1. Thac the said Board of Trostees and the Town of Southold are released from any and
aU damages, or claims for damages, of suics arising ditectly or indirecdy as a result of any oper-
acion pedormed punuaot to this permit, and the &aid Permittee will, at his or her own expense,
defend any and all such suits lniciated by third parties, and the &aid Permittee assumes full liahIIity
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 24 mos. which is roasiderecl to he the
escimated cime required to complete the work involved, but should åtœmstaoces warrant, request
for an extension may be made to the Board at a later date.

3. l1,at this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the strucmre or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will he subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originacing application, may he cause for
revocation of this Permit by resolution of the said Board.
5. Thar there will be no unreasonable interference with navigation as a result of the work
herein au"dlorized.
6. That there shall he no intederence with the right of the public to pass and repass along
the heach between high and low water marks.
7. Thar if furure operations of the Town of Southold require the removal and/ot alterations
in the location of the wotk herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstruction to ftee navigation, the said Permittee will he required,
upon due notice, to remove or alcer this work or projecr herein stated without expenses to the Town
of Southold.
8. Thac the said Board will he notified by t he Permittee at the completion of the work auth-
orized.
9. That the Permittee will obtain all other permits and consents that may he required sup-
plemental co this permit which may be subject to revoke upon fallure to obtain same.

Dear Mr. Enrico:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1999 regarding
the above matter:
WHEREAS, Ocean Consulting on behalf of EDGEMERE PARK ASSOC.
applied to the Southold Town TrUstees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated August 16, 1999, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
EDGEMERE PARK ASSOC. to remove and replace, in same location,
approx. 105' of timber bulkhead and replace any backfill lost in
a 10'X 105' area.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Army permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403).

A detailed description and plans of Ihe applicant's activity are enclosed to assist in your review.
The decision whether to issue a pernlit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity on the public interest. That decision will reflect
the national concern for both protection and utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof: among those are conservation. economics, aesthetics, general
envirorunental concerns, wetlands, historical properties,. fish and wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion. recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs. consideration of property ownership and,
in general, the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal. state. and local agencies
and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by che Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision, commems
are used to assess impacts on endangered species, historic properties, water quality, general
envirorunental effects, and the other public interest factors listed above. Comments are used in
preparation of an Envirorunemal Assessmem and/or an Envirorunemal Impact Statemt;nt pursuant to the
National Envirorunemal Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public imerest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN
WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS
NOTICE, otherwise. it will be presumed that there are no objections to the activity.

Any person may request, in writing, before this public notice expires, that a public hearing be
held to collect information necessary to consider this application. Requests for public hearings shall state,
with particularity, the reasons why a public hearing should be held. It should be noted that information
submined by mail is considered just as carefully in the permit decision process and bears the same weight
as that furnished at a public hearing.
Our preliminary determination is that the activity for which authorization is sought herein is not
likely to affect any Federally endangered or threatened species or their critical habilat. However.
pursuant to Section 7 of the Endangered Species Act (16 USC 1531), the District Engineer is consulting
with the appropriate Federal agency to determine the presence of and potential impacts to listed species
in the project area or their critical habitat.
Based upon a review of the latest published version of the National Register of Historic Places,
there are no known sites eligible for, or included in, the Register within the permit area. Presently
unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished
under the required permit.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 V.S.C.
1456 (c) J. for activities under consideration that are located within the coastal zone of a state which has
a federally approved coastal zone management program, the applicant has certified in the permit
application that the activiry complies with, and will be conducted in a manner that is consistent with, the
approved state coastal zone management program. By this public notice, we are requesting the state's
concurrence with, objection to, or waiver of the applicant's certification. No permit decision will be
made until one of these actions occur. For activities within the coastal zone of New York State, the
applicant's certification and accompanying information is available from the Consistency Coordinator,
New York State Department of State, Division of Coastal Resources and Waterfront Revitalization.

WORK DESCRIPTION
The applicant, Edgemere Park Associates, has requested Depanment of the Anny authorization
to replace bulkhead and dredge material from Brushes Creek, Greal Peconic Bay at Laurel,
Town of Southold, Suffolk County, New York wilh ten years maintenance and subsequent
upland disposal.
The work would involve replacement, in the same location, of approximately 105 linear feet of
the existing bulkhead raised one foot over the existing bulkhead elevation and dredging, with ten
years maintenance, of approximately 100 cubic yards of material up to IS feet seaward of the
bulkhead to a depth of 4 feet below mean low water. Approximately 36 cubic yards of material
would be placed as backfill with the remaining 64 cubic yards of material trucked offsite to an
upland disposal location where it would be suitably retained so as to prevent its reentry into any
waterbody. Two additional dredging events are anticipated during the ten year life of pennit,
removing approximately 100 cubic yards of material per event, also to be trucked off-site for
upland disposal.
The staled purpose of this project is to provide adequate mooring facilities.
