Box 870 Southold, NY 11971 RE: 590 TARPON DR., SOUTHOLD SCTM#57-1-6 Dear Mr. Wilson: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wed., May 18, 2011: WHEREAS, MICHAEL WILSON applied to the Southold Town Trustees for an Amendment to Wetland Permit#5438 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 13, 2010, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to Wetland Permit#5438 to replace the 4'X 20' dock with a 4'X 30' dock located a minimum of 15' from the boundary line and add a 4'fiberglass open-grate walkway along the bulkhead, as depicted on the site plan prepared by Robert H. The attached 2003 NYSDEC stamped vegetation plan included two species of plants that are native, but invasive to his property and offensive to his neighbors. Since the installation, the Town of Southold Trustees have required no pruning or fertilization within the buffer. Over time non-native invasive plant ( Russian olive-eleagnus species) species have moved in along with the ticks and local deer herd. This has caused concern for Mr. Wilson for the health of his family, neighbors and visitors with the tick population; in addition to the ability not to see down to the canal for safety concerns of grandchildren and non- swimmers. Mr. Wilson had petitioned Scott Hughes of the Town's Environmental Department in October 29, 2009 to transplant selected taller plants to both north and south areas and replace with native lower growing plants. The board requested design changes to the vegetative buffer if the proposed activity meets the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code, when a plan is submitted for review and comment. Based on the Town of Southold's willingness to acknowledge a change in vegetation types/species, we are requesting at this time that the Trustees review/comment on the attached plan for transplanting/relocation and re-vegetation with lower growing species in the non-turf buffer zone. The map showed two proposed canals leading to Peconic (Southold) Bay. By 1973 one canal was partially completed and both sides bulkheaded. Gentile Bureau of Habitat - TW File REQUEST FOR LANDSCAPE BUFFER REVISIONS: Mr. Wilson is requesting the opportunity to re-plant the Town of Soufhold's 36 foot vegetative buffer with native species which are less aggressive, grow to a lesser height and still meet the requirements of a non-disturbance and non-fertilizer buffer. The Clethra almifolia anhd Baccharis halimifolia will be rescued from the buffer area and transplanted into the two Native Special Relocation Beds, as shown on the attached plan. These areas are now approximately 1,400 square feet of the total 4,00 square feet, of which 770 square feet are in Native Species Restoration Bed #1, and 360 square feet are in Native Species Restoration Bed #2. In the western section of the vegetative buffer (2,165 square feet) there are four native planting beds vvith a toCat of 1,400 square of planiings;-insfolh~d four fed on center, for a total of approximately 83* plants. The species and the quantities are on the attached list and are planted from the lowest growing species to the larger species at the outermost edge of the beds. Though it is sufficient to be planted 18" on center, 12" on center is preferred. · The proposal to plant Blue Oat Grass is unacceptable since it is a non-native ornamental species. I suggest that Switch Grass (Panicum virgatum) instead be used. · Being a highly invasive species, it is recommended that all of the Russian Olive be removed. Additional Groundsel and Bayberry could be used to fill the voids. · Red Fescue is used by some as a turf-grass. If it is to be incorporated into this plan, I point out that it cannot be mowed or feed since it is in a non-disturbance and non-fertilization buffer. · As per the "DEC plan", Pepperbush (Clethera ainifolia) should not be planted about the retaining wall. En- permit and modifications the course of the construction Rambo required modifications to the permits. The construction of the bulkhead required disturbance into the upland. Rambo obtained such approval from the DEC but did not realize that due to the non-disturbance buffer the Trustee's permit should have also been modified. My client wishes to conform the Trustee's permit to the DEC permit. My client needs to have Plantings by the Sea start the restoration of the wetlands and upland plants right away in order to comply with the DEC conditions of their permit. However, the Trustees permit and the DEC permit do not conform.
