Dear Ms. Brunjes:
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on July 19, 2000, regarding the
above matter.
WHEREAS, BARBARA BRUNJES, applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated June 28, 2000, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on July 19, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved application of
BARBARA BRUNJES to repair existing bulkhead, remove existing 14
l.f. bulkhead return and 14 l.f. of retaining wall and
reconstruct with timber bulkhead, with the condition of 8'
non-turf buffer behind the new construct.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete proiect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Ms. Brunjes:
On August 7, 2000, the New York District Corps of Engineers
received a request for Department of the Army authorization to
replace, in-kind and in-place, approximately 70 linear feet of
timber bulkhead along with IS-feet of bulkhead return with
approximately 20 cubic yards of clean fill used as backfill. The
site is in Petty's Pond, Southold Bay at the Town of Southold,
Suffolk County, New York.
Based on the information submitted to this office, our
review of the project indicates that an individual permit is not
required. It appears that the activities within the jurisdiction
of this office could be accomplished under Department of the Army
Nationwide General Permit Number 3. Nationwide Permits are
prescribed in the January 15, 2002 Federal Register, Final Notice
of Issuance, Reissuance, and Modification of Nationwide Permits
(67 FR 2020). The work may be performed without further
authorization from this office provided the activity complies
with the permit conditions listed in Section B, No.3, Section C,
the following soecial condition and any applicable regional
conditions, copies enclosed.
Special Condition
(A) The permittee understandB and agrees that, if future
operations by the United States require the removal, relocation,
or other alteration, of the structure or work herein authorized.
or if, in the opinion of the Secretary of the Army or his
authorized representative, said structure or work shall cause
unreasonable obstruction to the free navigation of the navigable
waters, the permittee will be required, upon due notice from the
Corps of Engineers, to remove, relocate, or alter the structural
work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States
on account of any such removal or alteration.
"
This determination covers only the work described in the
submitted material. Any major changes in the project may require
additional authorizations from the New York District.
Care should be taken so that construction materials,
including debris, do not enter any waterway to become drift or
pollution hazards. You are to contact the appropriate state and
local government officials to ensure that the subject work is
performed in compliance with their requirements.
This verification is valid for a period of two years from
the date of this letter, unless the nationwide permit is
modified, suspended or revoked. This verification will remain
valid for two years from the date of this letter if the activity
complies with the terms of any subsequent modifications of the
nationwide permit authorization. If the nationwide permits are
suspended, revoked, or modified in such a way that the activity
would no longer comply with the terms and conditions of a
nationwide permit, and the proposed activity has commenced, or is
under contract to commence, the permittee shall have 12 months
from the date of such action to complete the activity.
Within 30 days of the completion of the activity authorized
by this permit and any mitigation required by this permit, you
are to sign and submit the attached compliance certification form
to this office.

We propose to replace your existing bulkhead return and retaining wall with a new bulkhead as follows:
We will remove the existing bulkhead return at the North end of the main bulkhead and the adjacent retaining wall. We will
reconstruct these walls in accordance with the following specifications -
· 9" x 12' CCA pilings. 7' on center (pile on corner with main bulkhead to be 9"x 16')
· 6"x 6" CCA top & bottom stringer.
· 2" x lO"x I 0' tongue & groove creosote sheathing
· Existing tierods on bulkhead return to be replaced.
· New 6' backing piles with 3/4"x 10' tierods to be installed where present wall is located.
· New 2"x 8" CCA cap plans to be placed on top of entire bulkhead r:--..-- --
