The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.

The applicant does by the acceptance of this permit, assume all responsibility for operations under.
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance. the applicant also agrees to indemni.
fy and save harmless the Town, and its officers. agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con.
ducted in conformity with this permit.
This operation will not sUbstantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege.
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Your recent request to extend the above referenced permit has been
reviewed by the Trustees at their meeting held on July 31, 1986.
Your request has been approved by resolution, adopted at this
meeting for a period of six months. This permit will expire on
January 31, 1987.
This letter is an amendment to the original permit and as such
shall be attached thereto.
All other terms and conditions remain written in the original
permit.

The following action was taken by the Board of Southold Town
Trustees at a regular meeting held August 3, 1982:
RESOLVED to recommend to the Southold Town Board approval of the
wetland application #101 of Friedrich Krug to construct a 58 ft.
timber bulkhead connected to and in line with adjacent existing
bulkheads and to maintenance dredge an area of 58 ft x 15 ft in
front of proposed bulkhead to 4 ft below MLW in made man canal
off Budd's Pond, Southold.

Due to a long delay in securing the U.S. Arn¡y Corps of
Engineers perm1t, the work was never undertaken.
The Corps perm1 t has finally been secured ani Mr. Krug
1s prepared to undertake the project. Therefore, would you
kirnJy extern the perm1 t referenced above so that this may
be done.

INSTRUCTIONS FOR PERMIT
A. This opplicotion is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicote, occomponied by writter permis>ion from the owner of the property if not
the some as the applicont,
B. Pilot Plan must be drown to scale on the reverse .ide of this application showing the locotion
of property, the names and locotions of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a capy machine and attached
ta the Permit Application.)
C. No operation sholl be initioted by the applicant until all permits that ore required ore issued.
D. A detoiled statement of the rehabilitation and prLposed condition of the premises otter the
work i£ completed must be given, including a survey If required,
E. It permit is being sought for a more sizeable excavation than the construction of a privote
single dock or jetty, then this application must be accampanied by a survey and topogrophical map
certified by 0 registered land surveyor Professional Engineer. The horizontol contral of survey
shall be bosed upon an approval lacal coordinate system. The vertical control for elevation ond sound-
ings shall be based upon United States Coast and GeodetIc Survey and/or United Stotes Gealogical
Survey datum.
F. A statement must accompany the opplication describing any known prior operations conducted
on the premises in question ond whether any prior licenses or permits have been issued to erect
structures or to dredge ar deposit fill on said premises and whether any such permits or licenses
were ever revoked ar suspended by 0 governmental agency.
G. A filing fee af $25.00 shall accampony the application. ThIs filing fee includes one inspection
there is a $5.00 fee for each odditional inspectian.
H. The Town Board upon requestqQj_tJ¡e applicont f'ìr a permit, may waive in whole or in part,
the provisians of Article II, Sectian' ___~ubdivisions (,Ø) and. where it finds that noture of the
proposed ape rations ore such that the requirements of such provisions are not" necessary for 0
proper considerotion of 0 permit application.

The decision whether to issue a permit will be based on an evaluation
of the probable impact of the proposed activity on the public interest.
That decision will reflect the national concern for both protection and
utilization of important resources. The benefit which reasonably may be
expected to accrue from the proposed work must be balanced against its
reasonably foreseeable detriments. All factors which may be relevant to
the proposed work will be considered: among those are conservation, eco-
nomics, aestheti~s, general environmental concerns, historic values,
fish and wildlife values, flood damage prevention, land use, navigation,
recreation, water supply, water quality, energy needs, safety, food pro-
duction and, in general, the needs and welfare of the people.

Imp..,et Statement will not be prepared. A review of the latest publish-
ed version of the National Register of Historic Places and o[ the pre-
seflce or absence of registered properties or properties listed in .
the latest published version of the Register as being eligible for
inclusion, therein, has been made. Presently unknown archeological,
sci~nti[ic, prehistorical Or historical data may be lost or destroyed
hy work to be accomplished under the required permit.
The evaluation ~f the impact of the activity on the public interest
will include application o[ the guidelines promulgated by the Adminis-
trator, U.S. Environmental Protection Agency, under authority of Sec-
ti,'n 404(b) of the Federal Water Pollution Control Act or of the
criteria established under authority of Section 102(a) of the Marine
Protection, Research and Sanctuaries Act of 1972, as appropriate.
Any person may request, in writing, within the comment period specified
in this noti~e, that a public hearing be held to consider this appli-
cation. Requests [or public hearings shall state, with particularity,
the reasons. [or holding a public hearing.

will be obtained prior to the issuance of a Department of the Army
permit:
Appropriate approval from the New York State Department
of Enviornmental Conservation

30 December 1982 otherwise it will be presumed that there are no ob-
