Dear Mr. Hemnann::
The following action as taken by the Board of Town Trustees during a Regular Meeting, held on
May 22, 2002, regarding the above matter.
WHEREAS, En-Consultants, Inc. on behalf of Vincent Henic applied to the Southold Town
Trustees for a pennit under the provisions ofthe Wetland Ordinance of the Town of Southold,
application dated March 27,2002
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
May 22, 2002 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.

WHEREAS, the Board has detennined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of Vincent Renic for a
Wetland Pennit to construct 4'x20' wood steps including 4'x4' platfonn and 4'x22' wood
walkway elevated a minimum of3.5' above marsh grade down bank to existing dock - construct
+/-100 linear foot timberretaining wall (plus 18' westerly and 8' easterly returns) along top of
bank - remove remaining portion of existing block and wood retaining wall along top of bank _
backfill with approximately 25 cubic yards of clean sand to be trucked in ITom an upland source
and planted with native grasses - construct (2) story additions existing two story dwelling and
expand existing second story wood deck. The northerly portion of the return will be constructed
at an angle to face the retain wall as depicted on the plan dated 6-5-02
BE IT FURTHER RESOLVED that this detennination should not be considered a detennination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and pennit issued within six months of the date of this
notification.
Ifinspections are required, at a fee of$5.00 per inspection (See attached schedule).

Dear Mr_ Krupski:
As discussed during the May 22nd public hearing on the captioned permit application, please fmd
enclosed (3) copies ofa revised project plan, which depicts the westerly terminus of the retaining
wall positioned an additional two feet east of the westerly property line. The purpose of this
minor modification is to provide additional separation between the retaining wall and the black
locust tree located adjacent to and west of the westerly property line. Consequently, the total
length of the face of the retaining wall will be reduced fÌom 102 to 100 linear feet; the length of
the westerly return will be increased fÌom 17 to 18 linear feet; and the northerly portion of the
return will be constructed at an angle to the face of the retaining wall, as depicted on the plan.

This letter is to notify you that the Locust Tree on the West comer of 1295 Pine Neck
Road will be damaged when the Timber Retaining Wall of 1375 Pine Neck Road is
installed. As per the letter sent to The Board Of Trustees on May 22 2002.My Certified
Tree Arborist has stated that half of the root system will be damaged when the wall is
constructed. This will certainly cause great damage to my tree and land. You will be held
personally responsible for any and all damage that will a cure.

Waterways Law on night navigation states: Any and all
free standing pilings used in United States Waterways
for the purpose of mooring must use an exterior lighting
fixture with a 50 volt marine approved safety lens.Also

position from sunset to sunrise or as weather conditions
warent.

Dear Trustees:
I am writin9 on behalf of the application made for the construction of a new retaining wall abutting the bank at 1375
Pine Neck Road. I have examined the plans prepared by En-Consultants Inc. and visited the site to detenTline the
contractibility of the proposed retaining wall. Wrth many years of similar building experience, in environmentally
sensitive areas, I find the construction to be feasible without any major impact on the embankment. In fact, once
constructed the wall will prevent soil erosion that currently exists.
In reference to the tree located along the \I\o'esterly property line, all work will be hand excavated in that area and any
vertical pilings will be placed so as not to interfere with any major root system. This type of construction is doable
and common in areas where environmental sensitivity is required.
I hope this letter addresses all of your concerns.

unknown construction related questions. I have listed my many questions below:

4: Will it be painted to blend in with the natural grass?
5: What damage will this Timber Wall cause to the tree that is on my property?

7: Who will be responsible for the Timber Wall that is near my property line?
I will also ask Vincent Benic to have a complate plan of this Timber Wall project showing
What will ~ look like when the project is complete sent to my homa. I was sent a POOR copy of a Land
survey, which shows very little on this project.
I have enclosed photos of the land to show the tree and area in question.
