planting plan for approval.
5. West of the dock needs to be planted with a buffer. Submit a planting plan for this
area as well.
6. Allow the Phragrnites to grow. Any cutting of the Phragmites is allowed by
Trustee permit only. Amend your permit to include the cutting o f Phragmites.
7. Remove the fencing from the intertidal area.
8. Move the rowboat out of the intertidal area to an upland area.
9. Remove the wood chips from the non-disturbance buffer.
Please submit the planting plan and amendments to your permit by June 1, 2005 for our
June meeting deadline for public notice. After the approval of your planting plan them
will be a 60-day time period to plant these areas. Please contact this office at the
completion of the plantings. There will be 2 inspections; one at the completion of the
plantings and one 60 days later.
Attached are the forms for an amendment application. The fee is $50.00. The fee for each
inspection is $50.00.

Dear Mr. Keegan:
The Board of Trustees has inspected the above referenced property, as per your request,
for a final inspection on Permit # 5600, issued on July 24, 2002. The Board found the
following items were not in compliance with the conditions of your permit, according to
the survey prepared by David H. Fox of Fox Land Surveying last dated October 24, 2002,
and the Trustee permit:
1. The concrete retaining wall is 31' from the wetlands. The survey shows 34'. The
wall is 3' closer to the wetlands than what is permitted. This is a violation of
your permit.
2. The wood deck on the south side of the house is 56' from the wetlands. The
survey shows 68' from deck to wetland. The deck is 12' closer to the wetland than
is permitted. This is a violation of your permit.
3. The width of the lawn, east to west, to the east of the dock is 94'. The survey
shows 47'. The lawn area is 47' more than permitted. This is a violation of your
permit.
4. The house/patio is 30' to the buffer to the wetland, at the eastern side of the
house. The survey shows 10'. The buffer is 20' less than permitted in this area.
This is a violation of your permit.
5. The buffer area to the west of thc dock is 4'. Thc survey shows 40'. Thc buffer in
that location is 36' less than permitted. This is a violation of your permit.
6. Phragmites australis, a protected wetland plant, has bccn cut on the west side of
your property, in an area designated as non-disturbance buffer on your permit and
survey. This is a violation of your permit.
Garden fencing has been placed in the intertidal area along the creek, presumably
as a barrier to Canadian Geese. This is in violation of Chapter 97, the Town
Wetland Code. Please remove all fencing.
There is a rowboat upside down on the marsh in the intertidal area. This is also in
violation of Chapter 97. Please remove the boat and store it in the upland part of
your property.
There are wood chips in the non-disturbance buffer area on the eastern side of
your property. A non disturbance buffer is defined in Chapter 97 as follows:
"An area, typically fifty (50)feet wide, immediately landward of the wetland
boundary, shoreline structure, or other line designated by the Trustees where no
operations, maintenance or other activities can take place."
The non-disturbance buffer is an area designated to remain in its natural state, in
order to provide a buffer area to the creek, provide habitat, and for flood control.
Please remove the wood chips in the Phragmites.
Please contact this office to discuss the requirements for conforming to your
permit and the regulations of the Town. The Trustees will send a representative to
meet you at the above referenced property to clarify the items in this letter. We
expect to hear from you within 10 days of receipt of this letter.

The following action as taken by the Board of Town Trustees during a Regular Meeting, held on
July 24,2002, regarding the above matter.
WHEREAS, Catherine Mesiano on behalf of Gerald Keegan applied to the Southold Town
Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold,
application dated July 2, 2002.
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
July 24,2002 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surroúuding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people ofthe town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of Gerald C. Keegan for a
Wetland Permit to construct first and second story additions to existing single family residence-
west side +/- 8.5'x30' one story addition east side +/- 55'x64' two story addition consisting of
attached garage - habitable space and covered porch in ground pool and patio pervious driveway
remove existing garage - showing the set back at 62 feet - consistent with the old building and
that those plan show a 50 foot non-disturbance buffer with hay bales a planting plan and that
planting plan has to be implemented before the applicant can receive CO and the new house
needs drywells and gutters.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification,
If inspections are required, at a fee of$5,OO per inspection (See attached schedule),
