We are not sure what type of planting will be placed on our property so we are not prepared to submit a plan. We may plant trees; we may go with grassland. We feel if this is an issue with the Town of Southold Trustees then it should have been addressed 5 or so years ago when the pond was installed. The former owner of the property Mr. Lewis L. Edson who was legally allowed to place a road through wetlands should have been held liable for any planting necessary that pertains to this pond. Our intent at this time is to place bales of hay along the southern portion of our property and regardless if our garage is granted or not we will place plants of our own choosing. As you may be aware, this bas been an ongoing process to obtain permits, which will enable me to proceed in restore my house back to its fonner condition. I've supplied your department with tloor plans and with 4 surveys of the property showing the intent to add a garage and a small 20x20 extension on to house. I hope to be present at the walk-through by your department on Wednesday, Feb. 13th. I will call on the 12th to confinn the time that the board members will be seeing my property. The property bas been staked and the notice of amendment bas been placed in ftont of the house. The olÙY difference in the actual layout of this project is that I do not wish to remove the tree (which is beyond the 25' limit) where the garage would be situated. Therefore I took it upon myself to stake 15' away ftom back of property instead of 10', which is indicated on the survey approved by the DEC. However jfthis small adjustment that I have taken upon myself to proceed with is not appropriate because it is a slight change origina1ly approved by the DEC, then I will remove the tree and place the garage 10' as so indicated. I don't wish to create further delay on the premises. As I'm sure you're aware, the Dec stated that the pond is not within their jurisdiction. It does not fall under their wetlands act. The house is over 150' away ftom the tidal wetlands. I would like to state again for the record that I did not fill in at the southern part of my property along the pond and that it remains at its original elevation. As I stated to the DEC all I did fill in was the north section of the property and raise the house. I have made this known to the board of trustees on other occasions. The vegetation at the east ends is still at its 4' height and bas not been disturbed. . . I would like this matter to move along as quickly as possible especially since new guidelines will be set to take place soon. I can still get in under the deadline as long as no further delays are forthwith coming from your department. I have had numerous calls and requests for information regarding the procedures that have taken place during the past 16 months. I have chosen not to speak about it. As you will see I have staked out my property, and you will notice that the pond is at its south end. The pond, which was placed there a little more than 5 years ago by the town of Southold, is I'm sure beneficial for the entire downtown community of Southold. However I don't feel that I should be held back from my original request or for the added extension and garage already approved by the DEe because of it. As you can imagine this has been very costly for me I am paying the taxes on my property and also additional rents where I am living now until I can move into my own home. I would like this process to be expedited and would not appreciate any other agencies to get involved since my level of tolerance has surpassed and I have kept my feelings confidential. We plan on making the place look as nice as it can be. We don't intend to fill in by the garage area although it is on a slight tilt. The plan is just to put a wall at the bottom of the footings. I hope this meets with your and the building department's approval. I have not placed the bales of hay as I was hoping to use them for my foundation and naturally around the garage foundation to stop run-off. Although they would have been beneficial at the back of my property where the pond has been flowing into the living room of this house since its installment. When we purchased the house last July, it already had all utilities turned on. We recently went in and did some renovations by tearing out existing walls to bring the structure up to code. The house originally had a bathroom on the south side of the house, which is no longer there. The bathroom was evident by sewer lines and hot and cold water running into what was left of the extension. The sewer system was intact however it included only one ring. [ felt it necessary to install additional 4 rings because of the elevation to sea level. However [ recently have come to understand that there is 100' limitation to any bodies of water. In order to comply with the Board of Health, it will be necessary to obtain a letter from your deparbnent. According to DEC their boundaries are over 300' from the south section of my property and from what [ understand have no jurisdiction over the pond. We did not install a septic in back of the house because Miss Joan Beoken' s (our neighbor to the north) septic is very close there, We were told that a future garage must be in back of house and we felt it easier to add to existing unit. So we left the septic system where it lies today [ understand after the bathroom was removed, the Town decided to install a catch basin for street water. This in effect brought my property in violation of the [00' setback. Considering that the house was there and the utilities were never turned off and [ know that the Town has no intent on eliminating the pond, which my family and I rather enjoy to begin with as a benefit to the property. [wish that this matter could come to a compromise where no further action need be taken. I understand that this is the only setback that I would encounter due to the fact that it is an existing structure and that the Board of Health does makes allowances for such. In closing, our house and our presence there would be an asset to the "pond" . We would take care of the pond by cleaning any debris around and in it such as tree branches, metals, etc. We intend on landscaping the property to enhance its appearance to the neighborhood. We get along well with our neighbors and they are very happy that the "eye sore" is fmally being looked after. Providing notice of public hearings. Whenever the Code calls for a public hearing, this section shall apply. Upon determining that an application is complete, the board or commission reviewing the same shall fix a time and place for a public hearing thereon. The board or commission reviewing an application shall provide for the giving of notice: A. By causing a notice giving the time, date, place and nature of the hearing to be published in the official newspaper within the period prescribed by law. . B. By requiring the applicant to erect the sign provided by the town, which shall be prominently displayed on the premises facing each public or private street which the property involved in the application abuts, giving notice of the application, the nature of the approval sought thereby and the time and place of the public hearing thereon. The sign shall be set back not more. than ten (10) feet from the property line. The sign shall be displayed for a period of not less than seven (7) days immediately preceding the date of the public hearing.
