(E.S.T.)~ upon application of Tredwelt Abrams~ Sea Shell Marina~ Southold~ New York~ for a special exception in accordance with the Zoning Ordinance~ Article IV~ Section 408~ Subsection Ap for permission to erect a third ground sign at the Sea Shell Marina, south side Main Road~ Greenport~ New York. Fee paid $5.00° The Chairman opened the hearing by reading application for special e~eption~ legal notice of hearing~ affadavit attesting to its publication in the official newspaper~ and notice to the applicant° The Board discussed what wording would be used on Mro ~bram's sign° Southold Town Board of Appea_] -2- April 16, t96~ CHAIRMAN: Is there anyone present who wishes to speak in favor of this ~application? (There was no response.) CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that this sign is in line with the policy previously applied to signs. Signs give the traveling public assistance in relation to places of amusement, places to sleep, etc. in the Town of Southold. The Board finds that the public convenience and welfare and j~tice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. On motion by Mr. Bergen, seconded by Mr. Hulse, it was RESOLVED that Tredwell~Abrams, Sea Shell Marina, Southold, New York, be granted permission to erect a third ground sign at the Sea Shell Marina, south side Main Road, Greenport, New York, subject to the following conditions: 1. Written permission from the owner of the premises and the tennant of the premises to erect the sign in the above mentioned location. 2. The sign will be at least 5 feet from any lot line. 3. The sign will be removed when the boat is not docking in this marina. Vote of the Board: Ayes: Mr. Gillispie, Mr. Bergen, Mr. Hulse. PUBLIC REARING: Appeal No. 644 - 7:45 P.M. MILOWEKI: Yes° After investigation and inspection the Board finds that the access road to the property of the applicant is in passable condition for emergency vehicles~ and would not present difficulties in case of an emergency. (EoSoTo), upon application of Ann DeMaria, 5 Weldon Road, Commack, New York, for recognition of access in accordance with State of New York Town Law~ Section 280A. Location of property: private road known as Park Place, east side South Harbor Road, Southold, New York, bounded north by M. Crane, east by E.H. Ford, south by L. Ford~ west by Park District. Fee paid $5.00° The Chairman opened the hearing by reading application for recognition of access, legal notice of hearing, affadavit attesting to its publication in the official newspaper~ and notice to the applicant. CHAIRMAN: Is there anyone ~resent who wishes to speak in favor of this application? (There was no response.) CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) The Chairman read a letter from the Chief of Southold Fire Department, which reads as follows: Dear Fir. Gillispie: I inspected this right-of-way known as Park Place and find it very hazardous~ there are several trees I fear we may strike entering~ particularly at night. I recommend slightly widening and scraping road level before I would approve it. Incidentally at the alarm of fire we attempt to go anywhere and usually do. Very truly yours, Adolph G. Westerlund, Chief Engineer. Mr. Terry, Esq., representing Ann DeMaria, then appeared at the hearing. The Chairman again read the letter f~om the Fire Chief to Mr. Terry. Mr. Terry said he would see someone in the area and try to make some arrangement for making the access in better condition. After investigation and inspection the Board finds the access is very hazardous by having several trees with limbs that stick out, also the road is unlevel. A fireman ccould very easily be hurt while trying to enter the access at night. However, clearing and leveling the road, and trimming some larger branches from the trees would make the access passable for emergency equipment. The Board also finds the lot is over-sized. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity-of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. Subsection A~ for permission to sell a lot with 75 ft. frontage° Location of property: west side Robinson Road~ Greenport~ New York~ bounded north by'A° Rosenberg~ west by Robinson Road, south by Do Bruckheimer and Sterling Creek~ west by Sterling Creek° Fee paid $5.00° The Chairman opened the hearing by reading application for variance~ legal notice of hearing~ affadavit attesting to its publication in the official newspaper~ and notice to applicant~ The Chairman found there was a misprint in the legal notice. The legal notice read Article III~ Section 300~ Subsection A; it should have read Article III~ Section 303~ Subsection A. Mrs° Brown agreed to change the Section on the legal notice. MRS° BROWN: I do. CHAIRMAN: I think its explained ~very clearly in the application~ you don~t need to say anymore. Is there anyone present who wishes to speak against this application? (There was no response.) The Board discussed with Mrs. Brown the property surrounding Mrs. Lyons property. After investigation and inspection the Board finds that the property has insufficient frontage. However, the lots in this area are irregular, some have more frontage on the water than they have on the road. The Board agrees with the reasoning of the applicant for applying for the variance. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. On motion by Mr. Gillispie, seconded by Mr. Hulse~ it was RESOLVED that Edna Brown, East Marion, New York~ a/c Helen~tH. Lyons, 36 Ocean Drive, St. Augustine, Florida, be granted permission to sell a lot with 75 ft. frontage located west side Robinson Road, Greenport, New York, bounded north by A. PUBLIC HEARING: Appeal No. 648 - 8:45 P.Mo (E,SoTo), upon application of George Moore, 152 Flanders Road, Riverhead, New York, for a special exception in accordance with the Zoning Ordinance, Article IV, Section 408, Subsection A, for permission to erect a directional sign on the property of Mary Phylko~ south side Sound Avenue~ Mattituck~ New York, bounded on the north by Sound Avenue, east by F. Walgo, south by C. Price, west by H.Ro Reeves & Sons. Fee paid $5.00. Southold Town Board of Appeals -8- April 16~ 1964 The Chairman opened the hearing by reading application for special exception~ legal notice ofhearing~ affadavit attesting to its publication in the official newspaper~ and notice to the applicant° The Chairman re~d a letter from the owner of the premises~ giving George Moore permission to place a sign on her property. CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? (There was no response.) CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response) After investigation and inspection the Board finds that three businesses will be advertised on one sign. The sign will read: "Anchor Inn Dock"~ Bar and Restaurant~ "Open Boat---Tex III"~. "Naugles Dock". In the past "Bar" has not been permissable on signs° The Board also finds the sign will be beneficial to the traveling public. Mrs. Sepko (or Mrs. P~lko, whichever name ms correct) has given permission to George Moore to place a sign on the north west corner of her property. The Board finds the public convenience and welfare and jt~tice will be served and the legally established or permitted use of neighborhood property and adjoining use districts ~will not be permanently or substantially injured and the spirit of the Ordinance will be served° On motion by Mr. Gillispie~ seconded by Mr. Bergen, it was RESOLVED that George Moore~ 152 Flanders Roads Riverhead~ New York~ be granted permission to erect a directional sign on the property of Mary Pylko~ south side Sound Avenue~ Mattituck, New York~ bounded on the north by Sound Avenue~ east by F. Walgo® south by~C. Price~ west by H. Ro Reeves & Sons~ subject to the following conditions: 1o The word- "Bar" be removed from the sign. 2o The sign shall be no larger than 4: x 8'. 3. Mr. Hulseo Southold Town Board of Appeals -9- April 16~ 1964 PUBLIC HEARING: Appeal Noo 649 - 9:00 P.Mo (E. SoTo)~ upon application of Long Island Lighting Company~ 175 E. Old Country Road~ Hicksville~ New York~ for a special exception in accordance with the Zoning Ordinance~ Article III~ Section 3004 SubSection 6a~ for permission to install an area protection generator on property of Long Island Lighting Company~ north west side of Main Road~ (Route 25)~ Greenport~ (Arshamomaque)~ New York~ bounded north by Stepnoski~ east by So Ciacia Estates~ south by Main Road~ west by Drossos and Rempeo Fee paid $5°00° There were three representatives from the Long Island Lighting Company present at the hearing: Mro William Burns~ Mr~ Davi~ Song~ and ~o Perry Hatch. The Board and the repzesentatives from the Long Island Lighting Company first discussed the type of generator to be erected° Mr. Song showed pictures of another plant just like the one to be erected in ~Greenport~ and the Board discussed it briefly. The Chairman read application for a special exception~ legal notice of hearing~ affadavit attesting to its publication in the official newspaper~ and notice to the applicant° CHAIRMAN: All of the Board has seen the site where the generator is to be erected~ east of the Drossos Motel and very close to Chapel Lane. The Board established that the area is under contract~ subject tothe Long Island Lighting Company obtaining permission to erect the generator° CHAIRMAN: How much land does Manor'Acres own? MR. SONG: Almost six acres° ~. HULSE: So you will have a little under six acres? MR. SONG: Yes. The Chairman read the legal description of the property in question° CHAIRMAN: Part of this land is swamp, isn't it? MR. SONG: It appears that way~ yes. Mro Song presented to the Board an air photograph of the property showing the proposed location of the generator° The Board discussed it briefly. CHAIRMAN: One of the things that concerns us here is the Southold Town Board of Appeals -10- April 16~ 1964 possibility of fumes° MR. SONG: In the application there is the approval from the State Department of Air Polutiono The State has also approved the Southampton operation. The representatives had numerous maps which the Board viewed and discussed. CHAIRMAN: We are also concerned about the noise that will be coming from this generator~ MR. BURNS: We expect this unit to be better than Southampton° The sound would not be lOUdo Mr. Burns then went into further detail and explained the technical points involved in the sound from the generator° He used a photo to explain the intake of the generator and how the noise would be kept lOWo The estimated sound volume in decibels is considerably lower than other permitted uses° CHAIRMAN: Will there be anything around the generator to protect it~ and protect people from going near it? MR. BURNS: There will be a 7 ft. high fence surrounding the generator. CHAIRMAN: How frequent would you be checking this generator? MR. BURNS: We have someone stop once a week and check it~ and it is completely'overhauled once a month. CHAIRMAN: How many hours would this generator be running? MR. BURNS: It would be running 300 to 400 hours a year. The Board had a discussion with the representatives on the advantages of having this protective generator'in this area. CHAIRMAN: What is the area of protection covered by this generator? MR. BURNS: It will cover from the proposed location to Riverhead~ and from the proposed location to Orient. CHAIRMAN: What hazards would be presented by this installation generator? MR. BURNS: I can think of no .hazards in connection with the generator. It will be surrounded by a 7 fto high fence as was mentioned before° Also the 127~000 gallon oil storage tank will be surrounded by a protective trench. Southold Town Board of Appeals -11- April 16~ 1964 MR. HOWARD TERRY: Who would have a key to this area? MR. BURNS: There would be a key at the substation. MR. HULSE: How would the grounds be kept up around the place? MR. BURNS: We don~t expect frankly to do anything with the property except putting in the generator° However~ we do expect-to plant trees to protect the generator from the road. It was established the oil supply represented a ten (10) day storage based on a 24 hour day. However~ actual operation will proSably be 300 to 400 hours a year° Mr. Song made the foll~ing statement to the Board: The Town Board of the Town of Southold recently enacted an amendment to the Building Zone Ordinance~ which now authorizes the Zoning Board of Appeals to grant a special exception to permit a Public Utility use in an area zoned "A" Residential. The amendment appears now in Subsection 6a of Section 300 of Article III~ of the Ordinance° It is pursuant to this Subsection 6a that this application is made tonight° The property which is the subject of this application consists of approximately 6 acres and is located 500 feet east of Chapel Lane~ on the north side of Main Road° The Company has contracted to purchase this property from the Manor Grove Corporation, subject to obtainSng approval of the Town authorities for construction and installation of an electric power generating facility° Because of the great distance between the eastern end of Long Island and the nearest steam generating plant in Port Jefferson~ the electric transmission lines that supply power to the North and South Forks of Long Island are extremely vulnerable to damage and service interruptions during periods of snow and ice storms and hurricane winds° Between 1950 and 1962~. there have been 12 cases of prolonged outages of~one hour or more affecting the Greenport area. The total experienced service interruption time to our customers in this area resulting from these outages was approximately 50 hours. On March 20~ 1958~ a severe ice storm caused numerous transmission line outages on the North Fork resulting in a 20 hour power failure to the Greenport area° In 1962~ Long Island Lighting Company instituted a study to determine the best possible way to improve continuity of service to our customers on eastern Long Island° Costt efficiency~ and feasibility considerations showed that the answer was to install small electric Southold Town Board of Appeal~ -12- April 16~ 1964 generators for area protection at various stra%egic locations on our system. As can be seen in Exhibit~"C'' (Map of Long Island)~ Greenport is well located for this purpose~ situated as it is midway on the North Fork° In the event of an emer- gency power failure west of Greenport between Riverhead and Greenport~ or a failure east of Greenport~ a small generating unit will provide continuous emergency power until the line failure is corrected. The particular property site in question was chosen by the Company as the site of the generating unit, because of its close proximity to the Company's existing substation located west of Chapel Lane in Greenport. It is estimated that the total cost of the project will be approximately $1~.500~000o00 Construction is scheduled to begin in June of this year and the estimated completion date is in August~ 19644 The installation itself will consist of a gas turbine and generator, air intake structure~switchgear and a small separate utility building for storage° In addition, an oil tankg 30 feet in diameter and 24 feet high will store fu~t to operate the generator° The unit is designed to produce an summer-winter average output of 15~000 kilowatts° The installation's fence will be set back 450 feet from Main Road° The Structures will be ~ack a few feet further from the fence. Since this generator is designed to operate auto- matically or on electric impulse from Hicksville~. and no service employees are needed at the site, there will be minimal increase of automobile traffic in the area. Of course~ the unit~will be serviced periodically by employees and oil deliveries~ but anyrt~affic resulting will be negligible. The surrounding and adjoining area is zoned Residence with the exception of a 200 foot strip of Business Zoning along Main Road on properties adjoining to the east~ west and south. On the basis of the papers submitted in support of this application~ it is respectfully requested that the Long Island Lighting Company be granted a special exception pursuant to Article III~ Section 300~ Subsection 6a of the Southold Town Board Of Appeal s -13- April 16~ 1964 Building Zone Ordinance, to permit the construction~ operation and maintenance of a generating facility on the property described therein° The Chairman read the affadavit attesting to Mr. Burns' qualifications on the technical points of the generator° He also stated that he felt the Board had expert opinion° MR. HULSE: The road coming out of the plant, will that be clear so that there will be no problem of the trucks getting in and out? MR. BURNS: yes. Mr, Burns showed on the map to the Board the sufficient area for trucks to pass in and out° CHAIRMAN: The location of this substation is approximatel~ 800 feet to the nearest building, Drossos Motel~ it is 1~700 feet approximately to the Sound Shore Motel~ it is 800 feet approximately to the westerly boundry of the beginning area of the actual trees~ it is approximately 600 feet to the nearest building across the Main Road to the South° Is there anything further for or against this application? (There was no response°) After investigation and inspection the Board finds that all hazards that were in question have been elimated. The Board finds there are no dangers of air polution~ the generator will not be extremely noisy, and there will be a 7 foot high fence around the generator to protect people from going near it~ The Board finds that the public convenience and welfare and jus- tice will be served and the legally established or permitted use of the neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. (E.S.T.), upon application of Constantine Kings 69 Further Lane~ Riverhead, New York for a special exceptio~ in accordance with the Zoning Ordinance Article III~ Section 300= Subsection 11~ for permission to erect a directional sign on the property of John G. Poliwada~ South west corner of North Road and Atbertson Lane~ Greenport, New York. Fee paid $5.00. The Chairman opened the hearing by reading application for special exception~ legal notice of hearings affada~it attesting to i~s publication in the official newspaper= and notice to the applicant° The Chairman also read a letter from John G. P~liwada giving Mr° King permission to place a sign on his property. CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? MI{. KING: Me. CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that Constantine King wishes to place a 4~ x 6' sign at the corner of the North Road and Albertson Lane which will read "King's Greenport BoWling Lanes~ Moore's Lane & Route 25". The Board finds that this sign is in line with the previously ~-expressed policy. It is in the interest of the public for places of amusement~ lodgeing, and recreation purposes in the Town of Southold. The Boar~ finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially ~njured and the spirit of the Ordinance will be observed° On motion by Mro Gillispie~ seconded by Mr° Bergen, it was RESOLVED that Constantine King, 69 Further Lane~ Riverhead~ New Yorka be granted permission to erect a directional sign of the property of John G. Poliwada~ south west corner of North Road and Albertson Lane~ Greenport, New York~ Subject to the following conditions: 1o The sign shall be placed 5 feet from any property line. 2. MR. KING: Yes° Isn't there a telephone building going in this area in the near future? The Board~ Mr. Terry~ and Mr. King discussed the telephone building that is proposed to go in the area in question and how this building would effect the present "Bowl" sign Mr° King now has on the Bowling Alley° CHA~: Are there any other questions? (There was no response.) After investigation and inspection the Board finds that due to the fact a telephone building might be placed in this area~ Mr~ King's Bowling Alley would not be~ as easy to spo~inwhen traveling east on %he Main Road~ the telephone structure would block the view of the Bowling Alley° The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. KING: How about if I painted it on the back of the building? CPL~I~: You have already received three special exceptions for signs for this building. We deny painting s~gns on the roof to everyone. I can never remember granting permission to anyone to paint a sign on the roof° If you put the "Bowl" slgn on the side of the Duilding it will clearly advertise from any distance better than writing words° I can:t possibly grant this° MR. KING: I have to have something on the back of the roof. CHAIRMAN: You don~t have to have anything° MR. KING: As you come down the street you see a white roofs or a white building there~ you can't tell what it is.
