~O-87-l119 Corey creek
Dear Mr. LaValle:
The Department of Environmental conservation has completeã
review ot your recent request to modify tne Tidal WetlandS,
Protection of Waters, Water Quality Certification permits for the
waterways referenced above. The permits are modified as
ClescrlÞed below:
10-82-02.. Sebonaa creek: We are unable to authorize the
requested extension of the activity window for 1995 because we
have documented the arrival of the first returning piping plovers
as of March 2nd. If the Sebonac dredging and beach nourishment
were to begin now, the possibility exists that the equipment and
human activity on the beach could disturb the courting, mating
and nesting activity of this endangered species at a site they
used last year. As an alternative, I hereby amend this permit
again to ~end the expiration date until March 15, 1996. This
extension should make it possible to dredge the creek during the
autumn of 1995 or late winter/early spring 1996.
10-87-1119 core? creek: The permit is hereby extended until
March 25, 1995 to allow completion of the 1995 dredqinq. special
condition #12 is hereby modified, for the year 1995 only, to
prohibit dredqing between 'Kax:.ch 25 and Auqust 15.
We have identified an additional issue which must Þe taken
into consideration as the work at Corey creek is completed.
There is an Osprey nest Bite on the beach in the vicinity of the
beach nourishment area, as well as historical use of the beach
for n..tinq by least: terns and/or pipinq plovers. In order to
prevent disturbance to th... species, the follOWinq conditions
are added:

17. The permittee shall have their qualitie~ wildlire monitor
at the project site on the day the dredqe and !:>each
nourishment pipes are dismantled tor removal. The monitor
shall be on site before any work starts (including vehicle
operation on the beach) to check for the presence of pipine¡
plovers and least terms. If either of these species is
siqhteà, the monitor shall not allow work to beqin, and
shall contact Kenneth Meskill - NYSDEC Bureau of Wildlife,
at 444-0270 for instructions.
18. Any beach nourishment pipe located within 150 feet of the
osprey nest site shall be removed in a single working day or
less to minimize disturbance to the nest site.
This amendment letter is now part of the DEC approval for
the Corey Creek project and should be kept with the December 13,
1994 and December 22, 1994 approval letters. This letter is also
now part of the DEC approval for the Sebonac Creek project and
sbould be kept with the october 24, 1994 letter on that project.
Finally, we also have potential nestine¡ shorebird concerns f
at the Richmond Creek site. Please be certain that all sand.
stockpiled at the Town of Southold park is removed by March 22 to
preclude any disturbance to shorebirds Which may return to this
nest site which was active in 1994. --1
If you have any questions on these projects, please call me
at 444-0359. Thank you for your cooperation in this matter.
very truly yours,
