The dock must be elevated to a minimum height of3 1/2 ft. above grade in the area of the
vegetated tidal wetlands measured from grade to the underside of the decking.
A pemlit can be issued upon receipt and review of four copies of a revised plan and
crossvlew.
Pursuant to 6NYCRR621.15(b) this infomlation must be provided by 8113/2001. Failure
to provide this information by the date specified in this request may be grounds for denial of your
application.

Dear Ms. Lachenmeyer:
The Board of Town Trustees took the following action during its regular meeting held on
Thursday, June 21,2001 regarding the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of RICHARD & MARIA KICK
applied to the Southold Town Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of South old, application dated Ja;lUary 9,2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS. a Public Hearing was held by the Town Trustees with respect to said application on
June 21, 2001, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of RICHARD & MARIA
KICK to install a 3'X 25' fixed CCA timber dock secured by (12) 4"X 6" CCA timber dock
posts and elevated a minimum of 1 '+/- above grade. The facility is to be accessed by a 4'X 100'
natural wood chip pathway. Seaward end of the dock will be 10' northwest of southeast property
line. This permit is issued with the stipulation that no larger than a 16' vessel may be moored or
tied at this location.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years ITom the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upor: completion of said project.

The New York District, U.S. Army Corps of Engineers, has
received a request for Department of the Army authorization for
the following activity:
APPLICANTS:
Richard and Maria Kick
8 Wagner Avenue
Lake Grove, NY 11755
ACTIVITY:
Install an inclined 4 foot by 22 foot fixed timber
walkway, elevated a minimum of 4 feet above the
grade of intertidal wetland, a 4 foot by 10 foot
platform and two 8-inch diameter mooring piles.
The purpose of this project is to provide an
adequate mooring facility for the applicants'
vessel (s) .

unnamed Canal off Shelter Island Sound
LOCATION:
Town of Southold, Suffolk County, New York
As this is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawing is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicants
have certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state
coastal zone management program.
To allow for the timely processing of the subject
application, your comments are requested within 15 days of the
date of this letter.

As you know I represent the adjacent property owner,
Michael Wilson, with regard to the Kick application for
a dock. My client is the adjacent property owner who
will be most affected by the proposal. At the last
hearing I requested, on the record, that Mr. Bowman
provide me with a copy of the revised Kick proposal with
sufficient time to forward it to my client in Texas. In

WHEREAS, Land Use Ecological Services on behalf of RICHARD & MARIA KICK ap?lied L0
the Southold Town Trustees for a permit under the provisions of the Wetland Ord;¡;ance of the
Town of South old, application dated January 9,2001 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
February 21,2001 at which time all interested persons were given an opportunity to be heard,

WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,

CCA timber dock secured by (4) 6" dia. CCA timber piles and elevated a min. of 4'
above grade, a 3'X 18' ramp and 6'X 10' float secured by (2) 8" diameter piles. Dock
