Dear Ms. Cantara:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 18, 2004 regarding the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of JLH ASSOCIATES, LLC
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated May 4, 2004, and,
WHEREAS, said application was referred to the South old Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 18, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JLH ASSOCIATES,
LLC to construct a single-family dwelling with attached garage, open porch, pervious
driveway and sanitary system, with the condition drywells and gutters are installed to
contain the roof run-off, and all as depicted on the survey prepared by John T. Metzger
last dated September 7,2004.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
Fees: $100.00

At the meeting of the South old Town Conservation Advisory Council held Tuesday,
June 15, 2004, the following recommendation was made:
Moved by Don Wilder, seconded by Doris McGreevy, it was
RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH

Lot 27-Albacore Drive
Proiect Descripôon
Applicant proposes to construct a single family dwelling with attached garage, open
porch, pervious driveway and sanitary system. The dwelling will measure approximately
33' x 40.5', the attached garage will measure 35.5' x 21', and the open porch will be 15'
x 20'. The lot coverage for all impervious structures will be approximately 13.1% (2,588
square feet).
The sanitary system will be located as far from the wetlands as possible, with 5' setbacks
from the front and side property lines. It will be composed of 6 leaching pools and a
1,500 gallon septic tank. Please refer to the site plan for further detail.
A line of hay bales will demark the limits of clearing and ground disturbance.
Variance Reauest
Freshwater Wetlands Setback
The proposed structures will be located approximately 28' from the freshwater wetlands
on the site, requiring a variance of 72' from the 100' requirement. The reasons for
granting a variance are as follows:
1. The owner is subject to practical difficulty due to the size of the lot (limited
building area) and the proximity of the wetlands. A 100' setback from the
wetlands would be almost to Albacore Drive.
2. The applicant will install a line of hay bales to protect the wetland area during
construction (refer to site plan).
3. The freshwater wetlands on the lot are not regulated by the NYSDEC.
4. Similar variances have been granted on properties to the north of this lot.

Dear Mr.Hurtado:
The Board of Trustees took the following action during its regular meeting held on Wed.,
June 22, 2005 regarding the above matter:
WHEREAS, Land Use Ecological Service, Inc. on behalf of JLH Associates, applied to
the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance
of the Town of Southold, application dated May 4,2004, and
WHEREAS, said application was referred to the South old Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 18, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
W.HEREAS, the Board approved the application to construct a single-family dwelling
with attached garage, open porch, pervious driveway and sanitary system on August
18, 2004, and,
WHEREAS, a review of the above referenced permit, survey, and an inspection of the
property at the above referenced lot indicates inconsistencies and discrepancies in the

wetland line, as found in the field and as delineated by CW. Bowman of Land Use
Ecological Services, Inc., as submitted to this office as part of your application, and,
WHEREAS, pending the resolution of this issue,
NOW THEREFORE BE IT

the Trustees have fully reviewed the problem stated above.
BE IT FURTHER RESOLVED that this determination should not be considered a

Dear Mr. Hurtado:
The Trustees have reviewed your permit, survey, and inspected the property of the above
referenced lot and have found discrepancies in the wetland line in the field as compared
to what was submitted to this office on your survey, as delineated by C.W. Bowman of
Land Use Ecological Services, Inc.
As a result, these discrepancies will need to be resolved prior to the issuance of any
building permits.
In addition, the hay bale line, which was inspected on 2/11/05 by Ed Forrester, does not
comply with the regulations for the following reasons:
I. The location of the hay bales is not correct.
2. When a new hay bale line is erected in the correct location, it is required that the
haybales be staked.
3. There needs to be new flags placed to delineate the wetlands.
4. Place new stakes showing the location of the approved and permitted house as per
the approved survey.
Pending the resolution of these issues the Trustees intend to SUSPEND Trustee
Permit # 5981 until such time that the Trustees have fully reviewed the problems
stated above.

Lot 28, Albacore Drive - John Hurtado
Dear Mr. Krupski:
In order to clarify the wetlandslhaybale locations at the above referenced site, I have
pulled files on Lots 26, 27, and 28. I flagged the wetlands in this area in March of 2000.
I again flagged the Albacore Drive side of wetland limits within the area of Lots 26, 27,
and 28 in March of2004 and Lot 25 in February of2003. Please note during these times
the lots were being heavily marketing and several flaggings were completed by others as
well.
In any case, I have compiled the information that I have and included a copy of the Lot
27/28 surveys on which I have also overlapped the 2000 line. My field inspection on
6/16/05 indicates that the surveyor must have missed a flag on Lot 27 that would have
connected the line to Lot 26. I have highlighted this "connection" in yellow.
Also note that the "compilation" includes surveys by different surveyors and do not
match exactly.
