Rob Herrmann 1329 North Sea Road Southampton NY 11968 Re: CHARLES LO CASTRO SCTM #123-8-12 Dear Rob, The following action was taken by the Board of Town Trustees during a Regular Meeting, held on August 25, 1999, regarding the above matter: WHEREAS, Trustees Ordinance 1999 and, CHARLES LO CASTRO, applied to the Southold Town for a permit under the provisions of the Wetland of the'Town of Southold, application dated July 2, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 25, 1999, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, . . NOW THEREFORE BE IT, . RESOLVED, that the Board of Trustees approves the application of CHARLES LO CASTRO to replace within 18" approx. :124' of existing timber bulkhead and backfill with approx. 25 c.y. of clean sand to be trucked in from an upland source. Remove and replace inkind/inplace existing 61+/-' of low-profile groin, remove and replace inkind/inplace existing wood deck over bulkhead and wood steps to beach, remove existing wood deck at top of bank and construct a new 12' X 20' wood deck, and reconstruct wood steps down bank, with condition that a new survey be submitted showing no new 12' X 20' deck at top of bank, only remove and replace inkind /inplace existing decks and steps, and that plan also show a max. height of reconstructed low-profile groin to be 2.1 feet below the top of the bulkhead. Located: 2400 Park Ave., Mattituck. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete proiect will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Because the Southold Board of Trustees was unwilling to grant approval for the proposed deck, however, the applicant has decided to withdraw that aspect of the application, Instead, he wishes only to remove and replace (in-kind and in- place) the existing decks and steps on the property as depicted on the submitted survey, Therefore, I attach herewith (4) copies of a project plan revised accordingly, Please also note that the plan has been revised to depict the maximum height of the reconstructed low-profile groin to be 2,1 feet below the top of the bulkhead, which reflects the present conditions depicted on the survey, As the application now consists only of the replacement of existing structures, I trust a permit can be issued shortly, and I thank you for your attention to this matter.
