Dear Mr. Chakraborti,
The Commissioners of the Southold Park District have asked me to write to you regarding a concern
that they have with the drainage system for NYS Route 25 road runoff in Southold which is located at
the end of Mechanic Street where it meets Youngs Ave.
This drainage system has a pipe that empties the road runoff directly into the west end of Town Creek
where the Southold Park District maintains a park and a marina.
Early in 2003 we spent $34,600.00 of tax payer money to have the marina area dredged and it has
already begun to fill in with the runoff from your drainage system.
Since this was a major expense for the residents in our municipality and we certainly don't want to have
to do this again anytime soon we would like to recommend that New YorK State possibly install the
same drainage system that has worked so well on Hobart Road Southold at the north end of Town
Creek or look to make an improvement to the current system that will not dump road runoff into an
already environmentally sensitive creek.
Please advise us immediately as to your thoughts on this important matter.

DESCRIPTION OF AUTHORIZED ACTIVITY:
Remove and replace 235 linear feet of bulkhead in place. Dredge to 3.5' below mean low water no greater
than 45' off shore of the replacement bulkhead with resultant 900 cu. yds. of dredged material to be dried
on-site -and then trucked to an appropriate upland location. All work must be done in accordance with the
attached plans prepared by Robert H. Fox last revised September 11, 2002 and stamped approved by
NYSDEC on November 5, 2002.
By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL. all
applicable regulations, the General Conditions specified (see page 2 & 3) and any Special Conditions included as part
of this permit.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation of the
State of New York, its representatives, employees, and agents ("DEC") for all claims, suits, actions, and damages, to the
extent attributable to the permittee's acts or omissions in connection with the permittee's undertaking of activities In
connection with, or operation and maintenance of, the facility or facilities authorized by the permit whether in compliance
or not in compliance with the terms and conditions of the permit. This indemnification does not extend to any claims,
suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any
claims, suits, or actions naming the DEC and arising under article 78 of the New York Civil Practice laws and Rules or
any citizen suit or civil rights provision under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect
to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental
Conservation law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may
be required to carry out the activities that are authorized by this permit. .
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights
of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real
or personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by
an authorized representative of the Department of Environmental Conservation (the Department) to determine whether
the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant
to ECl 71-0301 and SAP A 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the permit
area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection
by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a
Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any
order or determination previously issued by the Department or any of the terms, conditions or requirements contained
in such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer ofthis
permit. Such application must include any forms or supplemental information the Department requires. Any renewal,
modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at ieast:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous
Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management
Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:

General Condition 4: Þennit Modifications, Suspensions and Revocations by the Department
The Department reserves the right to modify, suspend or revoke this permit in accordance with 6 NYCRR Part 621. The grounds
for modification, suspension or revocation include:
a) materially false or inaccurate statements in the permit application or supporting papers;
b) failure by the permittee to comply with any terms or conditions of the permit:
c) exceeding the scope of the project as described in the permit application;
d) newly discovered material information or a material change in environmental conditions, relevant technology or applicable
law or regulations since the issuance of the existing permit;
e) noncompliance with previously issued permit conditions, orders of the commissioner, any provisions of the Environmental
Conservation Law or regulations of the Department related to the permitted activity.

ADDITIONAL GENERAL CONDITIONS FOR ARTICLES 15 (TITLE 5), 24, 25, 34 AND 6NYCRR PART 608
( TIDAL WETLANDS)
1. If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the
people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered
by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense
to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to
the State, and to such extent and in such time and manner as the Department of Environmental Conservation may
require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the
navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on
account of any such removal or alteration.
2. The State of New York shall in no case be liable for any damage or injury to the' structure or work herein
authorized which may be caused by or result from future operations undertaken by the State for the conservation
or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any
such damage.
3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission,
consent or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General
Services or local government which may be required.
4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended
solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other
environmentally deleterious materials associated with the project.
5. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
6. There shall be no unreasonable interference with navigation by the work herein authorized.
7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and
restore the site to its former condition. No claim shall be made against the State of New York on account of any
such removal or alteration.

8. If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302,
303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are
met.
9. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
2. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted
activity .
3. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion
or prior to permit expiration, whichever comes first. The approved methodologies are as follows:
a. stabilized as per specifications identified on approved plans.
4. The storage of construction equipment and materials shall be confined to within the existing parking area.
5. Prior to any construction or removal of bulkheads and other shoreline stabilization structures all backfill shall be
excavated landward of the bulkhead and retained so as not to enter the waterway, tidal wetland or protected buffer
area.
6. There shall be no discharge of runoff or other effluent over or through any bulkhead or shoreline stabilization
structure or into any tidal wetland or adjacent area.
7. Bulkhead constructed directly adjacent to vegetated tidal wetlands shall be jetted in with no disturbance to the tidal
wetland. Trenching is strictly prohibited.
8. The use of wood treated with pentachlorohenol in the construction of structures that will be in contact with tidal
waters is strictly prohibited.
9. Dock reconstruction or replacement or seasonal installation shall not involve expansion or substantial modification
of existing structures or facilities.
10. All repairs to existing structures shall be confined to replacement of existing elements with no change in design,
dimension, or materials, unless specifically authorized herein.
11. All dredged material shall be disposed on an approved upland site and be retained so as to not re-enter any water
body, tidal wetland or protected buffer area.
12. During the dredging operation, the permittee and his contractor shall prevent spillage of sediment during
excava,tion and haulage. Dredging shall be accomplished with a clam shell or other closed "bucket" equipment.
13. Dredging is prohibited from June 1 - September 30 of each year to protect spawning shellfish and/or spawning
finfish.
14. A filter fabric curtain weighted across the bottom and suspended on floats shall be positioned to enclose the work
site before commencing dredging. The curtain shall remain in place and functional during all phases of the dredging
operations and remain in place for two hours after dredging termination.
15. Within 30 days of completion of dredging operation, a dredged depth survey of the dredged area shall be
submitted to the Region 1 Bureau of Marine Habitat Protection, SUNY Building 40, Stony Brook, NY 11790-2356.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 24, 2002 regarding the above matter:
WHEREAS, Catherine Mesiano on behalfofSOUTHOLD PARK DISTRICT applied to the
Southold Town Trustees for a pennit under the provisions of Chapter 97 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated January 31, 2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
April 24, 2002, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOL VED, that the Board of Trustees approve the application of SOUTH OLD PARK
DISTRICT for the in-place replacement 235' of existing functional deteriorated concrete
bulkhead in the following manner:
South Wall- 120 1.f. - Installation of 10"X 20' CCA piles 6' on center, 6"X 6" CCA top and
bottom wales faces with 16' long C-Loc Vinyl Sheathing, 3/4" X 14' tie rods, and 8"X 8' CCA
backing piles with laylog.
East Wall- 115 I.f. - Installation of 10"X 16' CCA piles 6' on center, 6"X 6" CCA top and
bottom wales faced with 14' C-Loc Vinyl Sheathing, %"X 14' tie rods and 8"X 8' CCA backing
piles with laylog.
Maintenance dredging of slips and adjacent area for access. Dredging to extend to approx. 40'-
45' from face of existing bulkhead to approx. -3.5' ML W. Spoil site located at NE comer of site,
containment with silt fence and staked haybales. Dredging to be perfonned by crane barge and
land crane with clamshell buckets. All dredge spoil, approx. 1000 cy. to be removed to an
upland site.
Open fixed dock on south and east sides +/-130'. Replace stringers using 6"X 6" and 4"X 6"
CCA and 8"X 12' inside piling. Replace inside piling using 8" X 12' CCA. Replace 2" decking
as necessary.
A 10' non-turf buffer to be installed landward of the new bulkhead.
BE IT FURTHER RESOLVED that this detennination should not be considered a detennination
made for any other Department or Agency, which may also have an application pending for the
same or similar proj ect.
Pennit to construct and complete project will expire two years from the date the penn it is signed.
Fees must be paid, if applicable, and pennit issued within six months of the date of this
notification.
Inspections are required at a fee of$5.00 per inspection. (See attached schedule.)

17. Crowley Marine Construction on behalf of SEAN FAHEY requests a Wetland
Permit to install a 3'X 16' ramp, 6'X 20' float with two 2-pile dolphins to secure
float on existing 4'X 70' seasonal dock. Located: 1415 North Parish Dr.,
Southold. SCTM#71-1-14
TRUSTEE DICKERSON: Is there anyone who would like to comment on this
application?
TRUSTEE KRUPSKI: This is the seasonal dock application with the extension
to the dock, on the bay.
TRUSTEE DICKERSON: I'll read the CAC comments, They recommended
Approval with a Condition. I don't know what the condition is though.
TRUSTEE KRUPSKI: We don't have a CAC representative here.
TRUSTEE POLIWODA: I don't think we should be expanding our bay front
dockage especially for a ramp and float since it's unreasonable to dock a boat
in the bay on a ramp and float, especially with an east wind in that position.
There aren't many docks, if any docks, in that area. The reason that it was
given a permit was I guess trial and we found it to be an error.
TRUSTEE KRUPSKI: The applicant already has a dock.
TRUSTEE POLIWODA: Right.

TRUSTEE KRUPSKI: Is there anyone who would like to speak in favor of the
application?
CATHERINE MESIANO: I'm here on behalf of the applicant. As you probably
recall, we met at the site last Wednesday with representatives of the DEC and
we reviewed the park districts initial request which goes to reface the existing
bulkhead, which was found to be in a deteriorated state, and it was the
consensus of the two agencies that the proposed method was not acceptable
to either agency. After consideration and discussion with the applicants, the
applicants are now putting forth a request to replace, in-place replacement of
the 235' of existing functional but deteriorating concrete bulkhead. I've given
Lauren a copy of the proposed activity with the revised description which if you
would like I will read it into the minutes. The south wall of the bulkhead is 120
linear ft, We proposed removal of the existing concrete bulkhead and
replacing that in-place with an installation of 1 O'X 20' CCA piles 6" on center.
6'X 6" CCA top and bottom wales spaced with 16' long C-Loc vinyl sheating,
W' by 14' tie-rods and 8'X 8' CCA backing piles with laylog. The east wall
comprised of 115 I.f. we propose removing and replacing in-place, the
installation of 10'X 16" CCA piles 6' center, 6'X 6" CCA top and bottom wales
faced with 14' long C-Loc vinyl sheathing, %" by 14' tie rods and 8'X 8" CCA
backing piles with laylog. The open fixed dock on the east and south side is
approx. 130' and we propose to replace the stringers using 6'X 6" and 4'X6"
CCA and 8'X 12' inside piling, replace inside piling using 4" X 12' CCA and
replace 2" decking as necessary. Now we went on to discuss the extent of the
maintenance dredging that's proposed and we propose to dredge to an
approximate depth of 3 Y:,' at mean low water. The area to be dredged would
be approximately 45' seaward of the south-facing wall of the bulkhead and
approximately 40' seaward of the east-facing wall of the bulkhead. We
anticipate that it's approximately 1,000 cy. of dredge spoil. which will be
contained on site. The northeast spoil site is proposed in the northeast corner
of the property contained with silt fence and staked hay bales. The dredging
will be performed by crane barge and clamshell buckets. The excess dredge
spoil will be trucked to an upland site after it's had a chance to drain first. Are
there any questions? I didn't provide you with a sketch because I'll have it
drawn to the specifications that we end up agreeing on to depict basically what
we talked about. Does this accurately reflect your understanding of what we
discussed at the site?

CATHERINE MESIANO: I'm here on behalf of the applicants. We have an
existing structure with a deck off of the south side and a small porch off of the
easterly side. We are proposing to enclose the existing deck that's off of the
existing southeasterly side and the existing deck off of the back of, the
seaward side of the house, we propose to remove and replace with a covered
porch across the back of the house. We are hoping that the existing setback
except at the southerly corner of the area where the deck will be replaced, and
we're looking to add just two feet onto that portion of the porch, so we'll be at
the minimum 40' from the existing bulkhead to the new covered porch and
deck. Other than that, we are keeping all of the footprints and setbacks that
presently exist. The only excavation proposed would be whatever posts are
required for the porch. There is no foundation being excavated, If there are not
already drywells on the site, then they will be installed.
TRUSTEE KRUPSKI: Is there any other comment? I think the only comment
the Board had was that the pipe through the bulkhead had to be removed.
CATHERINE MESIANO: That's right. We discussed that.
TRUSTEE KRUPSKI: We also need additional drywells for the house, and

disturbance buffer, which has not been shown on the survey yet until we are
certain that there are no other changes that have to be made.
TRUSTEE KRUPSKI: I think the Board feels that's critical to the project that
the house be relocated with a 50' non-disturbance and that you're going to
have to show us the house placement and the septic system on the survey,
and have it staked in the field, and drywells and gutters for the house. For our
inspection in May, we're going to need the proposed mooring pile staked and
the end of the dock staked.

Maintenance dredaina of slips and adiacent area to -4' M.L.W. for access.
Dredging to be performed by crane barge and land crane with clamshell buckets.
All dredge spoil to be removed to an upland site.
