The Southold Town Board of Trustees revie~ved the ~urvey dated August 21, 2000 and
determined the construction of a second-story addition to the existing single-family dwelling, to
be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code.
However. an:, ac,tx,~ty w~thin ..v0 of the Wetland line or seaward of the Coastal Erosion Hazaru
Area would require permits from this office.
This determination is not a determination from any other agency.
If you have any ~trther auestions please do not hesitate to call.

There is a swimming pool being built at this property. They have no Trustee permit, and it may be over 100' from the
wetlands, but the DEC NJ letter did ask for a hay bale line.
I will fax over the survey that was given to Building Dept. for the pool permit.
We just want to make sure they won't have a runoff problem into the creek.

Ba~cd on the informataon you have submitted, the New York State Department of Environmental
Conservation has determined that thc property landward of the l 0 9.. elevation contour, as shown on
thc survey prepared by Anthony W. Lewandowski on 8/21/00, is beyond Article 25 jurisdiction.
Theretbre, in a,~orda~ace with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661)
no permit is required under the Tidal Wetlands Act. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward o?the tidal wetlands
jurisdictional boundary, as indicated above, without a permit. It is your responsibiliD, to ensure tint
all necessary precautions are taken to pr~wem any sedimentation or other alteration or disturbance to
the ground surface or vegetation within Tidal Wetlands jurisdiction which may result ~om your
project. Such precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a
temporary feneo, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or ~provals from other agencies.
