Moore October 29, 2013 ATTN: Betsy Perkins 51020 Main Road Southold, NY 11971 RE: James D'Addario and Janet D'Addario, Wetlands Permit No. 4995 Dear Ms. Moore, I have reviewed the Declaration of Covenants draft you submitted to this office with respect to the above referenced application concerning the fifteen foot wide non turf buffer to be established and subsequently maintained along the landward side of the bulkhead. Please be advised that a resolution has been included in the Trustee's November agenda that modifies the terms of the amended permit when it was transferred in July 2013. The amended resolution removes the reference to "two retaining walls" as an inspection of the property noted that the retaining walls were never constructed. The covenants and restrictions document must be executed and filed with the County pursuant to §275-10(K) of the Southold Town Code. Please note that a copy of this document or, in the alternative, a sworn statement attesting to the filing is to be presented to the Office of the Board of Trustees within 90 days of issuance of the amended permit. Rob Herrmann 1329 North Sea Road Southampton NY 11968 Re: GEORGE CHRISTMANN, JR., SCTM #126-5-4 Dear Mr. Herrmann, The following action was taken by the Board of Town Trustees during a Regular Meeting, held on January 22, 1999, regarding the above matter: WHEREAS, GEORGE CHRISTMANN, JR., applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated January 4, 1999 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 22, 1999, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of GEORGE CHRISTMANN „ JR. to construct a 90+' timber retaining wall to be tied into adjacent structures to east and west, backfill with approx. 100 c.y. of clean sand trucked in from upland source and replant with Cape American beach grass and remove existing landing and stairs and construct a 4' X 5' seasonal set of stairs to beach with condition that a 15' buffer area be maintained landward of bulkhead. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete proiect will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. The site is adjacent to Great Peconic Bay located in Laurel, Town of Southold, Suffolk County, New York. All work will be performed landward of the spring high tide line. Our review indicates that the proposed work does not appear to include dredging or construction activities in or over any navigable waters of the United States, the placement of any dredged or fill material in any waters of the United States (including coastal or inland wetlands) or the accomplishment of any work affecting the course, location, condition or capacity of such areas. Therefore, a Department of the Army permit will not be required. Care should be taken so that any fill or construction materials, including debris, do not enter the waterway to become a drift or pollution hazard. You are to contact appropriate local government officials to ensure that the subject work is performed in compliance with their requirements.
