NANOP-RE APPLICATION NO. 84-617-L2 PUBLIC NOTICE NO. 12409 OESCRIPTION OF WORK The appl icant, Leonard Lang, requests Department of the Army authorization to maintain a bulkhead with associated backfill, and a floating pier assembly and to perform dredging with 10 years maintenance in Budd's Pond, Shelter Island Sound at Southold, Suffolk County, New York, as shown on the attached drawings. Approximately 124 linear feet of timber bulkhead with a 10 foot return on the southern end has been constructed seaward of the 1 ine of mean high water. A pier assembly has also been constructed consisting of a 4 foot by 4 foot platform, a 3 foot by 14 foot ramp, and a 6 foot by 20 foot floating pier adjacent to the bulkhead. In addition, the applicant proposes to dredge a 99 foot by 15 foot area inmediately waterward of the completed bulkhead to a depth of 4 feet below the level of mean low water. Approximately 200 cubic yards of dredged material would be removed and used as backfill behind the completed bulkhead with any surplus to be placed on the upland property where it wi 11 be suitably retai ned to prevent its re-entry to the waterway. It is estimated that subsequent maintenance dredging would be necessary every to 3 to 4 years and that 100 cubic yards of dredged material would be removed each time and would be disposed of in the Town landfill. It should be noted that the completed work was done without prior Department of the Army authori zati on. The New York Di stri ct Corps of Engineers, having reviewed the matter, has declined at this time to initiate legal proceedings for the undertaking of the unauthorized work. The decision, whether or not to grant approval, will be based on an evaluation of the probable impact on the public interest of either allowing the work to remain as constructed, or requiring its modification or removal. Public comments in response to this notice should be directed toward these alternatives. The purpose of the completed bul khead is for erosion control. The purpose of the pier assembly is for private recreational mooring. The proposed dredging is to provide adequate depth for mooring. . .
