Dated October 30,2000,was issued and Amended on October 24,2001 and Amended again on
December 12,2018 and conforms to all of the
requirements and conditions of the applicable provisions of law. The project
for which this certificate is being issued is for the construction of a dock with a 10'x4' platform at

The New York District, U.S. Army Corps of Engineers, has received a request for
Department of the Army authorization for the following activity: ,
APPLICANT: Dennis Ude
ACTIVITY: The proposed work would install a new,ramp, three-feet wide by
..____1,5-feet long, and float, six-feet wide by 20-feet long, onto the end of
►P s ��' an existing fixed timber pier, four-feet wide by 87-feet long.. The
knew float would be secured by four (4) eight-inch diameter timber
, Iles. The water depth beneath the float would be approximately

aquatic vegetation in the project area. The proposed structure
would extend a total of approximately 85-feet seaward from the
plane of Mean High Water into Jockey Creek. The channel is
approximately 250-feet wide in the project location.

- . The purpose of this project is to provide safe access to the
waterway for a private residence.
WATERWAY: Jockey Creek, tributary of Shelter Island Sound
LOCATION: The project is located at 1227 Pine Neck Road, in the Town of
Southold, Suffolk County, New York.
As this is minor in nature, authorization may be by Letter of Permission. This is
in accordance with current Federal Regulations governing work in navigable waters of
the United States. To accomplish the coordination required, prior to the issuance of a
Letter of Permission, your review of the enclosed drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1456{c)(3)(A)), the applicant has certified that the activity
complies with and will be conducted in a manner that is consistent with the approved
state coastal zone management program.

Dear Mr. Anderson:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, December 12, 2018:
WHEREAS, Suffolk Environmental Consulting, Inc., on behalf of DENNIS UDE applied
to the Southold Town Trustees for an Amendment to Wetland Permit#5234 under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated October 18, 2018, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 6.3 and 9.3 of the Local
Waterfront Revitalization Program to the greatest extent possible through the imposition
of the following Best Management Practice requirements: the proposed structures are
within the pier line, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 12, 2018, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
BE IT FURTHER
RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit
#5234 to install a 3'x16' hinged ramp and a 6'x20' floating dock situated in an "L"
configuration supported by four(4) 8" diameter pilings off of the seaward end of catwalk;
and as depicted on the site plan prepared by Suffolk Environmental Consulting, Inc.,
dated November 30, 2018, and stamped approved on December 12, 2018.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

A Wetlands Permit (5234) was issued for the dock structure in 2000
DENNIS UDE requests an Amendment to Wetland Permit#5234 to install a 3'x16' hinged ramp
and a 6'x20' floating dock situated in an "L" configuration supported by four (4) 8" diameter
pilings off of the seaward end of catwalk. Located: 1227 Pine Neck Road, Southold. SCTM#
1000-70-5-36
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the below listed Policy Standard and therefore
is INCONSISTENT with LWRP.
63 Protect and restore tidal and freshwater wetlands.
The applicant has not demonstrated that the following dock standards pursuant to § 275-
11. Construction and operation standards have been met.
(d) Review and approval of dock applications. Before issuing a permit for a dock structure,
the Trustees shall consider whether the dock will have any of the following harmful
effects:
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependent
activities;
[5] Whether the dock will cause degradation of surface water quality and natural
resources;
[11] Whether the cumulative impacts of a residential and commercial dock will change
the waterway or the environment and whether alternate design, construction, and
location of the dock will minimize cumulative impacts; and
[12] Whether adequate facilities are available to boat owners and/or operators for
fueling, discharge of waste and rubbish, electrical service and water service.
9.3 Preserve the public interest in and use of lands and waters held in public trust by the
state and the Town of Southold.
A. Limit grants, leases, easements, permits or lesser interest in lands underwater in
accordance with an assessment of potential adverse impacts of the proposed use,
structure, or facility on public interest in public lands under water.
The dock structure will extend further into public waters resulting in a net
decrease in public access to/on public underwater lands. The applicant enjoys
access to public water via an existing dock structure.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C,the preparer of this form should review the exempt
minor action list,policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered"yes",then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus,the action should be analyzed in more detail and, if necessary, modified prior to making a

This Firm represents the owner of the above referenced property, who is seeking
all required regulatory approval to add a Hinged Ramp and Floating Dock to the
existing catwalk thereon. Please be aware that a permit was secured from your
Board in 2000 for a fixed catwalk, hinged ramp and floating dock, however, due
to the New York State Department of Environmental Conservation having issue
with the hinged ramp and floating dock, same was eliminated from the final
construction. We now wish to re-apply, and obtain, approval you're your Board
for the hinged ramp and floating dock. Please find enclosed:

NATURAL RESOURCE PERMIT CONDITIONS - Apply to the Following
- Permits: TIDAL WETLANDS
1. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.
2. Notice of Commencement At least 48 hours prior to commencement of the project,the permittee
and contractor shall sign and return the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project,the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
3. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area(upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.

4. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the permitted activities.
5. Storage of Equipment, Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 75 linear feet from the tidal
wetland boundary.
6. Use of Treated Wood The use of wood treated with Pentachlorophenol or other wood treatment not
specifically approved by the Department for use in wetlands and/or marine waters, is strictly prohibited
in the construction of structures that will be in contact with tidal waters.
7. Authorized Float Dock wiith Vertical Cable Stays Installation The float shall be installed at the
approved location and must include the installation of vertical cable stays capable of supporting the
structure so that the bottom is maintained at a minimum of 2'/z feet above the existing bottom grade.
8. No Floats, Ramps in Vegetated Tidal Wetlands Floats and ramps may not rest on or be stored in
any vegetated tidal wetland.
9. Use of Structure The authorized structure is provided for access to the waterway and is not intended
for the mooring or launching of vessels. Prop dredging, resulting from motorized vessels intentionally
powering in shallow waters, is a regulated activity and is not authorized by this permit.
10. No Dredging or Excavation No dredging, excavating or other alteration of shoreline or
underwater areas is authorized by this permit, nor shall issuance of this permit be construed to suggest
that the Department will issue a permit for such activities in the future.
11. No Permanent Structures on Dock No permanent structures shall be installed on
dock/catwalk/float without first obtaining written Department approval (permit,modification, or
amendment).
12. No Structures on Pilings No structures, other than structures specifically authorized by this
permit, shall be constructed on pilings without further authorization from the department(permit,
modification or amendment).

15. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause
loss or destruction of the natural resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, without
expense to the State, and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill
and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.
16. State May Require Site Restoration If upon the expiration or revocation of this permit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Department of Environmental Conservation may
lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
17. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants, epoxy coatings,paints, concrete, leachate or any other environmentally deleterious materials
associated with the project.
18. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by Suffolk Environmental Consulting (two sheets), dated 9/20/2018
and stamped NYSDEC approved on 11/1/2018.
19. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which maybe caused by or result flice

A copy of this permit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal, modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.

4. Submission of Renewal Application The permittee must submit a renewal 1east30
days before permit expiration for the following permit authorizations: Tidal Wetlands.
5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revoke this permit. The
grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;
d. newly discovered material information or a material change in environmental conditions,relevant
technology or applicable law or regulations since the issuance of the existing permit;

permittee's acts or omissions in connection with the permittee's undertaking of activities in connection
with, or operation and maintenance of,the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or
intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under
Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision
under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of
their responsibility to comply with this permit, including all special conditions while acting as the
permittee's agent with respect to the permitted activities, and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-
way that may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the
riparian rights of others in order to perform the permitted work nor does it authorize the impairment of
any rights, title, or interest in real or personal property held or vested in a person not a party to the

The following action was taken by the Board of Town Trustees
during its regular meeting held on October 25, 2000 regarding
the above matter:
WHEREAS, James E. Fitzgerald, Jr. on behalf of -DENNIS UDE
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated October 5, 2000, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 25, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

and 6'X 20' float secured by 4 piles with fixed stops to support

BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified

20' float secured to four pilings with fixed stops
to keep the float a minimum of 2.75 feet above the
substrate at mean low water. The purpose of this
project is to provide water access and a
recreational mooring facility for the applicant.

order to perform the permitted work nor does It authonze the Impairment of any nghts. title, or Interest In real or personal property held
or vested In a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to Inspection at reasonable nour~ and Intervals by an authonzed
representative of the Department of EnVIronmental Conservation (the Department) to determine whether the permittee IS complymg with
thiS permrt and the ECl SUCh representauve may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Oepar1Jnent's representative dunng an Inspection to the permit area when
requested by the Department
A copy of this permit, Including aU referenced maps, drawmgs and special conditions, must be available for Inspection by the
Department at aR times at the project site or facility. Fadure to produce a copy of the permit upon request by a Department representative
IS a violation of thIs permIt.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
!Jnless excressly orovlded for by the Department, Issuance of this permit does not modify, supersede or rescind any order or
determlnaton previously Issued by the Department or any of the terms, cr,naitions or reqUIrements contained in such a~der or
determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate wntten application to the Department for renewal, modlficaDon or transfer of this permit.
Such appllcanon must Include any forms or supplemental Information the Department reqUires Any renewal, modmcatlon or transfer
granted by the Department must be In wrrbng.
The permittee must submit a renewal application at least
a¡ 180 days before explranon of permrts for State Pollutant DIScharge Elimination System (SPDES), Hazardous Waste
Management FacllitJes (HWMFj, major Au Pollution Control ¡APC) and SOlid Waste Management FaCilities (SWMF);
and
b) 30 days before eXplracon of all other permrt types.

( TIDAL WETLANDS)
1. If future operanons by the State of New York require an alterabon in the posibon of the structure or work herein
authorized, or If. in the opinion of the Department of EnVIronmental Conservabon rt shall cause unreasonable
obstruction to the free navigabon of said waters or flood flows or endanger the health. safety or welfare of the people
of the State, or cause loss or destrucbon of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work. obstructions. or hazards caused thereby without expense to the
State, and if, upon the expirabon or revocabon of this permrt. the structure, fill. excavabon. or other modification of the
watercourse hereby authorized shall not be completed, the owners. shall. wrthout expense to the State, and to such
extent and in such bme and manner as the Department of Environmental Conservabon may require. remove all or
any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity
of the watercourse. No claim shall be made against the State of New York on account of any such removal or
alterabon.
2. The State of New York shall In no case be liable for any damage or Injury to the structure or work herein authorized
which may be caused by or result from future operabons undertaken by the State for the conservabon or improvement
of navigabon, or for other purposes. and no claim or right to compensabon shall accrue from any such damage.
3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission. consent
or approval from the U.S. Army Corps of Engineers. U.S. Coast Guard, New York State Office of General SefV1ces
or local government which may be required
4. All necessary precautions shall be taken to preclude contaminabon of any wetland or waterway by suspended solids,
sediments. fuels. solvents. lubricants, epoxy coabngs, paints. concrete. leachate or any other environmentally
deleterious materials associated with the project.
5. Any material dredged In the conduct of the work herein permitted shall be removed evenly. wrthout leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
6. There shall be no unreasonable interference with navigabon by the work herein authonzed.

7. If upon the expiration or revocabon of thIS permrt. the project hereby au1horized has not been completed. the applicant
shall, without expense to the State, and to such extent and in such bme and manner as the Department of
Environmental Conservabon may require. remove all or any portion of the uncompleted structure or fill and restore
the site to Its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
8. If granted under 6NYCRR Part 608. the NYS Department of Environmental Conservabon hereby certifies that the
subject project will not contravene effluent liml!abons or other limrtations or standards under Sections 301, 302, 303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met

portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit Wrthln 30 days of complebon of project. the bottom portion of the form must also be

10. All activlnes authorized by this permrt must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permrt applicabon.

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and/or
protected buffer areas.
2. Dock or timber catwalk shall not exceed four (4) feet in width and shall be a minimum of 3-1/2 feet above grade" over
tidal wetland areas ("as measured from ground to bottom of dock sheathing).
3. The use of wood treated with pentachlorophenol in the construction of structures that will be in contact with tidal
waters is strictly prohibited.
4. All repairs to existing structures shall be confined to replacement of existing elements with no change in design.
dimension, or materials. unless specifically authorized herein.
5. No dredging, excavating or other alteration of shoreline or underwater areas is authorized by this permrt. nor shall
issuance of this permrt be construed to suggest that the Department will issue a permrt for such activities in the future.
6. No permanent structures may be installed on dock/catwalk without first obtaining written department approval (permrt,
modification or amendment).
7. Docks/catwalks may not (a) extend laterally beyond property lines, (b) be placed so that docked boats extend over
adjacent property lines, (c) interfere with navigation, (d) interfere with other landowners riparian rights.
8. No ramp or float is authorized with this structure. nor shall rt be construed that the Department will issue a permrt for
such structures in the future.
