replanted per plan. Conditions landward of hay bale line pose danger to
protected area. Recommend hay bale line remain, storm water runoff threatens
protected area, remainder of lot not graded, no ground cover, no storm water
retention from downspouts or proposed paved area, entire property slopes to
protected area. Recommend not approving Building Department to release C.O.
until lot is improved with grading, ground cover and storm water retention plan.

Mr, Liso has shown a willingness to correct the clearing at the north side of the lot by:
1, New row of hay bales from the big rock on the north west comer, to the
tree, curving south into the existing hay bales line,
2, Woodchip the disturbed area,
3, Planting pepperbush, as suggested by Chris Pickerall, at his recommended
size and spacing,
The Board would suggest that as soon as items #1 & #2 are complied with, the work can
proceed on the house,
Item #3 will have to be complied with as soon as the plant material becomes available in
late March,
Obviously this Board recommends that no Certificate of Occupancy be issued untilltem
#3 is complete,

The subject area includes an approximately 85 ft x 18 ft (1,530 ft2) clearing along the
north side of the property in what was mostly Sweet Pepperbush (Clerhra alnifolia) and
one or more Oaks (Quercus sp,), At the time of the latest visit (Friday. April 19, 2002)
the southern and eastern bow1daries of the clearing were lined with hay bales, Based on
my original discussions with Albert J. Krupski it was decided that the most appropriate
actions to correct the clearing would involve planting Sweet Pepperbush. With this in
mind and given the current availability of plant material, 1 recommend the fOllowing
actions;

Plant at total of 42 Sweet Pepperbush (2 gallon pots @ 24>30") at 6 ft on center
(OC) spacing throughout the cleared area.
The relali\'ely close spacing and small size oflhe plants were chosen to increase the
chances for establishment and long-tenn survival. The planting layout is not critical, but
[ would recommend a series of staggered rows resulting in the 6 ft OC spacing
throughout,

Dear Mr, Fitzgerald:
The following action was taken by the Board of Town Trustees
during its regular meeting held on February 24, 2000 regarding
the above matter:
WHEREAS, Proper-T Permit Services on behalf of WILLIAM MANOS
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated February 4, 2000, and,
WHEREAS, said application was referred to the Southcld Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 24, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
WILLIAM MANOS to construct a single-family dwelling with on-site
sewage disposal system with the condition that the house is 75'
from the edge of the wetlands, there is to be a 50'
non-disturbance buffer zone, and there is to be a line of staked
hay bales at 65' off the wetland line to remain during
constructon to limit any debris from washing down the hill, all
in accordance with survey last revised March 14, 2000.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
noti fication.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

authorized has not been completed. the applicant shall, without expense

Sections 301. 302, 303. 306 and 307 of the Clean Water Act of 1977

SPECIAL CONDITIONS
1. A 50 foot buffer of undisturbed natural vegetation shall be
maintained landward of the wetland boundary at all times.
2. A 50 foot buffer of undisturbed natural vegetation shall be
maintained landward of the water body at all times.
3. A snow fence or other temporary, project-limiting fence
shall be erected prior to the commencement of any permitted
activities along the upland edge of the designated buffer
area in order to prevent the inadvertent intrusion of
equipment into the protected area. The fence shall be
maintained until project completion.
4. Prior to commencement of any construction activities, a
continuous row of straw bales shall be staked end to end
along the base of the snow fence (or other temporary,
project limiting fence) on the upslope or project side of
the fence. The bales shall be maintained, repaired and
replaced as often as necessary to ensure function, until all
disturbed areas are permanently vegetated. The average
useful life of a bale is approximately 3-4 months.
Sediments trapped by the bales shall be removed to an
approved upland location before the bales themselves are
removed.

5. straw bales shall be recessed two to four inches into the
ground.
6. Use of wood treated with pentachlorophenol or creosote is
prohibited. Standard pressure treated lumber is treated
with CCA and its use is permitted.
7. All equipment and machinery shall be stored and safely
contained greater than 100 feet landward of the regulated
wetland or water body at the end of each work day. This
will serve to avoid the inadvertent leakage of deleterious
substances into the regulated area. Fuel or other chemical
storage tanks shall be contained and located at all times in
an area greater than 100 feet landward of the regulated
wetland or water body. If the above requirement cannot be
met by the permittee, then the storage areas must be
designed to completely contain any and all potential
leakage. Such a containment system must be approved by
NYSDEC staff prior to equipment, machinery or tank storage
within 100 feet of the regulated wetland or water body.
8. All areas of soil disturbance'resulting from this project
shall be seeded with an appropriate perennial grass, and
mulched with straw immediately upon ~ompletion of the
project, within two (2) days of final grading, or by the
expiration of the permit, whichever is first. Mulch shall
be maintained until a suitable vegetative cover is
established. If seeding is impracticable due to the time of
year, a temporary mulch shall be applied and final seeding
shall be performed as soon as weather conditions favor
germination and growth.
9. Suitable vegetative'cover is defined as a minimum of 85%
area vegetative cover with contiguous unvegetated areas no
larger than 1 square foot in size.

notice covenant to the deed:
"Regulated freshwater wetlands associated with Lily Pond
are located on the northern portions of the properties of
William & Georgia Manos and their heirs, assiqns or
successors. This property is subject to the provisions of
Environmental Conservation Law (ECL) Article 24, and the
conduct of regulated activities may occur only pursuant to
ECL Article 24 if prior approval is given by the New York
State Department of Environmental Conservation (NYSDEC) or
its successor(s). Regulated activities include, but are not
limited to clearing of vegetation; application of chemicals;
excavation; grading and filling; and erection of any
structure(s)."
This deed covenant shall be recorded with the Clerk of
Suffolk County within 90 days of the issuance of this
permit. A copy of the covenanted deed or other acceptable
proof of record, along with the number assiqned to this
permit, shall be sent within one calendar year of the
issuance of this permit to: NYSDEC, Regional Manager BEP.
