Dear Membe~ of the Board of Trustees:
I am vailing on behalf of the l~,'n, fmrfily indianE my mother, Mary ~ Bums,
owner of property at 3125 Wells Avenue adjacmt to the pwpeny owned by Mr. And
Mrs. Hufe who are seeking a variance to tear down a proexisein$ house and replace it
with another closer to the v~atex ~nd approximately 20 feet into the 100 foot setback fram
the water required by the Town of Southold. It is our view that the proposed project
would have a n ~eE~tive impact on our property, the immediate co~,..anity and the town as
a whole.
Our home is occupied year round by our !~mily. Our quality of life here has to do with
the view, the light, the lovely breezes that come off the creek and the privacy we have
established. [:~l.h~rl~ what would be a larger house 20 feet fo~ard from its preexislin~
site would adversely affect all those qualities wa have enjoyed. I believe the truste~
have visited the site and are aware of how dose tol~her our two houses are and how
delicate that balance is.
We feel that this is also ma issue of quality of life for both the immediate co~anity and

broken by anyone who wants to. The purpose of having setbacks is, I would ~hink to
preve~ just such an evmt from happening ~ rules w~re established to protect not
just the mvit,.~m~nt of our shore line c~.~..anity but the character of Town itseff and the
q~mlity of life nhared by every~me. What would we do if everyone, as a result of this.
decided to get closer to the water and petionecl the town for variances?
While we feel that the Hufe's have every right to improve the quality of their lives, we do
not feel that they have the right to do so at any neighbor's expense, at the community's
expeme or at the Town's expe~x~. We, therefore, do not recommend that the board
approve the Hufe's plans as they have been presented.

the water required by the Town of Southold. It is our view that the proposed project
would have a negative impact on our property, the immediate 6t,,,:raunity and the town as
a whole.
Our home is occupied year round by our family. Our quality of life here has to do with

quality of life shared by everyone. What would we do if evel~one, as a result of this,

At the meeting of the Southold Town Conservation Advisory Council held Monday, October 23,
2000, the following recommendation was made:
Moved by Bill McDermott, se~:onded by Ken Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
CONDITION of the Wetland Permit Application of ELLEN HUFE 70-4-9 t6 remove existing
single-family residence and replace with new single-family residence in different location.
3195 Wells Ave., Southold
The CAC recommends Approval with the Condition that a 20' non-turf/non-fertilization buffer
be placed behind the bulkhead.

Dear Mr. Krupski and Board of Trustees,
Attached please find a redesign and relocation of the Hufe Residence. This new location was chosen
with respect to the letter of non-jurisdiction set backs as permitted by your letter of February 17,
2000.
I apologize for the inconvenience of reviewing this application twice, and adding to your busy
schedule. It was not understood that we would need to reapply for a change of location for a similar
structure as was previously proposed. With the extent and cost of the previously proposed renovation,
it became evident that the home could be better located to optimize their properly and views without
encroaching your Wetlands jurisdiction.
Please accept our request on the grounds of this earlier determination for a ruling of non-jurisdiction
despite any changes you are presently facing in change of jurisdiction. It has taken several months to
complete the redesign and we had no concept that the rules would be changing.
The proposed site is 81.2'+ to the nearest point of the tie line and it is 10'+ further to mean high
water.

'Dear Ms. Marten,
The Southold Town Board of Trustees reviewed the survey dated
and received in our office on February 14, 2000, and determined
that the construction of an addition on the southwest side of
and an addition to the southeast side an existing house to be
out of the Wetland jurisdiction, under Chapter 97 of the Town
Wetland Code.
However, any activity within 75' of the Wetland line would
require permits from this office.
This determination is not a determination from any other agency.
If you have any further questions, please do not hesitate to
