5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized. .
6. That there shaII be no interference with the right of the public to pass and repass a100g
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the. remova1 and/or alteratioas
in the locaúon of the wode: herein mthorized, or if, in the opinion of the. Board of Trustees, the.
work shaII cause unreasonable obsttuctlon to free navigation, the said Pe=ittee will be required,

Dear Mr. DeLucca:
The following action was taken by the Board of Town Trustees
during its regular meeting held on August 23, 2000 regarding the
above matter:
WHEREAS, James V. DeLucca, R.A. on behalf of ALFONSO ROMANO
applied to the Southold Town Trustees for a permit under the
pruvisions of the Wetland Ordinance of the Town of Southold,
application dated August 4, 2000, and
WHEREAS, said application was referred to the Southola Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on August 23, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
ALFONSO ROMANO to rebuild existing wood deck that has been
removed and add new wood piles for deck and stair area next to
and behind existing wood piles. Rebuilt dwelling on existing
piles and deck.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be nctified
upon completion of said project.

At the meeting of the Southold Town Conservation Advisory Council held Tuesday, August 15,
2000, the following recommendation was made:
Moved by Scott Hilary, seconded by Bob Ghosio, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the
Wetland Permit & Coastal Erosion Permit Application of ALFONSO ROMANO 58-2-2 to
rebuild existing wood deck that has been removed and add new wood piles for deck and stair
area next to and behind existing wood piles. Rebuild dwelling on existing piles and deck.

The CAC recommends Disapproval and that no action be taken until the violations are resolved,
There are concerns with the buried oil tank and the location of the cesspool.

Dear Mr Romano,
Based on the information you have submitted, the New York state
Department of Environmental Conservation has deterained that:
Construction of the proposed addition and front deck are located
above the 10' contour on a natural gradual slope as shown on the
survey by Joseph A Ingegno, last revision May 9, 1997.
Therefore, in accordance with the current Tidal Wetlands Land Use
Requlations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind _y take place seaward of
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlandll jurisdiction which may rellult from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale ber..
Please be further advised that this letter does not relieve you of
the responsibility of obtaininq any necessary permits or approvals
from other agencies.

/
(1) The grant of alternative relief will not produce an undesirable
change In character of neighborhood or a detriment to nearby
properties because there are houses of similar size within the
immediate vicinity.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because to achieve additional floor area, the applicant would have to
disturb the area under the existing building which is closer to the v-a
Flood Zone.
(3) The requested area variance is substantial exceeding 5.43 percent
of the maximum 20% allowable lot coverage.
(4) The grant of alternative relief will not have an adverse effect or
Impact on the physical or environmental conditions In the
neighborhood or district because the construction will be built in an
area that Is landward of the existing structure.
(5) The situation has been self-created because the applicant has an
existing house and could add a second floor without the need of a
variance.
In considering this application, the Board deems this action to be the
minimum necessary and adequate, and at the same time preserves and
protects the character of the neighborhood, and the health, safety,
welfare of the community.
RESOLUTION/ACTION: On motion by Member Dinizlo, seconded by
Member Collins, It was
RESOLVED, to DENY the 25.4% requested, and to GRANT
ALTERNATIVE RELIEF for a total lot coverage of 23.5% (or 2,094 sq. ft.
whichever Is greater).

Dear Mr Romano,
Based on the information you have submitted, the New York state
Department of Environmental Conservation has determined that:
Construction of the proposed addition and tront deck are located
above the 10' contour on a natural gradual slope as shown on the
survsy by Joseph A Ingegno, last revision May 9, 1997.
Theretore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance ot any kind may take place seaward ot
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the qround surtace or veqetation
within Tidal Wetlands jurisdiction which may result trom your
I ~ proj ect. Such precautions may include maintaininq adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erectinq a
temporary tence, barrier, or hay bale berm.
Please be turther advised that this letter does not relieve you of
the responsibility of obtaining any necessary permits or approvals
from other agencies.

Southold Town Board of Appeals
(1) The grant of alternative relief will not produce an undesirable
change In character of neighborhood or a detriment to nearby
properties because there are houses of similar size within the
. immediate vicinity.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because to achieve additional floor area, the applicant would have to
disturb the area under the existing building which Is closer to the V-8
Flood Zone.
(3) The requested area variance Is substantial exceeding 5.43 percent
of the maximum 20% allowable lot coverage.
(4) The grant of alternative relief will not have an adverse effect or
Impact on the physical or environmental conditions In the
neighborhood or disb'Ïct because the construction w, be built in an
area that Is landward of the existing structure.
(5) The situation has been self-created because the applicant has an
existing house and could add a second floor without the need of a
variance.
In considering this application, the Board deems this action to be the
minimum necessary and adequate, and at the same time preserves and
protects the character of the neighborhood, and the health, safety,
welfare of the community.
RESOLUTION/ACTION: On motion by Member Dinizlo, seconded by
Member Collins, It was
RESOLVED, to DENY the 25.4% requested, and to GRANT
ALTERNATIVE RELIEF for a total lot coverage of 23.5% (or 2,094 sq. ft.
whichever is greater).
