Teieonone SO 5-2660 MINUTES SOUTHOLD TOWN BOARD OF APPEALS April 2, 1964 A regular meeting of the Southold Town Board of Appeals was held 7:30 P~M.® Thursday~ April 2~ 1964~ at-~he Town Office~ Main Road~ Southold~ New York. There were present: Messrs: Robert Wo Gillispie~ Jro~ Chairman~ Robert Bergen~ Fred Hulse~ Jro~ and Charles Grigonis~ Jr~ Absent: Mr~ Serge Doyen., Jro PUBLIC HEARING: Appeal No° 641 - 7:30 P.M. (E.S.T.)~. upon application of H. Ao Clark & Sons~ InCo of Greenport~ New York a/c Everett Knoblock~. 1501 Pine Neck Lane~ Mamaronek~ New York for a variance in accordance with the Zoning Ordinance~ Article III~ Section 300~ Subsection 7~ for permission to erect a private detached garage in the side yard area of property located on the north side of Soundview Avenue~. Southold~ New York~ bounded north by Diplaros - Ober~ east by John Parks. south by Soundview Avenue~ and west by Lloyd H. Clark° Fee paid $5°00° Southold Town Board of Appeals -2- Apri! _2, 1964 The Chairman opened the hearing by reading application fora variance~ legal notice of hearing~ affidavit attesting to its publication in the official newspaper~ and notice to the applicant. The Chairman showed to Judge Henry Clark pictures that were taken of the property in question~ and he identified them. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? HENRY CLARK, JR.: When this was originally laid out~l it was back 3 ft. further. Howevers, large trees prevented from putting it back further° We would also have continual difficulty with the grease trap and cesspool° THE CHAIRMAN: Could it be put back by the removal of the trees? HENRYCLARK, JR.: It would mess up the appearance of the back yard area° THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection of the site the Board finds that the difficulties and hardship noted by the applicant are compounded by an irregulary sha/ped andundersized lot~ and that the house was built prior to the Zoning Ordinance° It is the Boards~ opinion that straight adherence to the back yard requirements of the Ordinance in this instance would not improve the character of the neighborhood~ might in fact~ deteriorate its character by causing the removal of substantial oak trees° The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same district; and the variance does observe the spirit of the Ordinance and will not change the character of the district° On motion by Mro Gillispie~ seconed by Mro Hulse~ it was~ RESOLVED that H. (E.S.T.)~ upon application of Edith Mo Young~ Westphalia Road~ Mattituck~ New Yorka for a variance in accordance with the Zoning Ordinance, Article III~ Section 303~ and Article~i~ S~ction 1000A~ for permission to divide a parcel of land into two separate lots with insufficient frontage and area. Location of property: north side Middle Road~, Mattituck~ New York~ bounded north by Monahan - Stelzer~ east by Haas - Jacobsen~ south by Middle Road~ and west by Louis Kinirski. Fee paid $5.00. The Chairman opened the hearing by reading application for a variance~ legal notice of hearing~ affidavit attesting to i~s publication in the official newspaper~ and notice to the applicant. THE CHAIRMAN: this application2 Is there anyone present who wishes to speak for MRS. YOUNG: This piece of land was the right size until the county road went through° THE CHAIRMAN: Was the lot always that angle? MRS. YOUNG: It was always that angle. By looking at the map~ you can see were some of the property was taken off° The lots were 125 ft. in depth~ and are 99 fto in depth now° There was a general discussion about the county taking property~ how much property they take~ and what price they pay for it. Mrs. Young also explained that she had a customer that would only buy these lots if it can be used as two lotso THE CHAIRMAN: Is there anyone present who wishes to speak against this appli=ation? (There was no response°) The Board finds after investigation and inspection of this property,, that the difficulties noted are primarily a result of the county taking approximately 2~ of the northerly area of lots~ Southold Town Board of Appe~l.s -4- Apr~ 2~ 1964 which were legal size prior to the new road construction~ and agrees with the reasoning of the applicant as to the unusual and unlque hardship which would be created by requiring this parcel to be considered as one loto Accordingly it is our opinion that the division as outlined in the application is a fair solution and that the effect will not materially change the character of the neighborhood° The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property.~ and in the same district; and the variance does observe the spirit of the Ordinance and will not change the character of the district° On motion by Mr° Bergen~ seconed by Mr° Gillispie~ it was RESOLVED that Edith Mo Young~ Westphalia Road~ Mattituck~ New ¥ork~ be granted permission to divide a parcel of land into two separate lots with insufficient frontage and area° Location of property: north side Middle Road~, Mattituck~ New York~ bounded north by Monahan - Stelzer~ east by Haas - Jacobsen~ south by Middle Roa~ and west by Louis Kinirski. Vote of the Board: Ayes: - Mro Gillispie~ Mr. Bergen~ Mr. Hulse~ and Mro Grigonis~ Mro Tredwell Abrams appeared before the Board for an informal discussion~ in reference to placing a third ground sign at the Sea Shell Marina~ south side Main Road~ Greenport~ New York. On motion by Mr. Gillispie~ seconded by Mr. Hulse~ it was RESOLVED that the minutes of the Southold Town Board of Appeals dated March 19~ 1964~ be approved as submitted° Vote of the Board: Ayes: - Mr. Gillispie~~ Mr. Bergen~ Mro Hulse,~ and Mr. Grigoniso - On motion by Mro Gillispie~ seconded by Mro Hulse~ it was RESOLVED that the Board of Appeals set 7:30 P~M. Westerlund~ Southold Fire Department~: Southold, New York, asking him to inspect the right-of-way known as Park Place, east side South HarborRoad~ Southold~ And give the Board his opinion as to whether this right- of- way is suitable for the passage of fire trucks and emergency equipment.
