consideration for the issuance of the Permit does undentand and prescribe to the fol-
1. That the said Board of Trustees and the Town of SouthoId are released from any and
aU damages, or claims for damages, of suits arising cfuectly or indirecrly as . result of any oper-
ation perfonned pursuant to this permit, and the IlBÍd Permittee will, at his or her own expense,
defend 80y and all such suits initiated by third parties, and the IlBÍd Permittee .-...... full IØhiIity
with respect thereto, to the complete exclusion of the Board of TrusteeS of the Town of Southold

2. That this Permit is valid for a period of mas. which is coasidered to be Ibe
estimared time required m complete the work involved, but shonid årcumstances warrant, request
for 80 extension may be made to the Board at a later date.
3. 11]at this Permit sbould be retained indefinitely, or as long as the said Permittee wishes
to maintain the strucmre or project involved, to provide evidence m anyone concerned that .ulb-
orizarion was originally obtained.
4. That the work involved will be subject tn the inspection and .pptoval of the Board or
its .gents, 80d non-œmpUance with the provisions of the originating .pplication, may be cause for
revocation of this Permit by resolution of the said Board.
5. That rhere will be no unreasonable interference with navigation as . result of the work
herein atidlOrized.
6. That there shall be DO interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the œmovaI and/or alterations
in the locarion of the work herein aulborized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstrucnon to free navigation, the said Petmittee will be required,
upon due norice, to remove or alter Ibis work or project herein stated wilbouc expenses to the Town
of Southold
8. That the said Board will be notified by the Permittee at the completion of Ibe work aulb-
orlzed.
9. That the Permittee will obtain all other permits and consents Ibat may be required sop-
plementaI to this permit which may be subject to revoke upon falluœ to obtain woe.

Dear Mr. & Mrs. Ruggiero:
The following action was taken by the Board of Town Trustees
during its regular meeting held on April 19, 2000 regarding the
above matter:
WHEREAS, HENRY & SUSAN RUGGIERO applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated March 22,
2000, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on April 19, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
HENRY AND SUSAN RUGGIERO for an existing 60' floating dock with
a metal ramp and for an existing bulkhead with the condition
that the piles on the right side of the dock, as you look out at
the water, be eliminated and replaced with two 2-pile dolphins
to hold the float in place, and repair or replace remaining
piles on the left side of dock, and replace the ramp, as per the
letter dated March 22, 2000.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Tuesday, April 11,
2000, the following recommendation was made:
Moved by Scott Hilary, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION of the Wetland Permit Application of HENRY & SUSAN RUGGIERO 63-7-
29.1 for an existing 60' floating dock and metal ramp, existing bulkhead, and replace piles,
which were dislodged by ice movement.

The CAC recommends Approval with the Stipulation that when the structure needs to be placed,
it must conform to present Trustees' policies and the number and size of the pilings should be
addressed.

Dear Mr. Stepnoski,
The Southold Town Board of Trustees held a Worksession on
Wednesday, March 22, 2000 at which time there was some
discussion regarding the immediate repair of Ms. Ruggiero's dock.
,
The Trustees agreed that you may start the repair of her dock
but to eliminate the piles on the right side of the dock as you
look out at the water, replace two 2 pile dolphins to hold the
float in place, repair or replace remaining piles on left side
of dock, and replace the ramp.
