Dear Mr. Anderson:
The following action was taken by the Board of Town Trustees
during its regular meeting held on March 27, 1996 regarding the
above matter:
WHEREAS, Suffolk Environmental Consulting on behalf of ROBERT
AND BARBARA HOLLEY applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated February 14, 1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 27, 1996, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
construct a 8' X 22' addition and a 8' X 12' deck to existing
dwelling and maintain haybales and sediment barriers in the
northwest corner, as per survey dated December 6, 1995. Located
Bay shore Road, Arshamomoque.
and,
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.
FEES: None.

At the meeting of the Southold Town Conservation Advisory Council held March
25, 1996 the following recommendation was made:

Moved by Allan Connell, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH SUCCESTIONS of the Wetland Application of ROBERT E. AND BARBARA
c. HOLLEY 53-3-13 to construct an 8' x 22' addition and 8' x 12' deck.
The CAC recommends approval and suggests applicant maintain existing
hay bales and sediment barriers in the northwest corner.

Vote of Council: Ayes: All
Motion carried.

Enclosed herewith please find seven copies of a Trustee Wetlands Application and
survey along with a check made payable to the Town of South old in the amount of
$150.00 covering the requisite application fee.
You should be aware that our proposal for a small addition and deck is now
considered a Type 2 Action pursuant to the State Environmental Quality Review Act.
Accordingly, no inter-agency coordination is now required. Please inspect the property
and let me know when this matter will come before the Board for discussion

Desil!n Considerations
(I) Proposed deck to be no closer than 53 feet from the landward edge of tidal
wetlands whereas existing dwelling is located 30 feet trom landward edge
of tidal wetlands
(2) Existing lot coverage is 15.4% including existing driveway and proposed
lot coverage is 16,6% (also including existing driveway).
(3) Applicant created coastal high marsh vegetation landward of original
wetlands line and the setbacks stated above take into account created tidal
wetlands,

have been located over a turfed area and therefore, no destruc-
tion of a natural area will result from the project as proposed;
(4) the applicant has enhanced tidal wetlands values by the

successful despite their close proximity to the existing
dwelling.
