Dear Mr. Safir:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 26, 2004 regarding the above matter:
WHEREAS, HOWARD SAFIR applied to the Southold Town Trustees for a permit
under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance
of the Town of Southold, application dated April 9, 2004, and,
WHEREAS, said application was referred to the South old Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 26, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of HOWARD SAFIR to
install a waterline over the driveway utility easement for county water.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Tuesday, May
11, 2004, the following recommendation was made:
Moved by Don Wilder, seconded by Doris McGreevy, it was
RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH
A CONDITION of the Wetland Permit application of HOWARD SAFIR to install a
waterline over the driveway utility easement for county water.

The CAC recommends Approval of the application with the Condition the area is
restored to the previous condition.

Dear Sir/Madam;
During a recent inspection, Department staff noted a potential violation at 312 Oaklawn
Ave, Southold (Suffolk County). Specifically, excavation of a trench approximately 3' wide by
150' in length in the adjacent area to a regulated tidal wetland without benefit of permit. These
are regulated activities within the Department's Tidal Wetland jurisdiction and therefore, require a
permit from the Department.
Conducting regulated activities without the required NYSDEC permits is a violation of
Article 25 of the State's Environmental Conservation Law. Such violations may be subject to a
maximum penalty of $10,000 per day per violation.
At this time, the Department is issuing this warning letter in lieu of further enforcement action

In reference to my application for a Trustee Pennit to connect a water line from my house
at 2 I 31 Oaklawn Avenue to Suffolk County water, let me provide you with the following
tàcts.
Last winter my wife and I were asked by a local committee of citizens whether we
wished to hook up to Suffolk County water when it became available in the spring. We
indicated that we would be interested and through trus committee, contacted the Suffolk
County Water Authority, who advised us that we would have to hire a licensed and
bonded contractor to run a line from our house to Oaldawn Avenue. My wife then
contracted with Krieger Well & Pump Corp, of Matti tuck, New York. Krieger Well told
us that they could shoot a "bullet" under the shared driveway to which we have a right of
way and where our gas line currently runs trom Oaklawn A venue to our house. We
assumed that since Krieger Well was in this business that they knew and would obtain
whatever pennits were required.
About March I of trus year, I received a call trom a neighbor. Mr. RlIssell, complaining
that our contractor was digging up the driveway without proper notice to him. I
contacted Krieger Well and was told that Mr. Russen had complained to the State DEC
and the Town. This was the first I became aware that no permits had been obtained. I
asked Krieger Well to make sure they were compliant with whatever pennit requirements
there were and I, personally, called both Lauren in the Trustees' Office and Chuck
Hamilton at the State DEC. The State DEC looked into the matter and responded with a
letter advising me that we had not properly pennitted this project. However after looking
at it, thev have approved completion of the project and no further action is required on
my part with the State DEC. I have provided a copy of the State DEC letter to Lauren.

When I contacted Lauren in the Trustees' Office she advised me of the permit
requirement and provided me with an application which I have submitted. She also
advised me that because the work had begun without permit, it would be necessary to pay
a double fee ($500). I submitted the application and paid the fee.
Recently, Lauren requested that I provide a copy of our survey showing my right of way
on the shared driveway. I provided a copy which I have been advised was very hard to
read and am in the process of attempting to get a more legible copy to provide to the
Board.
It is my understanding that the pipe has been installed and that the excavation has been
filled in. The work that remains is connecting it to my house and to the Suffolk County
water line on Oaklawn A venue when that is finished.
Let me state that at no time was it my, or my wife's intention to be non-compliant with
any Town or State regulations. We love our house in Southold and are only interested in
meeting whatever obligations are required by the Town.
