New York 11971 Telephone (516) 765-1892 Fax (516) 765-1823 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD ~ November 25, 1996 Ep-Consultants Inc R()y Faje 1329 North Sea Road Southampton, NY 11968 ~P: JOSEPH BENDOWSKI SCTM n23-8-19 Dear Mr. Haje, ~he following action was taken by the Board of Town Trustees during its regular meeting held on June 25, 1997, regarding the above matter: WHEREAS, JOSEPH BENDOWSKI,applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 3, 1997, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 25, 1997, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, . . . "lOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of JOSEPH BENDOWSKI,to remove and replace (inkind/inplace) an existing 90+/-' of bulkhead and a 45' easterly return, remove and replace and existing 4' X 14' deck and a 3' X 9' stairway leading to beach, remove and replace (inkind/inplace) an existing 33+/-' jetty, and backfill with approx. 300 c.y. of clean sand to be trucked in from an upland source, and that any amount of old rotted jetty seaward of new one be removed, and that jetty be low profile. Located: 3060 Park Ave, Mattituck. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Cahill Commissioner September 5, 1997 NOTICE OF PERMIT AMENDMENT DENIAL Mr. Roy Haje El1-Consultants 1329 North Sea Road Southampton, NY 11968 RE: Application # 1-4738-01639/00001 J"clÇ I~J - {j C¡t/bd cJSr< I (¡--If Dear Mr. Haje: We have carefully reviewed your proposal to amend the existing permit to allow the extension of the authorized 33' groin to 64' in length along the Eastern property line. The following is our determination. Based upon our analysis we have determined that the extension of the groin 31' seaward of the line of apparent low water does not meet the standards for permit issuance pursuant to 6NYCRR Part 661.9(b)(1)(I), (ii) and (iii). Specifically. your proposal will have an undue adverse impact on the present and potential value of the adjacent tidal wetlands by interfering with the littoral drift of the shoreline causing additional shoaling and scour areas along the intertidal beach which will effect the benthic colonization and productivity of this area. The project is not compatible with public health and welfare because this project will adversely impact the Bendowski property as well as the adjacent property to the west by preventing the littoral deposition of sand on that beach and also increasing the scour effects on the west side of the groin leading to accelerated erosion of that property. The shadow area (or area of impact) of the proposed groin would extend approximately 125' (2.5 times the length of the structure) down drift or to the west. Since another groin exists along the western property line only 90' west of the proposed groin, an erosional area would be created between both groins leading to increased erosion of the Bendowski property.
