Dear Ms. Mesiano:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 25, 2000 regarding
the above matter:
WHEREAS, Catherine Mesiano on behalf of KARL RIESTERER applied
to the Southold Town Trustees for a permit under the provisions
of the Wetland Ordinance of the Town of Southold, application
dated July 28, 2000, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 25, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with thè pcemises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standards set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
KARL RIESTERER to construct a second floor addition to extend 5'
beyond the existing footprint (no first-floor expansion), with
the condition that a line of hay bales be placed down at the top
of the bank during construction.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

2000, the following recommendation was made:
Moved by Jaclyn VanBourgondien, seconded by Scott Hilary, it was
RESOL VED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of KARL RIESTERER 70-4-47 to construct a second floor addition
to extend 5' beyond existing footprint, and recommends DISAPPROVAL to install an 18'X 30'
in-ground pool with additional retaining wall landward of existing seawalL
1945 Calves Neck Rd" Southold
The CAC recommends Disapproval of the pool for the following reasons:
1, The existing landscape does not conform to proposed pool structure,
2 There would be excessive inrringing upon the wetland boundary,
3, The proposed alteration of the bank would have a negative impact on the wetlands,
4, The existing wetland buffer is working and there is no need shown for disturbance,
