Box 521 Greenport, NY 11944 RE: ELLEN HUFE SCTM#70-4-9 Dear Ms. Martin: Thc following action was taken by the Board of Town Trustees during its regular meeting held on Wednesday, February 21, 2001 regarding the above matter: WHEREAS, Amy Martin of Fairweather Broxvn on behalf of ELLEN HUFE applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated January 2, 2001 and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 21, 2001 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, thc Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of ELLEN HUFE to remove the existing single-family dwelling and replace with a new single-family dwelling in a different location all as depicted on plans last revised March 9, 2001. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date-it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Accompanying this please find the sur~'ey for the property, locating the markers as they were seen on the 14th. The new site plan places the proposed residence starting 2' landward of those markers as requested in your approval at the February 21,200 l hearing. We still feel that a larger house moving forward towards the water and closer to us on our side of the property line-- where the houses are extremely close already-- willhave a negative impact on us and our property. We, therefore, object to the proposed plans for these reasons and the other reasons expressed iu our previous letter. In addition, we would greatly appreciate it if the board would review the proposed phns in light of existing covenants affecting the Hufl~ property end the fact that the lower portion of the property was filled in by the previous owner, Carl Vail, in order to ext~md the prop¢lty line beyoud its true boundaries. However, any activity within 75' of the Wetland line would require permits from this office. This determination is not a determination from any other agency.
